Recommended Motion:
1. Authorize the Director of Finance to amend the FY 2005/06 Budget by transferring $50,000 from Account
No. 240-379-5505-0000 to Account No. 240-379-5504-7617 "Pennsylvania Avenue", and by transferring
$100,000 from Account No. 240-379-5505-000 to Account No. 240-379-5504-7618 "2nd Street".
2. Adopt Resolution.

Subject:
Resolution awarding a contract to Silvia Construction, Inc., for Pavement Rehabilitation at Pennsylvania
Avenue from Baseline Street to 16'h Street, and 2"' Street from 1-215 Freeway to "E" Street, (SS06-39) and
(SS06-40). per Project Plan No. 11602. and authorization for the Director of Finance to amend the FY 05/06
Budget.
Background:
On August 1. 2005. the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital
Improvement Program (CIP) for Pavement Rehabilitation at Pennsylvania Avenue from Baseline Street to 16'h
Street, and 2"d Street from 1-215 Freeway to ''E'' Street, (5506-39) and (5506-40).
This project consists ofthe following:
I. Milling and removing damaged asphalt concrete pavement.
2. Overlay new asphalt pavement full width.
3. Paint new stripes.
4. Replace loop detectors and intersections.
The plans and specifications for this project are completed and the project was opened to public bidding on
March 21. 2006. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W.
Dodge. Construction Bid Board. High Desert Plan Room, Reed Construction Data and Bid America,
Construction Bid Source, Bid Ocean. the City's web sites, and with the San Bernardino Area Chamber of
Commerce.

Based on review of the sealed competitive bids received, staff has determined that Silvia Construction, Inc. of
Rancho Cucamonga. the apparent 10\\ bidder. has met the minimum requirements of the specifications and bid
guidelines: and. therefore. recommends that the Mayor and Common Council award the referenced contract to
Silvia Construction. Inc.

The estimated project costs are as follows:

If approved, this project is expected to begin construction in late June of 2006 and be completed by September
of 2006.
Financial Impact:
Adequate funding for these projects is available from the FY 2005106 CIP and from the State Infrastructure
Bank Loan Contingency Account. A budget amendment is needed to appropriate the additional funds needed,
due to the rise in the cost of asphalt paving and fuel and the bid amount exceeded the Engineer's Estimate.
Currently, the State Infrastructure Bank Loan (I-Bank) contingency account balance is $705, I 00. The proposed
transfer for this project will decrease the balance to $555,100. The Public Services Department is proposing to
transfer $267,000 from the I-Bank contingency account for projects on May 15, 2006, decreasing the balance to
$288.100.
It should be noted that savings from the other 29 pavement rehabilitation projects that Public Services is
performing are anticipated generate overall budget savings, which will be transferred into the contingency to
replenish the balance.
Recommendation:
I. Authorize the Director of Finance to amend the FY 2005/2006 Budget by transferring $50,000 from
Account No. 240-379-5505-0000 to Account No. 240-379-5504-7617 "Pennsylvania Avenue", and by
transferring $100,000 from Account No. 240-379-5505-000 to Account No. 240-379-5504-7618 "2"
Street".

SECTION 1. Silvia Construction, Inc., 9007 Center Avenue, Rancho Cucamonga, CA
91730, is the lowest responsible bidder for Pavement Rehabilitation at Pennsylvania Avenue from
Baseline Street to 16th Street, and 2'd Street from 1-215 Freeway to "E" Street, (SS06-39) and (SS06-40),
per Project Plan No. 11602. A contract is awarded accordingly to said bidder in a total amount of
$308,549.65, with a contingency amount of $45,282.45, but such award shall be effective only
upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The
Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of
the contract is on file in the office of the City Clerk and incorporated herein by reference as
fully as though set forth at length,
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party,
