STAFF REPORT
BACKGROUND:
The following is a chronological listing of events regarding the city's
abatement at 718 West 7th street, up to and including the costs
incurred by the city.

A Notice of Violation was issued by Code Enforcement on
this date noting that it is a unsafe dwelling based on
allowing tenants to remain in residence during the struc-
tural remodeling (while structurally unsafe). occupants
of the building were vacated and the Building was posted
as a dangerous building. The tenants returned to the
building with the owner's knowledge and consent.
4. 1/30/90 A further correction notice from the Building Inspector
was left with instructions to "stop all work" because
permits were not valid for the scope of work being done.
5. 2/2/90 The owner and tenants continued to ignore the. notifica-
tions that the building was dangerous and unfit for habi-
tation. Notice was sent to both utility companies to
disconnect utilities to the front building.

7. 2/22/90 The utility companies disconnected utilities to both the
front and back buildings. The gas disconnect of the back
building was in error, however, the electric company dis-
connected two meters on the front building as directed by
Code Enforcement, plus a third meter on the back building,
stating that it had no number and thus was considered not
to be a legal electrical meter.
Due to utilities being disconnected tenants finally moved
out of both buildings.
8. 2/23/90 S.P.M. Architect submitted a letter regarding the safety

of the structure (see Attachment "C").
9. 3/2/90 BBC hearing was held. The owner was ordered to submit
plans and obtain proper permits for the scope of work
actually being done, and to allow no tenants in the unsafe
buildings until repairs were completed.
10. 3/30/90 Code Compliance Officer, Mark Young had a phone conver-
sation with an officer of Security National Bank which was
loaning money to the owner. They were requesting to be
informed of the policies and procedures of the City
concerning permits.
11. 4/2/90 A letter was sent to Phillip Long, Vice President of Se-
curity National Bank, as per the phone request during the
March 30 telephone conversation. It included information
on city requirements.
SUMMARY:
The owner has failed to disclose to Planning Division and to Building
Division, exactly what he is doing, or what he intends to do on the
property (i.e. the number of dwelling units, number of bedrooms, etc.).
STAFF RECOMMENDATION:
Staff recommends that the Council uphold the decision of the Board of
Building commissioners on March 2, 1990, submit proper plans and to
obtain the proper permits for the rehabilitation work he intends to do;
and while the rehabilitation of the property is in progress, no tenants
are to be allowed to occupy the structure; and all current and future
costs of the Code Enforcement action be incurred as a lien against the
property and a personal debt of the owner(s).

Building Commissioners declaring that a nuisance exists at:
718 W. 7th Street.
STATEMENT OF FACTS
Appellant Bradford E. Henschel, J.D. applied for and
received building permit #78644 on July 6, 1989. Pursuant to
that permit the appellant, as owner-builder, hired a licensed
electrician to rewire thl'! rear house, at 718 1/2 W. 7th St.
and rewired 718A w. 7th St. and 718B W. 7th St.
Plumbing was repaired in all three units and windows
were repaired or replaced with energy efficient windows of an
esthically pleasing and UBC approved nature.
New carpet was installed in 718B and 718 1/2 w. 7th St.
Repairs were made to termite damaged wood.
Before appellant was able to call for his inspection of
the new electrical wiring and 100 amp panels and sub-panels
inspector Jim Clark came to the property on January 16, 1990
and demanded that all work stop, rather than inspect. He
told the appellant that day that his windows were ILLEGAL and
that the posts supporting the front duplex would have to be
bolted. When he was informed that the posts were already
bolted he said, "Oh, I didn't notice that."

This incident led to a series of meetings with city
officials. I was told that permit #78644 was cancelled.
On January 26, 1990 I obtained three permits, one for
each unit. Two units were rented and both had been rented
since the middle of 1989. Those permits were #80857, 80858
and 80858. The same day those permits were issued Mr.
Brandel Eads, a "code" enforcement officer, issued a Notice
of Violation after coming onto the subject premises, WITHOUT
ANY INSPECTION WARRANT REQUIRED BY LAW, and seeking out
probable cause of penal violations under SBMC 15.24.040 A & B
as well as other offenses.
At this time I had my engineer, Steve Murray, call the
City and tell them the building was safe.
On January 30, 1990 Mr. Dean Pagel issued a stop work
order on the 3 permits taken out on 1/26/90.
By this time most of the work mentioned in report 90-
3682 had been done, such as repair of doors, roof leak,
leaking toilet upstairs, etc.

