Recommended Motion:
1. That the Certificate of Sufficiency, dated May 4, 2006, for the following Initiative Petition be
received and filed: "Initiative Measure proposing requirements and sanctions on businesses
and individuals regarding day laborer agencies, the solicitation of day laborers, aiding and
abetting illegal immigration and prohibiting persons or entities from renting or leasing
property to illegal aliens.
2. That pursuant to Section 120 of the City Charter, the Council pass the ordinance without
alteration, or
3. That pursuant to Section 120 of the City Charter, the Council proceed to call a special
election at which time said ordinance shall be submitted to a vote of the people.

Certificate of Sufficiency for Initiative Petition submitted by Joseph Turner-
"Initiative Measure proposing requirements and sanctions on businesses and
individuals regarding day laborer agencies, the solicitation of day laborers,
aiding and abetting illegal immigration and prohibiting persons or entities
from renting or leasing property to illegal aliens."
Backl!round:
Section 120 of the City Charter provides that any proposed ordinance may be submitted to the
Common Council by a petition signed by qualified and registered electors of the City equal in
number to thirty percent (30%) of the entire vote cast for all candidates for Mayor at the last
preceding City election at which a Mayor was elected.
On October 10, 2005, proponent Joseph Turner filed with the City Clerk a Notice of Intention
and the written text of the proposed initiative. He requested that the ballot title and summary be
prepared and he paid the $200 filing fee as required by City of San Bernardino Resolution No.
92-82. As required by Elections Code Section 9203a, the City Attorney prepared the ballot title
and summary and it was filed with the City Clerk on October 25, 2005.
Pursuant to Elections Code Section 9208, the proponent had 180 days from the date ofreceiving
the title and summary to file the petition. The I 80th day was on Monday, April 24, 2006, at
which time Mr. Turner filed petitions containing signatures of 3, 143 voters. Thirty percent
(30%) of the entire vote cast for all candidates for Mayor was based on the votes cast for Mayor
in the November 6,2001 election when Mayor Judith Valles ran unopposed. A total of7,385
votes were cast for Mayor Valles and 30% of that number equals 2,216, which is the number of
valid signatures needed to qualify Mr. Turner's petition.
Immediately upon doing a raw count of signatures and providing Mr. Turner with a Receipt for
Petition and Certificate of Page and Prima Facie Signature Count, we hand delivered the
petitions to the County Registrar of Voters and requested that they check the petitions and that
such process be completed within 10 days (May 4,2006) as required by Charter Section 120.
On this date, May 4, 2006, we have received the attached letter from the County Registrar of
Voters Office indicating that the petition has qualified with 2,217 valid signatures, one more than
the required number of signatures.
At this point, I present the attached Certificate of Sufficiency and letter from the Registrar of
Voters so that the City Council may receive and file them. Pursuant to City Charter Section 120,
the Council now has the following options (following are verbatim excerpts from the Charter):
"(a) Pass the ordinance without alteration within twenty (20) days after the attachment of the
Clerk's certificate of sufficiency to the accompanying petition (subject to referendary
vote), and if the ordinance shall be passed by the Council, but shall be vetoed by the
Mayor, and on reconsideration shall fail of passage by the Council, then, within five (5)
days after determination that said ordinance shall have so failed of final adoption, the
Council shall proceed to call a special election at which said ordinance without
alteration, shall be submitted to a vote of the people; or,
"(b) Forthwith after the Clerk shall attach to the petition accompanying such Ordinance
his/her certificate of sufficiency, the Council shall proceed to call a special election at
which said ordinance, without alteration, shall be submitted to a vote of the people, "
Financial Impact:
$3,500 for verification of signatures by the County Registrar of Voters, This amount does not
include estimated costs for a special election should it be called.
Recommendation:
That the following motions be approved:
I. That the Certificate of Sufficiency, dated May 4, 2006, for the following Initiative
Petition be received and filed: "Initiative Measure Proposing Requirements and
Sanctions on businesses and individuals regarding day laborer agencies, the
solicitation of day laborers, aiding and abetting illegal immigration and prohibiting
persons or entities from renting or leasing property to illegal aliens."
2. That pursuant to Section 120 of the City Charter, the Council pass the ordinance
without alteration, or
3. That pursuant to Section 120 of the City Charter, the Council proceed to call a special
election at which time said ordinance shall be submitted to a vote of the people.

