REOUEST
The applicant, Jack Strickler for Lutheran Highland Avenue
Church, is appealing certain conditions of approval by the
Planning Commission for Parcel Map No. 13158. The applicant
requests that the Mayor and Council reconsider those certain
conditions and delete them as conditions of approval. (See
Exhibit "A")
BACKGROUND
Parcel Map No. 13158 is a request to subdivide one parcel
consisting of 5.95 acres into two lots consisting of 2.59
acres and 3.36 acres. The site is the location of Lutheran
Highland Avenue Church located at 1820 East Highland Avenue
generally situated at the northeast corner of East Highland
Avenue and Osbun Road. The property is designated CG-1,
General Commercial - 1, by the General Plan. The Parcel Map
meets all standards of the Municipal Code and is consistent
with State Law and the General Plan. Parcel Map No. 13158 is
exempt from the California Environmental Quality Act under
section 15315, Class 15.
APPEAL REOUEST/BASIS OF APPEAL
The applicant is appealing the following two conditions
regarding the requirements for undergrounding of utilities
and constructing street lights.

"All existing overhead utilities adjacent to or
traversing the site on either side of the street shall
be undergrounded in accordance with Ordinance No. MC-
601 (Subdivision) or Resolution No. 88-65 (Non-
sUbdivisions) ."

The basis of appeal is that the applicant feels that the two
requirements are two expensive to apply to this project.
Expense is not a valid reason for not applying. Municipal Code
requirements. If it was, every project would appeal the
requirements and not build the required public improvements.
However, Ordinance No. MC-601 is in the process of being
amended (See Exhibit "D"). This amendment .would have a
direct bearing on Condition No. 5 in that it proposes to
exempt "the previously developed portions of any non-
residentially zoned parcels" from the requirement to
underground utilities. The challenge here is to exempt
churphes from undergrounding without allowing previously
developed commercial or industrial land reuse, redevelopment
or other subsequent Planning approvals to escape underground-
ing. Condition No. 10 would not be affected by the proposed
ordinance amendment. section 18.44.070 allows the city
Engineer to require the installation of street lights as a
condition of approval of a subdivision.
RECOMMENDATION
It is recommended that this item be continued until the first
Council meeting in July, by which time the ordinance
amendment should be in effect. This would allow some relief
to the applicant by deleting Condition No.5, because the
project would then be exempt from the requirement to under-
ground utilities.

Dear Sir,
I am writing to you on behalf of the Highland Ave. Lutheran Church. who
is the applicant/owner in the above mentioned parcel map request.
The request was approved on Tuesday March 6 meeting of the Planning
Commission.
We are objecting to standard requirements 05 page 11 of the condition of
approval and #10 page 12. We feel that these two requirements are to
expensive to apply to this project.
I discussed this situation with Mr. Hardgrave and he suggested that I contact
you. He told me that the Legislative Review Committee is presently studying
this ordinance and Resolution for some possible modification.
I attempted to call you to discuss our situation but found you were
unavailable for a few weeks, so I talked to Mr. Reilly about this matter
and I am certain that he will relay our concerns and problems. Mr. Reilly
suggested I contact you and request this item be put on the Legislative
Review agenda as soon as possible.

SITE LOCATION
The site is located at 1820 East Highland Avenue, generally
situated at the northeast corner of Highland Avenue and Osbun
Road (See Attachment "F").
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed subdivision is consistent with the Municipal
Code and in conformity with the General Plan as shown in
Attachment "A".
CALIFORNIA ENVIRONMENTAL OUALITY ACT STATUS
Parcel Map No. 13158 falls within Section 15315, Class 15, of
projects exempted from the California Environmental Quality
Act.
BACKGROUND
The subject site is developed with a church, Sunday School
facilities, and playground at the south portion of the site.
The northern portion of the site is unpaved and consists of a
basketball court and baseball field. Surrounding land uses
consists of multiple family residential to the north, single
family residential to the south, commercial to the east and
commercial and multiple family residential to the west.
ANALYSIS
LOT CHARACTERISTICS
The proposed Parcel Map will subdivide the approximately 5.95
acre parcel into two lots. Lot one will consist of approxi-
mately 2.59 acres. The proposed 2.59 acre lot will consist
of an unpaved surface with a basketball court and part of a

