STAFF REPORT
BACKGROUND:
The following is a chronological listing of
abatement at 1432-1446 North G street, up to
incurred by the city.
events regarding the City
and including the costs
1. 5/3/89 The property was inspected and found open and vacant with
infestation of rodents/insects and in a state of disrepair.
There was trash and debris inside and outside, and
potential fire hazard.
2. 5/22/89 A correction notice and inspection report were sent to the
owner by regular mail, requiring procurement of permits and
correction of the substandard housing violations by the
owner. Notices were sent to both Electric and Gas
companies to disconnect service. The owner did not respond
or make any effort to secure the property.
3. 6/1/89 Code Enforcement section ordered an abatement of the pUblic
nuisance by a contractor since the owner(s) had not
responded. This included board-up of the building and
cleanup of debris, both inside and outside the 4-plex.
4. 6/16/89 The contractor completed the board-up ordered by the City
for 1432-1438-1438 1/4-1438 1/2 "G" Street.
4. 7/29/89 Board-up was completed by the contractor of the City
ordered board-up for 1434, 1436, 1440, 1442, 1444, and 1446
North "G" Street.
5. 1/19/90 Notice of the February 2, 1990 hearing before the BBC was
sent to the owner of record by certified Mail. This
mailing was returned by the Post Office as undeliverable
after the BBC hearing, and arrived at Code Enforcement on
February 16, 1990..
6. 2/2/90 The BBC heard the case as an uncontested abatement and
ordered that costs be incurred.

Because the current owners acquired the property after the filing of
the N.O.P. and the City incurred abatement costs, staff recommends
that the Council uphold the order of the Board of Building
Commissioners on February 2, 1990, to incur costs of the Code
Enforcement action at 1432-1446 North G street as a lien against the
property and a personal debt of the owner(s).

This letter is to further clarify our letter to council regarding
the property located at 1432-1446 G Street in your city.
As previously stated we recently acquired the property thru the
foreclosure process and are striving to improve the site to
encourage good tenants and to eliminate all problems previously
experienced by the city. The following requests of the council
would give us the opportunity to use availabe funds immediately
to take all corrective action.
A. We request that council immediately issue all
permits to proceed with the rehabilation construction
necessary
B. We request a reduction of the deliquent
owner to Four thousand dollars
charges from previous
C. We request the establishment of a monthly payment plan for
this reduced amount to commence July 1 1990
These requests are made so that our funds can be used to
immediately bring the complex up to standard thus removing this
blight from your city and provide much needed housing.

Thru a foreclosure process we have recently 3cqu~red the property
at 1432-1446 G Street 1n your city. Our plan lS to work with the
City R~habilation Program to rehab all of the units dnd then to
rent them out thYIJ the HUD Section 8 program. We did this
previously with a single ~amily property within the County of San
Bernardino and it was.very successful for all concerned.
You can hopefully understand our complete surprise and dismay
when we were informed that there were previous fines and costs on
the property from the Board of Building Commission. Our reguest
to you is to' forgo ttlese costly expenses as the property is
brought up to your standards. Our commitment to you is to make
monthly payments towards this debt so that our sincerety is
~vijent with any reductlon of fines being made after r~sults of
this commitment are observed.

BERNARDINO AUTHORIZING TIlE ABATEMENT OF A PUBLIC NUISANCE.
WHEREAS. pursuant to the San Bernardino I~nicipal Code. Title 15.
Chapter 15.28. the Building Official has posted a building(s) located at
1432 - 1446 North 'G' Street
. San Bernardino. California. and has
notified person(s) having an inte~est in the above property that the build-
ings(s) or premises constitute a public nuisance;
WHEREAS. pursuant to San Bernardino Municipal Code. the Building Official
has served a "Notice of Hearing Before the Board of Building COIIII1issioners of
.the City of San Bernardino", relating to abatement of said nuisance. to the
person(s) having an interest in the above property. and has prepared a
declaration of mailing of the notice. a copy of which is on file in these
proceedings; and
WHEREAS. a hearing was held to receive and consider all relevant
evidence. ob.i,ections or protests on Februarv 2.

WHEREAS. the Board of Building Commissioners heard the testimony and
examined the evidence offered by the parties relative to the alleged public
nuisance,
NOW. THEREFORE. IT IS ORDERED BY THE BOARD OF BUILDING COMMISSIONERS OF
THE CITY OF SAN BERNARDINO 'AS FOLLOWS:
SECTION 1. Based upon the evidence submitted. it was found and
determined that the building(s) and/or premises located at 1432-1446 N. 'G' St
San Bernardino. California. constituted a public nuisance for the reasons set
forth in Exhibit "Au. attached hereto and incorporated herein by reference
as though fully set forth at length as the findings of fact of the Board.

SECTION 2. Based upon the evidence submitted. it was determined that the i

shall be the personal obligation of the owner(s) as well as a lien on the

SECTION 3. Any person aggrieved by this order may, within fifteen (15)
days after Februarv 28. 1990 , appeal to the Common Council by filing with
the City Clerk a written statement or the order appealed from the specific
9rounds of appeal and the relief or action sought from the Common Council.

is hereby notified to appear before the Board of Commissioners of the City
of San Bernardino at its meeting to be held on February 2, 1990
at the Council Chambers, City Hall, 300 North "0" Street, San Bernardino,
California, at the hour of 9:00 a.m. or as soon thereafter as he may be
heard and show cause, if any he has, why said building should not be condemned
as a public nuisance and said nuisance be abated by the City of San Bernardino
by repairing, rehabilitation or demolishing and removing same and charging
the costs thereof to the owner as provided in the San Bernardino Municipal