Attached is a letter from Kari VeIjil, Registrar of Voters, dated May 4, 2006, indicating that as a
result of such examination, 2,217 signatures were found to be valid. In order to qualify, the
petition had to have 2,216 valid signatures of registered voters in the City of San Bernardino.
Based upon the attached letter from the Registrar of Voters, the petition has qualified.

The National Day laborer Organizing Network, and its 30 organizations, express their strong opposition
to the proposed initiative for the following reasons:
This type of measure, instead of promoting the integration of members of communities separates them;
it promotes stereotypes, and it spreads hatred and discrimination against one of the most vulnerable
groups in our community. Immigrant workers are part of the communities in which they live and work.
They always have been. We are, after all, a nation of immigrants. And San Bernadino is a community
of immigrants.
At this very moment, lawmakers in Washington DC are coming together to craft a realistic,
comprehensive immigration reform bill that will likely legalize millions of people. The measure is a
transparent effort to derail those efforts. Far from attempting to make things better in San Bernadino,
this initiative is another attempt by a known radical vigilante group to advance a dark anti-immigrant
agenda. As this municipality comes together to build a stronger community, those concerned with
immigration reform should direct their efforts to appropriate venues in Washington DC.
By becoming law, this initiative would not only criminalize the most essential and human act that exists,
that is to seek for work to feed their families, it would also violate the civil rights of thousands of human
beings (hard working men and women, elderly and children), protected by the US Constitution. It would
also promote the use of racial profiling, it would lead to segregation, and it would shamelessly
scapegoat a group of vulnerable people. just for not being white or African American. let us not forget
that such discrimination once was applied towards the African American community. This time iI's
against other racial groups; all to make a political point.
Finally, this initiative would not only drive the City of San Bernardino to spend large amounts of money
and constant headaches facing lawsuits. it would create a state of apartheid against a specific
population; which goes against all the principles that built this great nation.

To the honorable Mayor Patrick Morris, City Council members, Police Chief, City
Attorney, and other distinguish members of the panel:
Dear Ladies and Gentlemen:
My name is Robert Ballantyne, I maintain my residence at 4341 Cristy Avenue, in the
city of San Bernardino, where I have been residing for the past four years, I am currently
working at Glendale Community College as a professor of History in the field of Latin
American Studies.
I take this opportunity to express total rejection to the current ordinance entitled" The
San Bernardino Illegal Immigration Relief Act Ordinance" which is being discussed in
this meeting today. My decision is based on the following reasoning:
To begin with, the person who introduced this piece oflegislation, Mr. Joseph Turner, is
apparently not a resident of our community, therefore, beside being an outsider, he has
not business with our community, in fact, he most likely does not know the problems
and issues that concerns our community in San Bernardino,
Second, the ordinance that we are debating today, in my humbled opinion, this cannot
supersede the federal government, which is the authority that competes through its
legislative branch, And, since the Congress is currently in session legislating on the
policies that will apply to Immigration, no local city, municipality or county can pass
legislation that does not match with the Congress, which is the law making body of this
country in terms of immigration. Its implementation falls on the back of the state
government, and the local governments under the state; therefore, the local city
authorities of San Bernardino can only formulate any legislation that competence thc
federal government
My opinion is shared by Dr. Jaime Regalado, a PhD professor in in Political Science and
Public Policy, and who is currently the Director of the Pat Brown Research Institute for
Public Policy, located inside the campus of CaL State University Los Angeles,
Third, more than a decade ago, Dr. Francisco Balderrama, Professor of Chicano Studies
at Cal. State L.A., wrote an interesting book titled:"A Decade of Betrayal" which is a
recollection of histories and events that took place during the decade of the 1930's. To
summarize this book, it tracks how thousands Mexicans and their families were forced to
leave their homes in California, they were obligated to walk, with their belongings and
children, all the way to the Mexican border. No time was given to them to sale their
homes, or properties, nor to seek for legal remedy. Once in Mexico, they were rejected
for being "pochos" because they did not speak fluently Spanish, nor they knew their own
customs and traditions. Many had problems adjusting to their new life, without any
financial compensation. In other words, today, in the twenty first century, you are

