HARDGRAVE, Director of Public Works/ City Engineer SUBJECT: Item No. 12 on Council Agenda of 4-16-90 -- Adoption of Negative Declaration for Vacation of Lugo Avenue, North of 4th Street DATE: April 27, 1990 COPIES: File No. 15.30-268, Reading File At the Council meeting of 4-16-90, this item was continued to 5- 07-90, in order to afford an opportunity to find a solution to Mr. Tracadas' concerns. During the first environmental review, a concept was worked out to provide a connector street, from Sierra Way to Lugo Avenue. However, after this proposal had received a negative declara- tion, the applicant withdrew the application, apparently due to concerns over the amount of property they would have to dedicate for the connector street. A new environmental study was prepared on the basis of vacating a portion of Lugo Avenue and constructing a cul-de-sac at the terminus of the dedicated street. This study was reviewed by the Environmental Review Committee at their meeting of 2-1-90, and a recommendation made for issuance of a Negative Declara- tion. During the public comment period, Mr. Frank Tracadas submitted a letter objecting to the proposed vacation, on the basis that traffic, noise and air quality studies needed to be done before the Negative Declaration could be adopted. These comments were reviewed by the Environmental Review Committee at their meeting of 3-15-90. Mr. Tracadas appeared at this meeting to voice his concerns. After reviewing the comments in the letter, and the oral comments made during the meeting, the Environmental Review Committee determined that the evidence in the record supported the finding that the proposed vacation could not have a signi- ficant impact on the environment and voted to re-affirm their original recommendation for adoption of a Negative Declaration. 55 MARSHALL W. JULIAN Vacation of Lugo, North of 4th April 27, 1990 Page - 2 - Mr. Tracadas owns three parcels. One is developed and fronts on Sierra Way. The second is vacant and fronts on both Sierra Way and Lugo Avenue, and the third is vacant and fronts on Lugo Avenue. All three parcels are zoned CO - 1, Commercial Office. The present average daily traffic on Lugo Avenue is 375. Mr. Tracadas plans to develop an office building on the third parcel fronting on Lugo Avenue. He is of the opinion that two means of access would be preferable to only one. This is the basis for his objection to the proposed vacation. I met with Mr. Tracadas to attempt to develop a solution. The only solution acceptable to Mr. Tracadas is to provide the connector street to Sierra Way. This proposal is not acceptable to the applicant. Therefore, the Mayor and Council have the following options: 1. Adopt the Negative Declaration as recommended, over the objection registered by Mr. Tracadas. 2. Refer the proposed vacation back to the Environmental Review Committee, to amend the proposal to include a connector street to Sierra Way. The following form motions are presented for the above options: Option No.1 -- I. That the Negative Declaration for Public Works Project No. 89-47, vacation of a portion of Lugo Avenue, north of Fourth Street, be adopted. 2. That a finding be made that the vacation of a portion of Lugo Avenue, north of Fourth Street, is consistent with the circulation element of the General Plan. Option No.2 -- That the Negative Declaration for Public Works Project No. 89-47, Vacation of a portion of Lugo Avenue, north of Fourth Street, be referred back to the Environmental Review Committee for amendment of the initial study to include a connector street to Sierra Way. A single means of access (from Fifth Street) is adequate to accommodate the average daily traffic, including the additional MARSHALL W. Commercial office buildings generally do not rely upon easy access for success. Therefore, we recommend that the form motions under Option No. 1 be adopted. ()A7fi ROGER G.
