Resolution of Intention No. 90-112 was adopted, which sets a
public hearing date of 05/07/90 for the proposed vacation of
a "U" shaped alley lying between Olive Street and 10th Street, and
between Arrowhead Avenue and "D" Street.
Recommended motion:
1. That the hearing be closed and the Findings of Fact as set forth in the Staff
Report from Roger G. Hardgrave, Director of Public Works/City Engineer as to
why that certain "U" shaped alley lying between Olive Street and 10th Street
and between Arrowhead Avenue and "D" Street. is no longer necessary for
street purposes. be adopted.
2. Adopt Resolution.

STAFF REPORT
Staff received a request from the Housing Authority of the County of San Bernardino to
vacate that "U" shaped alley lying between Olive Street and 10th Street and between
Arrowhead Avenue and "D" Street. The request was made in order to better use their
property, as HACSB owns property on both sides of the alley. Also, the EastfWest
portion of the alley (even though it has garages opening out on to it - no car has
been through there for several months) is, for all practical purposes, abandoned and
has become a trash dumping site. Authorization to Proceed was given on 12/04/89, to
proceed with the proposed vacation and Plan No. 7968 was approved.

On 03/05/90, a Negative Declaration was adopted for the proposed vacation, and a
finding of consistency with the General Plan was made.
On 04/02/90, Resolution of Intention No. 90-112 was adopted. That Resolution sets a
public hearing date of 05/07/90. On 04/11/90, the Resolution of Intention was
published in a local newspaper, Notices were posted in the area proposed for vacation,
and all property owners adjacent to the proposed vacation were notified of said
hearing.
There appears to be no further necessity for that certain "U" shaped alley lying
between Olive Street and 10th Street and between Arrowhead Avenue and "D" Street,
either for present or future street purposes. Staff recommends the vacation on the
basis of the following Findings of Fact:
1. The above portion of the street has been determined by the Department of Public
Works to be of no further necessity to the general public:
a) Negative Declaration was adopted, and a finding of consistency with the
General Plan was made.
b) Traffic flow does not warrant an alley in this area.
2. None of the adjoining property owners has protested the vacation proceedings and
the required S400.00 fee has been paid.
3. All of the concerned City Departments and Utility Companies were notified of the
proposal and all have had the opportunity to respond. No easement reservations
were requested.
No special requirements have been placed upon the proponents relative to the
proceedings which would require an inspection of the area prior to the adoption of the
Resolution Ordering Vacation. Therefore, we have attached the said Resolution Ordering
Vacation for your action.

A RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION
OF A "U" SHAPED ALLEY LYING BETWEEN OLIVE STREET AND 10TH STREET, AND
BETWEEN ARROWHEAD AVENUE AND "0" STREET, IN SAN BERNARDINO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1 :
The Mayor and Common Council of the City of San
Bernardino,
having heard the evidence offered in relation to the proposed
7 vacation of that "U" shaped alley between Olive Street and 10th Street and
8 between Arrowhead Avenue and "D" Street, more particularly described in City
9 Resolution of Intention No. 90-112, hereby find from all of the
evidence
10 submitted that such alley proposed to be vacated by said Resolution is
11 unnecessary for present or prospective street purposes.

SECTION 2.
The Mayor and Common Council of said City do hereby
13 vacate that "U" shaped alley between Olive Street and 10th Street and
14 between Arrowhead Avenue and "D" Street, in San Bernardino,
California,
15 more particularly described as follows:
16 That certain 12 foot North/South alley; 15 foot EastfWest
alley; 9 foot North/South alley, as delineated on the map
17 of Home Builders Monte Vista Tract, as per plat recorded
in Book 18 of Maps, Page 58, in the office of the County
18 Recorder of San Bernardino County, State of California,
adjoining Lots 3, 4, 5, 6, 9, 10, II, 12, 13, and 14 of
19 said Tract; TOGETHER WITH the South 155 feet of Lot 18 of
said Tract, as described in the deed to the City of San
20 Bernardino by document No. 129, recorded April 2, 1929,
in Book 481, Page 243, Official Records of said County.

22 And is also described in said Resolution of Intention No. 90-112.

SECTION
3.
Nothing in this Resolution shall in any way affect
24 or disturb any existing easements for public utility purposes belonging
25 either to the City of San Bernardino or to any public utility.

SECTION 4.
The City Clerk of the City of San Bernardino shall
27 cause a certified copy of this resolution to be recorded in the office of
28 the County Recorder of the County of San Bernardino.
