Drainage from Small Canyon Channel presently is directed
to Highland Avenue, where it flows westerly to Sand Creek. The
Storm Drain Master Plan shows a 57-inch pipe in Highland Avenue,
from Small Canyon Channel to a point west of Palm Avenue.
Cal trans has agreed to accept the drainage from Small
Canyon Channel into their drainage system for Route 30 Freeway.
In order to accomplish this agreement, a 48-inch storm drain
will need to be installed, from the terminus of the improved
channel north of Highland Avenue to Atlantic Avenue. Caltrans
agreed to include this storm drain in their contract for the
freeway, if funds can be provided to finance the estimated cost
of $119,000.
Realigning the drainage from Small Canyon Channel to the
freeway system will allow the 57-inch pipe in Highland Avenue to
be deleted, and the remaining pipes and channels to be
downsized, at a considerable savings in cost.
At the Council meeting of 9-21-87, the recommendation
from the Ways and Means Committee that the City participate in
the amount of $119,000, was approved. An amount of $119,000 was
approved in the 1988/89 Storm Drain Construction Fund Budget
under Account No. 248-368-57826.
Dedication of the necessary right-of-way for the 48-inch
pipe was made a condition of approval by the County for a pro-
posed development. However, the development failed to proceed
and the Qeducti~m has not been granted. This property subse-
quently became a part of the City of Highland upon incorpora-
tion.
According to the attached letter from David Barmakian,
Ci ty Engineer, the City of Highland does not presently have
sufficient funds to finance the acquisition of the necessary
right-of-way. A request was presented to Cal trans to advance
the necessary funds for acquisition of the right-of-way. How-
ever, they are not able to advance the funds.
Mr. Barmakian proposes that the City of San Bernardino
up front the funds for acquisition of the right-of-way. The City
of Highland' has adopted Storm Drain Development Impact Fees,
which will provide a revenue stream to repay the funds advanced.
Draining the flows from Small Canyon Channel to the
freeway drainage system has some obvious advantages, and there
is concurrence that this should be done if the necessary funds
can be identified. Therefore, we recommend that the proposal be
approved, subject to execution of an appropriate co-operative
agreement.

Also, we recommend that $63,617 be transferred from the
appropriated amount of $784,267 for the storm drain along the
north side of Patton Hospital. This project is on hold until
the design of the golf course on Patton HoS"pital property is
completed. We anticipate that the funds will be repaid before
construction on this project is ready to proceed.

Reference: Small Canyon Storm Drain Easement
Dear Mr. Hardgrave:
In accordance with our recent phone conversation and our
previous conversation at the Zone 2 Flood Control District
meetings, I'm providing a brief summary of our status to date
in the city's attempt to obtain a storm drain easement south of
Hig~land Avenue for the referenced storm drain. The proposed
easement which is based on the CalTrans plans for this storm
drain is basically on the easterly boundary of Assessors
Parcel Numbers 287 - 081 - 42, 43 and 44.
We attempted, beginning back in January of 1989, to obtain the
easements from the property owners by means of a donation. It
should be pointed out that the same person owns two of the
three parcels (a Mr. Ron Roehler) with the middle parcel being
owned by Mr. Robert E. Overtree, et al. Despite several
meetings with the property owners our attempts to get donation
of the easement proved unsuccessful. In October of 1989 we
wrote to Mr. Bruce Kean at CalTrans requesting the State's
assistance in fronting the monies necessary for obtaining
the easement through condemnation. The city had a Real Estate
Appraisal Service, C.M. Benefiel and Associates, appraise the
costs of obtaining the storm drain easement. According to
their report the total cost for 25 foot permenent easement and
a 2~ foot temporary construction easement is $63,617.00 if the
City were to obtain the easement through condemnation. The
City of Highland is not in a position to expend this amount of
money to obtain the easement. CalTrans recently indicated
through Mr. Jerry Lunt, the Design Engineer for the freeway
project, that they would not agree to loaning the money to the
city.
You had indicated to me a couple of weeks ago that if we were
unsuccessful with CalTrans that I could discuss with you the
possibility of obtaining the money from the City of San
Bernardino for the purchase of the easements. Please note that
the City of Highland does have Storm Drain Development Impact
Fees and we are willing to consider an agreement with San
Bernardino whereby you would be reimbursed from the city Storm
Drain Development Fees at such time that sufficient funds are
available from this area.