and incorporated thereby) such as #4 Illegal addition of the
rear house was incorrect and Mr. Clark stated at the hearing
on March 2, 1990 that the rear (718 1/2) was legal and
records show it was legally converted in the past.
The board refused to accept any evidence from the
appellants, which included a certificate, with three pages of
algebraic calculations, from a licensed Architectual
Engineer, certifying that the building was safe. That
certificate is made a part of this appeal by attachment
hereto.
After refusing to accept any evidence and stopping the
appellant from presenting his position, the board voted that
718 W. 7th St. was a public nuisance.
After the vote and after appellant left the hearing room
further discussions on the subject were held which became
part of the order but were not voted on in the presence of
the appellant. Such orders as requiring the appellant to
hire a general contractor, rather than hiring specialty
subcontractors.
STATEMENT OF GROUNDS ON APPEAL
1. SAN BERNARDINO MUNICIPAL CODE 15.28.050
RELIEF BY CERTIFICATE OF ARCHITECTUAL ENGINEER
The above code section provides that a certificate from
an architectual engineer "registered and licensed by the
state, certifying as to the conditions of the building
justifying relief from the abatement order..." will provide
relief from an abatement of nuisance order by a building
official, WHERE THE OWNER CONTENDS THE BUILDING IS NOT A
PUBLIC NUISANCE.

The appellant contends that the building at 718 W. 7th
street and the rear house at 718 1/2 W. 7th St. in the City
of San Bernardino, are not a nuisance.
Attached to this appeal is a certificate from Steve
Murray, an Architectual Engineer, licensed by the State of
California, stating that the three units are structually
sound and safe.
Such requirement of a certificate is only necessary by
this section where the owner does not abate any "so-called"
nuisance. In this case the owners where actively repairing
and renewing the three units, as well as cleaning, painting,
and tree trimming. The inspector and the building officials
interfered with the owner by turning off all utilities to all
three units, ordering the tenants in 718B W. 7th St. to
vacate the building without inspection warrants required by
law for such action. (Cal. C.C.P. sec. 1822.50; Michiqan v.
Tyler. 436 u>s> 499, 504-07 (1978); Camara v. Muni. Ct., 387
u.S. 523, 530 (1967); Conner v. City of Santa Ana. 90 Daily
Journal D.A.R. 2315 (9th Cir. 1990)
The appellants request the Common Council to adopt a
resolution that neither building, 718 w. 7th St. nor 718 1/2
W. 7th St. is a nuisance. That the building and safety
department appoint another inspector, other than Jim Clark to
this job. That the appellants not be stopped from bringing
back the tenants to their units at 718 1/2 w. 7th St. and
718B W. 7th St.. That the building and safety not require
more work than is required by law when doing repair work to
some portion of the building at either address. That no
further code enforcement be conducted without inspection
warrants, signed by a judge and made upon probable cause as
required by law. That Mr. Clark and Mr. Hesterly be ordered
to stop slandering the appellant in public or republishing
the slander or libel that Mr. Henschel did work without a
permit, when such permit was issued on 7/6/89, (#78644).
That Mr. Clark cease and desist from soliciting Mr.
Henschel's neighbors to make complaints against the
appellants or from making false complaints when the neighbors
refuse to make a complaint. That Mr. Henschel be allowed, as
his right, to assist his contractors or do some of the work
required for repairs.

2. THE UNIFORM BUILDING CODE DOES NOT REQUIRE
UPDATEING OF BUILDING FOR REPAIRS UBC l04b
The Uniform Building Code does not require an owner to
update his entire building when making repairs. The Board of
Building Commissioners has allowed the Building and Safety
officials to require more of t~e appellants than the law
allows. Where the appellants have done cosmetic work on the
rear and upstairs units, such is not controlled by the USC at
all. where electrical rewiring and added main and s~b-pane19
have been added to the buildings the officials cannot require
the floors of the kitchen and living room to be torn up under
UBC section 104b.