baseball field. Lot two, proposed at the southern section of
the site will be 3.36 acres in size and will maintain the
existing church, sunday School facilities, and playground.
The proposed parcel map is intended for the future develop-
ment of proposed lot one which is undetermined at this time.
ACCESS AND PARKING
Proposed lot two will have access off of Highland Avenue and
Osbun Road; Proposed lot one will take access from Osbun
Road. In terms of parking, the existing church and Sunday
School have approximately 123 parking spaces on site which
exceeds the required approximately 88 on-site parking spaces
. (see Attachment "A"). The subdivision of the 5.95 acre lot
, will not effect the current parking situation. Osbun Road
will be dedicated (an additional five feet) and improved to
meet the requirements of the Public Works Department.
CITY AND STATE REQUIREMENTS
The proposed Parcel Map is consistent with the prov1s10ns of
Title 18 of the Municipal Code and the Subdivision Map Act of
the State of California, in that each parcel is of buildable
size and has access from a dedicated street. The street
frontage for lot one and two is 240 feet and 397.17 feet,
respectively.
COMMENTS RECEIVED
The proposal was reviewed by the Development Review Committee
(DRC) on their February 15, 1990 meeting. The DRC recom-
mended approval of the proposed parcel map and their comments
have been incorporated as Standard Conditions of Approval.

TENTATIVE PARCEL MAP FINDINGS (Section 18.28.050 SBMC)
1. Parcel Map 13158 is consistent with the General Plan in
that it meets all standards of the General Plan and
Municipal Code as they pertain to the subdivision of
property in the CG-1, land use designation.
1. All lots created conform to the lot reauirements of the
Municipal Code and >all provision of Title 18 in that
they are of buildable size and have access from a dedi-

Minor modifications to the plan shall be subject to approval
by the Director of Planning. An increase of more than 10
percent of the square footage or a significant change in the
approved concept shall be subject to (Planning Commission and
Development Review Committee) review and approval.
Construction shall be in substantial conformance with the
Plans approved by the Development Review Committee, Planning
Commission or Director of Planning.
The developer is to submit a complete master landscape and
irrigation plan (4 copies) for the entire development to the
Engineering Department with the required fee for approval,
the landscape plans will be forwarded to the Parks,
Recreation, and community Services and the Planning
Department for review and approval. (Note: the issuance of a
building permit, by the Department of Building and Safety of
the City of San Bernardino, does HQI waive these
requirements/conditions.) No grading permits will be issued
prior to approval of landscape plans.
The design shall include, but not be limited to the
following:
Street trees shall be planted on 35 foot center
spacing unless otherwise indicated by the Department
of Parks, Recreation, and Community Services. The
Parks Department shall determine the varieties and
locations prior to planting. A minimum of 25% of the
trees shall be 24" box specimens. Trees are to be
inspected by a Park Division representative prior to
planting.

2. ~Each parcel shall be provided with separate water and sewer
facilities so it can be served by the City or the agency providing
such services in the area.
3. ~Sewer main extensions required to serve the site shall be
constructed at the Developer's expense. Sewer systems shall be
designed and constructed in accordance with the City's "Sewer
Policy and Procedures" and City Standard Drawings.

5. )c All existing overhead utilities adjacent to or traversing the site
----on either side of the street shall be undergrounded in accordance

relocated at the Developer's expense as directed by the City
Engineer.
Sewers within private streets or private parking lots will not be
----maintained by the City but shall be designed and constructed to
Ci ty Standards and inspected under a Ci ty On-Site Constructi on
Permit. A private sewer plan designed by the Developer's Engineer
and approved by the City Engineer will be required. This plan can
be incorporated in the grading plan, where practical.

Street Improvement and Dedications:
7. ~All public streets within and adjacent to ~he development shall be
improved to include combination curb and gutter, paving, handicap
ramps. street 1 i ghts. si dewal ks and appurtenances. incl udi ng. but
not -limited to. traffic signals. traffic signal modification.
relocation of public or private facilities which interfere with
new construction. striping. signing. pavement marking and markers.
and street name signing. All design and construction shall be
accomplished in accordance with the City of San Bernardino "Street
Improvement Policy" and City "Standard Drawings". unless otherwise
approved by the City Engineer. Street lig.hting. when required.
shall be designed and constructed in accordance with the City's
"Street Lighting Policies and Procedures". Street lighting shall
be shown on street improvement plans except where otherwise
approved by the City Engineer.

right-of-way (R.W.) to provide the distance from street centerline
to property line and placement of the curb line (C.L.) in relation
