STAFF REPORT
The attached resolution relates to the establishment of a fee
for the recovery of abandoned shopping carts. This item was
approved by the Legislative Review Committee at their April
5, 1990 meeting. Although the initial proposal to regulate
abandoned shopping carts was the development of an ordinance
specifically detailing enforcement and abatement guidelines,
further review of the Municipal Code revealed that Chapter
12.44 and Title 8 provided the necessary authority for the
Public Services Department to remove abandoned shopping carts
in the public riqht-of-wav.
The proposed resolution recommends the establishment of a fee
of $15.00 per cart to recover the City's costs associated
with the removal and storage of abandoned shopping carts.
Under the established procedure of the Public Services
Department, an abandoned shopping cart which is picked up
will be impounded for a period of 60 days. The shopping cart
will be released to its owner only after the $15.00 per cart
fee is paid. If the shopping cart is not claimed by its
owner within the 60 day period, it will be disposed of, or
sold at public auction.

FOR THE RECOVERY OF ABANDONED SHOPPING CARTS.

WHEREAS, abandoned shopping carts in parkways and on the
4
public right-of-way are hazardous to the health and safety of
5
residents; and
6
WHEREAS, the Public Services Department is responsible for
7
removal of abandoned shopping carts which are left in parkways
8
and the public right-of-way; and
9
WHEREAS, abandoned shopping carts are considered to be a
blighting influence; and
WHEREAS, the removal of shopping carts is consistent with
the City's goal of blight abatement; and
WHEREAS, the City is entitled to the recovery of reasonable
costs associated with the removal of abandoned shopping carts;
and
WHEREAS, Title 8 and Chapter 12.44 of the San Bernardino
Municipal Code authorize City staff to remove abandoned shopping
carts; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
A fee of $15.00 shall be charged for the
release to the owner of each abandoned shopping cart removed from
public right-or-way and impounded by the City.
SECTION 2. Any shopping cart not claimed by the owner with
all fees paid, within sixty (60) days after impoundment by the
City, may thereafter be appropriated for use by the City,
disposed of, or sold at public auction by the Public Services