Today, we are seeing how one of the many right wing and extreme fascists groups kidnap
our city council members, rap them in the American flag, and introduce the agent of fear
on the residence of our beloved community. History is a valuable source to reach out and
learn the lessons of the past. Like Professor Balderrama's book, "My Kemp" allowed
Adolph Hitler to convince that the Jews, the Gypsies, and other ethnic minorities should
be exterminated. The same phenomenon occurred in Yugoslavia, and its taking place in
Daurfer, Africa. Do we want to be another authoritarian regime like China against the
Tibetan peoples?
An attack on Illegal immigrants will not solve our problems in San Bernardino, it will
makes us open to criticism and any kind of bully that comes to our neighborhood. This
should not even be in our city's agenda. We should be instead be addressing other issues
of greater importance for our city: safety and security against violent gangs; against the
sale and distribution of drugs; speculation on real state properties, in the improvement
of our street lighting, ensuring that we are prepare for a major catastrophe such as an
earthquake, or potential and destructive fires, looking into better ways to improve the
quality of our air, and more, the fixing and improving the city's draining systems, better
jobs, promoting and supporting small businesses, etcetera, but instead" we allow
ourselves to be here today accusing the immigrant community for the faults and mistakes
that we as a community have commit.
Let me say this, I shall not be a silent witness of an un justice that is about to be
committed. Attacking the most vulnerable and weak sector of our community. the one
that has no legal stand or political support, either here in the US, nor in their own country,
only shows how low can go before we reach rock bottom..
Please let me remind you that our country stands for more than laws, it supports and
response to the claim that we respect the dignity of human life, and therefore, we hold
human life as something precious. Our laws are constructed in a way to ensure that this
same principle is enforce by its power given through the law itself, as we take into
account all fonn of human condition, any race, or, humble origin, religion, or the
person's own political views. Why then listen to bias comments full of racism and hate?
Our community deserves better that what the San Bernardino Illegal Immigrant Relief
Act ordinance has to offer. Lets work to build a city where people are recognize for what
they are and do for our city, instead of listening to bigot and racist comments coming
from outsiders, who only want to divide and promote hate among us

Re: "City of San Bernardino Illegal Immigration Relief Act Ordinance"
Dear Council members,
Hermandad Mexicana Latinoamericana (HML) is a non-profit organization that
has advocated and organized in support of undocumented workers' civil, labor, and
human rights since its founding in the 1950s. We operate two offices in the Inland region
and have many members in the city of San Bernardino; we are writing this letter on
behalf of the undocumented workers and families of San Bernardino in opposition to the
proposed ordinance relieving San Bernardino of so-called illegal immigration.
It is our position that such an ordinance violates certain principles of American
civil rights and that the organization S.O.S (Save Our State) has a reputation of
attempting to initiate unconstitutional and pseudo fascist legislation. S.O.S. was the
organization that attempted to implement proposition 187 into California law only to
have that overturned by the federal courts as unconstitutional. It is also our position that
federal agents and not the city of San Bernardino enforce federal immigration law.
Regardless of any financial consideration the ordinance is unconstitutional and if
endorsed will be interpreted as a continued attack against the immigrant community. San
Bernardino City relies on the labor and purchasing power of the immigrant, in addition to
this fact, our community is inter related and any law intended to bar us from access to
housing and from seeking employment solely based on suspicion of our being
undocumented places the entire community in terror of being persecuted and will limit
the ability of local law enforcement to work efficiently.
S.O.S. as an organization does not represent the interests of the local San
Bernardino City, in fact the city is largely immigrant and unless the city wants to alienate
current and future constituents then it will not support the ordinance. Instead, we, as
HML, urge the San Bernardino City Council to oppose such proposals as the "City of San
Bernardino Illegal Immigration Relief Act Ordinance" and honor the Senate Judiciary
Committee's path to comprehensive immigration reform. We do not feel the city has any
moral or political interest in passing anti-immigrant legislation and it is our hope and
desire that the city be a city of the future and support hard working families instead of
criminalizing them.

