Agenda Item No. .t..3 CITY OF SAN BER~_ARDINO - REQUEST .,OR COUNCIL ACTION STAFF REPORT The Billboard Control Act of 1989 is pending before the House Surface Transportation Subcommittee, chaired by California Representative Norm Mineta. This House Resolution would repeal some fundamentally flawed provisions of the Highway Beautification Act of 1965. The legislation would: 1. Return to states and local governments the right to regulate existing billboards under their own land use laws. 2. Place a moratorium on new billboard construction along interstates and federal primary aid highways. 3. Provide for the removal of nonconforming billboards after September I, 1995, by cash payments or amortization. It should also be noted that Congressman George E. Brown has agreed to co-sponsor H. R. 3389. Resolutions in support of H. R. 3389, THE BILLBOARD CONTROL ACT OF 1989. WHEREAS, H. R. 3389, the Billboard Act of 1989 was introduced by Congressman John Lewis of Georgia on October 2, 1989; and WHEREAS, H. R. 3389, returns to states and local governments the right to regulate existing billboards under their own land use laws; and WHEREAS, H. R. 3389, places a moratorium on new billboard primary aide construction along interstates and federal highways; and WHEREAS, H. R. 3389, shall find a State to be in non- compliance if vegetation, located on any land on which the State owns a right-of-way, is allowed to be cut, altered, or removed for the purpose of improving the visibility of any outdoor advertising sign, display or device; and NOW, THEREFORE, BE IT RESOLVED THAT the Mayor and Common Council of the City of San Bernardino does hereby support H. R. 3389; FURTHER, BE IT RESOLVED that the City Council of the City of San Bernardino is working with the members of the Corridor Beautification Committee to improve the 1-10 Corridor.
