BACKGROUND:
Donna Braun is requesting that the fees related to a Temporary Use Permit for the church's annual
fun fair be waived. The total amount exceeds $2,000, the amount that can be waived by the Mayor or
Mayor's designee. At their meeting of May 2,2006, the Ways and Means Committee recommended
that the Mayor and Common Council waive the fees.
FINANCIAL IMPACT:
The total fee waiver is $3,078.71, as outlined on Attachment 1.
RECOMMENDATION:
Staffrecommends that the Mayor and Common Council approve the request for a Temporary Use Permit
for Our Lady of the Assumption Annual Family Fun Fair.

Donna Braun, on behalf of Our Lady of the Assumption Church/School, is requesting
that the fees related to a Temporary Use Permit for their annual Fun Fair be waived.
The applicable fees that can be waived are as follows:

Police services
Fire permit
Refuse services

Pursuant to Section 3.13.020, the Mayor or Mayor's designee may waive the established
fees in an amount not to exceed $2,000 per event. Since the total fees exceed that amount,
the Mayor and Common Council will make the determination of whether or not to waive
the fees.
Our Lady of the Assumptiollhas held this annual Fun Fair for many years, withno
detrimental impacts to the City of San Bernardino and staff recommends that the fee
waiver be approved.

Dear Mayor Morris and City Council Members,
The purpose of this letter is to request a waiver of the fees
connected to our upcoming annual FunFair on May 21"', 2006.
These would include the temporary use permit, police costs, etc.
The city of San Bernardino has undergone major demographic
change in recent years. Rapid growth in some areas has been
countered by economic downturn in others. Our school is located
in one of the latter areas.
Located on a city/county boundary line, fewer and fewer of our
students now reside in the neighborhood surrounding Our Lady of
the Assumption SchooL Consequently, our enrollment has
consistently decreased over the past five years. At the same time,
energy costs have risen significantly. Add to this our school's
mission to assist any and all with scholarships whenever feasible,
and it is readily apparent that the payment of over $2,000 in city
imposed fees for our annual FunFair will pose a financial hardship
for our school, especially since the FunFair is our major fundraiser
of the year.
We would greatly appreciate a waiver of fees for our annual event,
and we thank you for your consideration of this request.