Since a licensed architect has certified the building as
safe there is no q~estion of a 8erio~s safety problem.
Factually both buildings sustained no damage during the
recent ~arthquake, while other supposedly safe buildin~s
whEre destroyed or serious damaged. Many such buildi~gs were
government buildings.
The appellants request that the common council adopt a
resolution that ~o further summary proceedings take place
regarding the subject pra~ses in abatement or nuisanCE anc
that ths owners be allowed to finish the repairs they started
last year. It is further requested that the upper ~~it and
rear unit be allowed to be occupied immediately as being safe
pursuant to the certificate of the licensed architectual
e!:.gir.eer.

I have visually inspected the above referenced prnject.
There is a two story duplex being remodeled in the front ~nd
a newer single story unit in the back. The rear strllctllre
appears sound and according to the building inspector "..s a
few correctable problems, which have not been fully s~-lled
out since we tl~ve not yet received the letter they l'rlJfll~~pd
us. I do not find that this structure is a public nuills..nce
or an unsafe structure.
The front duplex was in the process of remodeling when
the work was stopped. Since the stoppage of work we have
been processing the drawings and calculations for upqrarllng
the existing foundations. At this point we are finishing the
final requirements to satisfy the plan check. The foundation
even at this point is the same it has been since it was ..t
the time of construction except for the exterior siding.

OF THE BOARD OF BUILDING COMMISSIONERS OF THE
CITY OF SAN BERNARDINO AUTHORIZING THE
ABAT~MENT OF A PUBLIC NUISANCE
WHEREAS, pursuant to the San Bernardino Municipal Code,
Title 15, Chapter 15.28, the Building Official has posted a
building(s) or premises located at 718 W. 7th Street ,
San Bernardino, California, with a 'Notice.to Abate Nuisance'
and has notified the person or persons having an interest in
said property that the said building(s) or premises constitute
a public nuisance, and has prepared a declaration of posting
and mailing of the notice, a copy of which is on file in these
proceedings; and
WHEREAS, pursuant to said San Bernardino Municipal Code,
the Building Official has served a 'Notice of Hearing Before
the Board of Building Commissioners of the City of San
Bernaridno', relating to abatement of said nuisance, to the
person or persons having an interest in said property, and has
prepared a declaration of mailing of the notice, a copy of
which is on file in these proceedings; and
WHEREAS, a hearing was held to receive and consider all

WHEREAS, the Board of Building commissioners heard the
17 testimony and examined the evidence offered by the parties
relative to such alleged public nuisance,

a public nuisance for the reasons set forth in Exhibit 'A',

review. As Mark Young showed the slides, details regarding each slide
was provided by Building Inspector James Clark. Since the zoning was
not on the agenda front sheet the Commissioners asked what it was, and
Mark informed them it is multi-family.

behalf of the subject property. Brad Henschel was present to testify.
Chairman Miller stated that after seeing the slides he wanted to get
information from Code Enforcement officers and Building Inspectors and
then from Mr. Henschel.
JC explained each slide. The preliminary ones showed the underside of
the building, with underpinnings that were not soundly constructed.
Just after that were slides showing hot water heaters (two on the front
building and one on the back); these were not enclosed or vented and
risk venting of fumes into the buildings because of negative pressure
created against the side of the house. Further slides showed new
concrete- pouring over old concrete footings with no structural
connection between the two layers. Other slides showed the supports
under the building as inadequate.
Commissioner Flores asked the thickness of the footings. JC explained
this is unknown as no inspections had been requested before and after.
commissioner Flores then asked if Mr. Henschel is doing the work, and
JC responded "some".
As the next slides showed the rear structure, JC mentioned that the
owner has requested COO funds, and that Coo has photographs Showing the
rear building prior to remodelling; this points up several problems.
The electrical panel in back is newly installed with 10 gauge wire, and
the rafters of the roof are new and are within inches of the property
line, which is a violation of Building Codes. Finally there were
slides showing an exposed, unprotected gas line, a new washer and dryer
(no permit had been taken out for this plumbing work).
JC commented that the slides and inspections have shown that much more
work is being done than Permits were taken out for. Permits were taken
out for $5,000 worth of work, and the work being done will total
approximately $50,000 valuation. There were no Permit fees as the
buildings are in the Enterprise Zone. JC stated the initial permits
were taken out on July 16, 1989, and for them to remain valid for the
standard 180 days, work would have to been ongoing and inspections done
on a regular basis. In January, 1990, it was found that no inspections
had been called for and that the work exceeded the Permit. He added
that the owner is liable for investigation fees.
JC added that, at a meeting with COO, Mr. Henschel had been told
engineering was required for seismic information requirements. New
plans have been received on March 1, 1990, but these have not been
reviewed yet for completeness. Prior plans were not adequate for
approval.

