Synopsis of Previous Council action:
None
Recommended motion:
That the City Engineer and City Clerk are authorized to proceed with initiating
proceedings for the establishment of an assessment district under the provisions
of Chapter 12.90 of the San Bernardino Municipal Code and that the City Engineer
is directed to prepare an Engineer's Report for the proposed front yard setback
maintenance within Tentative Tract No. 13307.

STAFF REPORT
A petition has been received by this office requesting the formation of an
assessment district for the maintenance of front yard setbacks adjacent to all
public streets within Tentative Tracts No. 13307. This petition is the result of
requirement by the City for the Developer to establish the district. The
assessment will include all maintenance costs and related administrative costs.
The signatures affixed to the referenced petition have been checked and found to
represent the owners of 100 percent of the area of the property lying within the
proposed boundaries of the district to be assessed for the proposed maintenance.
The actual amount of the assessments for each parcel within the proposed district
will be the actual costs incurred for maintenance of that given parcel. if any.
This will only occur if the property owner(s) fail to properly maintain the area
within the front yard setback, and the City must do the maintenance.
The developer will be required to pay the cost of the proceedings for
establishment of the district in advance.
