89-492
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, MAKING
FINDINGS AND DETERMINATIONS AS TO THE BENEFIT TO
THE CITY OF SAN BERNARDINO OF THE PUBLIC
IMPROVEMENTS FOR THE VERDEMONT AREA
WHEREAS, the City of San Bernardino, California (the
"City"), is a municipal corporation and a charter city duly created
and existing pursuant to the Constitution and the laws of the State
of California (the "City"); and
WHEREAS, the Community Development Commission of the City
of San Bernardino (the "Commission") on behalf of the Redevelopment
Agency of the City of San Bernardino
(the "Agency"),
is a
redevelopment agency, a public body, corporate and poli tic of the
State of California,
organized and existing pursuant to the
Community Redevelopment Law (Part 1 of Division 24) commencing with
Section 33000) of the Health and Safety Code of the State of
California (the "Act"); and
WHEREAS, pursuant to Section 33445 of the Act, the Agency
may, with the consent of the Mayor and Common Counci 1 of the City
(the "Council"), pay all or a part of the cost of installation and
construction
of
any
building,
facility,
structure
or
other
improvement which is publicly owned either within or without the
boundaries
of
a
redevelopment
project
area
if
the Council
determines:
(1) that such buildings, facilities, structures or

other improvements are of benefit to the redevelopment project area
or the immediate neighborhood in which the project is located,
regardless of whether such improvement is within another project
area, or in the case of a project area in which substantially all
the land is publicly owned that the improvement is of benefit to an
adjacent project area of the Agency, and (2) that no other
reasonable means of financing such buildings, facilities, structures
or other improvements is available to the community, and such
determination by the Agency and the Council shall be final and
conclusive; and
WHEREAS, the City is proposing to undertake a municipal
bond financing for the purposes of funding the costs of certain
right-of-way improvements and other public improvements necessary
for the further development of the Verdemont area of the City (the
"Verdemont Area"); and
WHEREAS, the City proposes to pay debt service
municipal bond financing, in part, with revenues generated
the levy of an infrastructure fee; and
on the
through
WHEREAS, it is anticipated that the levy of the
infrastructure fee will not provide sufficient revenues to support
the municipal bond financing and the City therefore will seek
revenues from the redevelopment project areas of the Agency to
support such financing; and

WHEREAS, it is in the interests of the present landowners
within the Verdemont Area and the residents, both within the
Verdemont Area and within the City generally, that the City causes
the acquisition, construction and installation of the right-of-way
improvements and the public improvements within the Verdemont Area;
and
WHEREAS, the Verdemont Area is located in the northwestern
quadrant of the City and borders the I-215 Freeway which is one of
the major thoroughfares leading into the City; and
WHEREAS, the Verdemont Area's proximity to the I-215
Freeway makes the area a gateway to the City and the careful and
orderly development and improvement of the Verdemont Area is in the
best interests of the City; and
WHEREAS, the Verdemont Area is immediately adjacent to the
State College Project Area and the Northwest Project Area and the
development of public improvements which will permit the development
of residential units within the Verdemont Area will benefit said
Northwest Project Area and the State College Project Area by
providing a residential base for persons presently working in the
State College Project Area and the Northwest Project Area; and
WHEREAS, the well-planned development of the Verdemont Area
will benefit the entire City and all other redevelopment project
areas within the City which project areas include: the

Meadowbrook-Central City Project Area, Central City North Project
Area, Central City East Project Area, Central City South Project
Area, Southwest Industrial Park Project Area, Central City West
Project Area, Tri-Cities Project Area, South Valle Project Area and
the uptown Project Area, to the extent that it will stimulate
commercial, retail and industrial activity within such areas,
provide a residential base for persons employed within such project
areas and thereby assist in the elimination of blight within such
areas; and
WHEREAS, the Verdemont Area is one of the few remaining
undeveloped areas of the City where residentially zoned property is
available for construction of housing and there is a need for the
development of such housing in the Verdemont Area in order to
increase the existing housing supply within the City; and
WHEREAS, in order to promote the City's health, safety and
welfare, it is important that the public improvements required for
the Verdemont Area be financed in order to ensure the orderly
development of the Verdemont Area; and
WHEREAS, it is appropriate at this time for the Council to
make certain findings and determinations and take certain action
with respect to the installation and construction of the
right-of-way improvements and the public improvements.

NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
Section 1. The Recitals hereinabove are
correct and are incorporated herein by this reference.

Section 2. The Counci I consents to the payment by the
Agency of the costs of the right-of-way improvements and the public
improvements to be constructed in the Verdemont Area which are
located outside of the established redevelopment project areas of
the Agency but are of benefit to such project areas and other
neighborhoods within the City for the reasons set forth in the
Recitals hereinabove. The Council further finds and determines that
no other reasonable means of financing the acquisition, installation
and construction of the public improvements is presently available
to the City and that the City requires the use of revenues generated
from redevelopment project areas of the Agency in order to fund the
acquisition, construction and installation of the public
improvements.
Section 3. The provision of public improvements in the
Verdemont Area will help stimulate development of the Verdemont Area
which will benefit the redevelopment project areas within the City
and immediate neighborhoods by providing a residential base to other
areas of the City and by increasing commercial and industrial

activity in the redevelopment project areas of the City which will
in turn help eliminate blight within such project areas and other
areas of the City.
Section 4.
The City Clerk is hereby authorized and
directed to cause this Resolution to be transmitted to the
Commission for consideration in connection with appropriate action
by that bOdy.
Section 5.
This Resolution shall take effect upon the
date of its adoption.