Chairman Miller responded that this was true, because the permits only
requested minor repair; the slides, however, indicate the repairs will
be major including foundation work.
Commissioner Ponder reminded Mr. Henschel that it is Mr. Henschel's
responsibility to give full information on repairs to be done when he
pulls a Permit. He added that there has obviously been a lack of
understanding and some miscommunication. He added that Mr. Henschel
has not told the City fully what he wishes to do with the property. He
finished by saying that for any other topics Mr. Henschel might wish to
review, this is not the proper arena.

Brad Henschel stated he had the right to obtain the pricing that way
because he was working under his Permit as owner / builder as allowed
under the Health and Safety Code. Attorney Zimmermann asked Mr.
Henschel if he had a copy of the code. He answered that he didn't have
a copy with him.
Chairman Miller called Dean Pagel, Building Inspection Supervisor to
the podium. Mr. Pagel stated that the Building Division needs a
complete set of plans from Mr. Henschel which meet all Plan Check
requirements. He added that the Department recommends Mr. Henschel
hire a licensed contractor to supervise the work and pull the plans so

that estimates would be correct and the work would be done in accord
with Building Code requirements.
Mr. Henschel said he wanted to submit his Architects calculations to
the Board and Chairman Miller informed him that this is not the
appropriate place to submit them. They should be submitted to Plan
Check. Mr. Henschel responded that he had already done this.
Commissioner Ponder made a motion, seconded by Commissioner Pollock, to
adopt Staff's recommendation amending it to include that full and
complete plans must be submitted and approved and that, the Building
Division was instructed to inspect on a regular basis in the meantime,
and if there was any evidence of work being done before Permits were
issued, that criminal charges be brought against the owner.
Roll call was taken with the motion being unanimously carried.

Don Hesterley presented background information for the Board's review
regarding abated properties listed on Attachment "A" as public
nuisances and the costs incurred to abate these properties by the City.
These are the cases where no appeal has been filed by the owner(s).
Staff's recommendation is that the costs listed in Attachment "A" for
the abatement of the public nuisances, be assessed against the owner(s)
of the subject properties and if not paid in a timely manner, to be
placed as a lien on the properties or a personal obligation of the
owner(s) .
Don Hesterley added that several addresses were to be pulled, however,
since owners of five of the locations were present, these should be
heard individually by the Board. Then the Board would be told which
items would be continued and which items would be heard from Attachment
"A".

BACKGROUND:
The buildings were inspected by Building Inspector James Clark and
Community Development Rehabilitation Coordinator Nestor Nazario on January
23, 1990, and was found to not be up to code. A stop work order was
issued on January 16, 1990 and again on January 23. His building permits
were cancelled. On January 26, 1990, the owner applied for new Building
Permits. On January 26, 1990, Code Enforcement Officer went to post a
Notice of Violation and a Notice to Vacate on the front building only and
told the tenants to leave.
A stop work order was issued on January 30, 1990 by Dean Pagel as work not
authorized on the permits was being done and Plans were required for Plan
Check on all work to be done before work was started. These permits were
also cancelled.
Code Enforcement inspected the building on February 2, 1990 and issued a
notice to Edison to disconnect the meter on the front building because it
was a substandard hazardous structure. One meter bringing power to the
front house was removed on February 14, 1990 and the second meter to the
front house was removed on February 22, 1990: a third meter was removed
from the rear house at that time. Gas was turned off on February 22,
1990.
On February 20, 1990 a letter of protest was received by Don Hesterley,
and in the matter was set for hearing at the BBC Meeting of March 2, 1990.

It has been determined by the Building Inspection Division
that the two story structure located at the above referenced
address was found to be a dangerous building.
You were informed of the problem by Mr. James Clark, Building
Inspector and also by myself, in a telephone conversation.
You have continued to place a tenant back into this structure
even though Code Enforcement posted the building. We are now
going to have the utilities removed. If the structure is
occupied on Monday, February 19, 1990, we will begin legal
action against you. Your cooperation is appreciated.
