Synopsis of Previous Council action:
On March 3, 1990, the Community Development Commission approved the Joint

STAFF REPORT
On March 19, 1990, the Mayor and Common Council and Community
Development Commission approved a joint development agreement
between the City, Agency and CFB Investments, Ltd. The agree-
ment provided for the expenditure of Twenty Percent Set-Aside
housing funds for the construction of two-hundred, twenty eight
(228) apartment units.
Because the low to moderate income housing funds are to be spent
outside the boundaries of redevelopment project areas, it is
necessary for the Mayor and Common Council and Community
Development Commission to adopt a mutual benefit resolution.
Although this project principally benefits the State College
Redevelopment Project Area, housing funds from ,other project
areas also contributed to the total amount of agency assistance
($1,650,000). The low and moderate income residents of other
project areas will also benefit from the construction of the
subject units.
I recommend adoption of the attached resolution.

RESOLUTION NO.
A RESOLUTION OF THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO MAKING
FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF
ASSISTING IN THE DEVELOPMENT OF A LOW- AND
MODERATE-INCOME MULTIFAMILY HOUSING PROJECT
(SHADOW HILLS PROJECT)
WHEREAS, the City of San Bernardino, California (the
"City"), is a municipal corporation and a charter city duly created
and existing pursuant to the Constitution and the laws of the State
of California; and
WHEREAS, the Community Development Commission of the City
of San Bernardino (the "Commission") on behalf of the Redevelopment
Agency of the City of San Bernardino (the "Agency"),
is a
redevelopment agency, a public body, corporate and pOlitic of the
State of California, organized and existing pursuant to the
Community Redevelopment Law (Part 1 of Division 24) commencing with
Section 33000) of the Health and Safety Code of the State of
California (the "Act"); and
WHEREAS, the City and the Agency have previously approved
and adopted the Redevelopment
Plan
for
the
State COllege
Redevelopment Project (the "Redevelopment Plan"); and
WHEREAS,
the
Agency
may,
in
furtherance
of
its
redevelopment purposes, undertake redevelopment projects and may use

revenues allocated to its low- and moderate-income housing fund in
accordance with Health and Safety Code Section 33334.2, .e..t ~.,
either within or without a redevelopment project area of the Agency
to the extent that it determines that the use of such revenues are
of benefit to the project area of the Agency; and
WHEREAS, the Agency deems it desirable to assist in
financing of the development of a low- and moderate-income
multifamily housing project known as the Shadow Hills Project (the
"Housing Project") which Housing Project is located in proximity to
the boundaries of the project area subject to the Redevelopment Plan
(the "State College Project Area"); and
WHEREAS, the Housing Project will result in the
construction of approximately two hundred eighty-eight (288) new
multifamily residential dwelling units for low- and moderate-income
families and it is in the interests of the City and the Agency that
the Agency causes the undertaking of the Housing Project in order to
improve and increase the community's supply of low- and
moderate-income housing; and
WHEREAS, the Housing Project is located in proximity to the
State College Project Area and accordingly will provide a
residential base to persons employed or engaged in business in the
State COllege Project Area which in turn will make the State College
Project Area more desirable for development; and

WHEREAS, the undertaking of the Housing Project will also
promote the development of other redevelopment project areas within
the City which project areas include: the Meadowbrook-Central City
Proj ect Area, Central City North Proj ect Area, Central City East
Project Area, Central City South Project Area, Central City West
Project Area, Tri-Cities Project Area, Southeast Industrial Park
Redevelopment Project Area, South Valle Project Area, Northwest
Project Area and the Uptown Project Area, to the extent that it will
also provide a residential base to low- and moderate-income families
who are employed or engaged in business wi thin such other project
areas of the Agency which in turn will make such project areas more
desirable for industrial and commercial development; and
WHEREAS, in order to promote the City's health, safety and
welfare and ensure the orderly development of the State College
Project Area and the Agency's various other project areas, it is
important that the Housing Project be assisted with Agency
financing; and
WHEREAS, it is appropriate at this time for the Mayor and
Common Council of the City (the "Council") and the Commission to
make certain findings and determinations and take certain action
with respect to the financing of the Housing Project.

NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION ACTING
ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The Recitals hereinabove are true and
correct and are incorporated herein by this reference.
Section 2. The Commission consents to the payment by
the Agency of certain costs in connection with the financing of the
Housing Project in order to implement the Redevelopment Plan and
other redevelopment plans of the Agency for the reasons set forth in
the Recitals hereinabove. The Commission further finds and
determines that no other reasonable means of financing the Housing
Project is presently available to the City or the Agency and that
the City and the Agency require the use of low- and moderate-income
tax increment revenues generated from the State COllege Project Area
and other project areas of the Agency in order to assist in the
funding of the Housing Project.
Section 3. The undertaking of the Housing Project will
allow the Agency to promote redevelopment within the State COllege
Project Area and other project areas of the Agency by providing a
residential base to low- and moderate-income households and families
who may be employed or engaged in business within the State College
Project Area and other project areas which in turn will help
stimulate development of. such project areas and their immediate
neighborhoods and thereby eliminate blighting conditions.

Section 4. The Secretary of the Commission is hereby
authorized and directed to cause this Resolution to be transmitted
to the Mayor and Common Council for appropriate action by that bOdy.
Section 5.

Effective Date. This Resolution shall take

I HEREBY CERTIFY that the foregoing resolution was duly