For the last fifteen years of her life - 1944 - 1959 - my German-born grandmother never left her
fann in northeastern Iowa. She feared that as a German immigrant she might be hanned. In 1944 a
German-speaking immigrant was killed in a small town in northeastern Iowa. His crime: he was foreign-
born and did not speak English.
It pains me deeply to see the City of San Bernardino rattling its racist sabers to further cloud an
atmosphere with violence in a city torn apart by violence to create conditions for only more violence,
~ violence at a higher level and with vicious intent. Racism leads to shootings in small towns. Racism
leads to lynching those who are different. Racism leads to the legalized denial of the culture of the other.
Racism is violence.
I speak as a religious leader in the Lutheran tradition. Like most traditions, we have a rich history
of providing hospitality to those in need. During the Reformation in the 1500's, Martin Luther and his
wife offered shelter and resources to those persons whose lives were torn apart by the impact ofthe
religious movement they started. They asked not for documents; but "what do you need?" Since those
humble beginnings, our church has been present in a variety of ways to offer hospitality. The Lutheran
Immigration and Refugee Service, has worked closely with the INS of the Federal Government for years
to provide hospitality for refugees AND to provide services for those persons in "irregular
circumsta!lCes," that is the undocumented in our country. In South Africa, our church clearly sided with
the victims of apartheid and worked diligently to maintain all people's dignity and humanity. In the
Middle East we work tirelessly to oppose any form of ethnic cleansings.
For those of the Lutheran tradition involved in voting on today's resolution and those who will be
voting this fall it will be important to study and remember the provision of hospitality as a pivotal
position in our religious history and practice.

The National Alliance for Human Rights (NAHR) in collaboration with scores of pro-immigrant
rights coalitions, organizations, and supporters from throughout the country has made a call for a
political and legal mobilization to defeat the racist anti-immigrant Save Our State "City of San
Bernardino Illegal Immigration Relief Act Ordinance."
The press conference scheduled by NAHR for 2:30 p.m. in front of the statue of Martin Luther
King, located in front of City Hall will bring together attorneys from MALDEF, ACLU, and
NAHR and several leaders representing various pro-immigrant organizations and coalitions to
unfold their two-part political and legal strategy designed to defeat the Save San Bernardino
initiative spearheaded by Save Our State leader Joseph Turner.
According to Armando Navarro, NAHR Coordinator, "Starting with the Mexicano and Latino
communities of Southern California, NAHR today is launching a rainbow people's political grass
roots struggle complemented by a legal one that will seek the defeat of the SOS racist driven
initiative. San Bernardino in the coming weeks will experience an unprecedented voter
mobilization against this racist and unconstitutional Save San Bernardino Initiative that will be
multi-ethnic/racial in composition and local to national in scope."
"In the midst of a national immigration mobilization and debate, this racist initiative is indicative
of the state of political war being waged against us by right wing nativist forces in their
desperation against not just our migrant community, but particularly Mexicanos and Latinos in
general. From a social change perspective, as a city, San Bernardino symbolically will become
our "Montgomery" not only in our struggle to defeat this racist initiative, but in energizing as
well the creation of a new national pro-immigrant civil rights movement," said Navarro.
Navarro concluded, "Racist Joseph Turner is using the Save San Bernardino Initiative as an
instrument for ethnic cleansing, meaning that he is scape-goating undocumented migrants by
blaming them for the myriad of socio-economic problems plaguing the city. Wrongly he wants
their physical removal as if it was a panacea."
Concurrently, complementing the political struggle will be the legal one led by MALDEF,
ACLU, and NAHR attorneys who will challenge the unconstitutionality of the Save San

My name is Esther Portillo, I am the director of a local voter empowerment project in Riverside and
San Bernardino. About 2 years ago, myself as an organizer for libreria Del pueblo with the total
support of Father Pat Guillen and Rosa Marta, we set out to organize and help Day Laborers in San
Bernardino. We learned many things about Day Laborers in San Bernardino during that time. One
that day laborers were not only Latino of Mexican and Central American Decsent they were also War
Veterans, African American, but they had one thing in common they were working class/ working
poor men that wanted to WORK to eat and to have enough for food and rent. And I know that the
people of the San Bernardino will overwhelmingly side with the Day Laborers and with renter and
with landlords who rent to any human being regardless of race, gender, class, ect. because the people
of San Bernardino are also working class families that understand what it means to go without food,
that live day to day to survive in this city. This is the city of poor working class people and they will
side with their people who are day laborers, who are renters and they as a united community will
defeat this unconstitutional discriminatory measure and any other measure and will be victorious.
