Recommended motion:
That the public hearing to hear protests on the proposed adjustment in the
Chestnut Avenue Storm Drain surcharge, from $0.09 to $0.13 per square foot,
be continued to 10:00 a.m., Monday, June 4, 1990, in the Council Chambers
of City Hall, 300 North "D" Street, San Bernardino, California.

STAFF REPORT
In May of 1989, Resolution 89-146 was adopted
establishing a surcharge for the construction of the Chestnut
Avenue Storm Drain. In subsequent actions, steps have been
taken to set up an assessment district to pay for this
surcharge. Generally, all new tracts have been conditioned to
pay "their fair share" of the costs associated with the proposed
Chestnut Avenue Storm Drain. This condition may be satisfied by
ei ther paying the $ 0.09 surcharge (in addition to the regular
storm drain fee of $0.10) or having their property included in
the assessment district.
Since May of 1989, project drawings and an engineer's
estimate have been completed for the project. The original
estimate for construction cost was $1,729,375 and the current
estimate is $2,246,271.00. Changes were required to meet en-
vironmental concerns, extend the drain in to private lands
within the National Forest Service boundary and to acquire
property for the debris basin. Addi tionally, the assessment
engineer working on the district has provided a revised estimate
of the vacant land available to be included in the district,
which is somewhat less than our preliminary estimate.
These changes (in the estimated cost and amount of
vacant land) require that the surcharge be adjusted to a level
of $0.13 per square foot, instead of the existing $0.09 per
square foot. We recommend that no adjustment be made in the
single family cap in the amount of $2,000 per unit. The change
in area ~s an adjustment of 6.39% while the cost of the improve-
ment is adjusted by 23%.
We, therefore, recommend adoption of the resolution
amending the surcharge amount from $0.09 to $0.13 per square
foot, in order to assure that suff~cient funds will be generated
from the assessments to cover the actual construction costs.
The assessments will be based upon the surcharge.
URGENCY CLAUSE:
Plans and estimates are 95% complete and it is essential that
sufficient surcharge fees be established to ensure adequate
funding of the proposed project. Work is anticipated to begin
in mid July. According to the schedule developed for this
assessment district, the Resolution of Intention will be adopted
on 5-21-90, so the adjustment needs to be done as soon as
possible.

5 WITNESSETH:
WHEREAS, development of the area in the vicinity of
7 Chestnut Avenue is contingent upon the construction of the

8 Chestnut Avenue Master Plan Storm Drain and Debris Basin, and
9 WHEREAS, construction of the Chestnut Avenue Storm Drain
10 System is needed to provide full protection from flooding for the
11 existing and future development; and
12
WHEREAS, authorization to proceed has been granted for
13 the Chestnut Avenue Storm Drain Assessment District; and
14 WHEREAS, no other financing plan has been established to
15 fund the required improvements; and
16
WHEREAS, the normal drainage fees collected within the
17 proposed assessment district boundaries, as established by
18
Resolution No.
88-114, will not be adequate to generate
19 sufficient revenue to finance the construction of the Chestnut
20 Avenue Storm Drain System, as determined by the study entitled
21
"Surcharge re:
Chestnut Avenue Storm Drain" on file in the
22 Department of Public Works/Engineering Office of the City; and
23 WHEREAS, it is necessary to impose a special fee of $0.13
24 per square foot, not to exceed $2,000 for a single family home,
25 on all development within the "Chestnut Avenue Storm Drain
26 Assessment District" in addition to the normal drainage fee of
27 $.010 per square foot for a single family home.

" (b)
Prior to building permit approval within the
5 'Chestnut Avenue Storm Drain Assessment District,' the following
6 special fees shall be paid in addition to the normal storm
7 drainage fees:

(1 )
For a single family home, a fee of $0.13 per
9 square foot of the lot, excluding dedicated streets. The special
10 fee shall not exceed $2,000.00.

For all other construction or land development,

12 including, but not limited to, commercial, industrial and
13 multiple residential, and including additions or extensions,
14 paving and other impervious areas, a fee of $0.195 per square
15 foot for the first 3,000 square feet of building area, paving or
16 other impervious area, and $0.065 per square foot in excess of
17 3,000 square feet.

SECTION 3.
Funds collected from the special drainage
