Appeal hearing regarding denial of fireworks stand application by Praise

Backl!:round:
Ordinance MC-I138, adopted on February 18,2003, sets forth the regulations for the sale of
fireworks. Section 8.60.0S0(C) states that the maximum number oflicenses issued during a
calendar year shall be 35 and that section also sets forth the prerequisites to issuance of a
fireworks license.
There are 33 organizations returning from 2005 leaving 2 stand openings for new organizations.
Six new organizations submitted applications for a fireworks license. Three groups provided the
information required under Chapter 8.60 and met the prerequisites allowing them to be placed in
a lottery drawing for the two fireworks licenses that are available. The remaining three groups
failed to meet the prerequisites, including the application submitted under the name of Praise
Tabernacle (Exhibit A).
On March 31, 2006 a fireworks application was received under the name of Praise Tabernacle
(Exhibit A) along with the following items: Preliminary Fireworks Financial Statement (Exhibit
B), Meeting Notes (Exhibit C), Articles oflncorporation for Praise Tabernacle Baptist Church
(Exhibit D) and a $50 application fee provided by the fireworks supplier.
After receipt of the initial application, a review was made of the supporting documents. It was
noted that proof of SOlc(3) status was not included and the organization's address was unclear.
The application listed the organization's address as 4623 N. San Bernardino and the Articles of
Incorporation listed an Alta Lorna address.
Our office contacted Wayne Lewis, listed as the responsible party, to clarifY the organization's
establishment in the City for a minimum of one year and to provide a copy of their SOlc(3) from
the IRS. Mr. Lewis explained that his organization was currently meeting at Cajon High School
and prior to that time, was meeting at a Highland A venue location. Our office directed Mr.
Lewis to submit documentation showing proof of establishment in the City and a copy of the
SOlc(3) to our office no later than April 17, 2006.
Mr. Lewis came into our office prior to April 17 and provided the following additional
documents: Contract with San Bernardino City Schools under the name of Empowerment
Temple dated December 12,2005 for use of Cajon High School (Exhibit E), copy of Edison bill
dated July 20, 2005 for 2185 E. Highland Ave, Suite D (Exhibit F), and a letter from the IRS
dated April 14, 2006 addressed to Praise Tabernacle Church (Exhibit G).
After reviewing the additional documents, Praise Tabernacle was sent a letter of denial based on
the following concerns:
. Status of Articles of Incorporation #C2027390 for Praise Tabernacle Baptist Church-
Suspended (Exhibit H)
. Letter from IRS addressed to Praise Tabernacle Church dated April 14, 2006 stating - "We
have no record of your organization being recognized as exempt from federal income tax
under section SOlc(3) of the Code."
. Contract with San Bernardino City Schools for use of Cajon High School under name of
Empowerment Temple. Contract with school for time period of January 8, 2006 - April 30,
2006.
. Utility bill provided for 2185 Highland did not establish meeting place prior to March 31,
2005.
Mr. Lewis visited our office again on April 18 at which time we further explained the reasons for
denial. At this time the suspended status of the corporation was brought to Mr. Lewis' attention.
Mr. Lewis stated that the corporation papers provided were "not for his church". He explained
that Praise Tabernacle was dissolved in 2001, re-established in 2003, and a name change to
Empowerment Temple in November 2005 all at various locations.
Mr. Lewis was again directed to provide proof of non-profit status and proof that his
organization has been established in the City for a minimum of one year.
On April 28, 2006 Mr. Lewis submitted an Appeal Form and the appropriate appeal fee. In
addition the following documents were also received: Praise Tabernacle Church By Laws and
Articles of Incorporation (never filed with the State) dated September 2003 stating EIN #55-
0868648 (Exhibit 1), Empowerment Temple Christian Fellowship By Laws and Articles of
Incorporation (never filed with the State) dated November I, 2005 stating EIN #74-3175460
(Exhibit J), a statement of history of Praise Tabernacle Church (Exhibit K), and a Commercial
Property Lease Agreement for 2185 E. Highland Ave., Suites D & E, dated September IS, 2004
between Nejat Mirharooni and Praise Tabernacle Church (Exhibit L). It was confirmed with the
property manager ofthis address that Praise Tabernacle Church occupied this location from
September 30, 2004 through approximately January 30, 2005 leaving a question oftheir location
from February 2005 to January 2006.
The additional items were considered by City Clerk Rachel Clark. As the additional items failed
to show proof of non-profit status, the City Clerk upheld the original denial ofthe application.
