STAFF REPORT
The subject properties were appraised by Ralph Monge SRjWA on November 11, 1989.
His valuations are the minimum bid prices on each parcel.
The bid packages have all been prepared and attached in accordance with the
past practices.
Upon passage of the enclosed resolution, the bid packages will be mailed out to
those potential buyers who have expressed interest in the properties, and the
City will advertise them in The Sun, and list them with the San Bernardino Board
of Realtors. Any broker's commissions will be paid by the Buyer, and any
accepted bid will be net of any broker's fee. The Real Property Section will
proceed with the sale of the properties. The results of the sealed bid opening
will be presented to the Mayor and ~ommon Council at the May 21, 1990 Council
Meeting, at which time any oral bids will be accepted.
The City will pay ~ of the escrow and closing costs on each escrow.
Pursuant to the conditions of the deed to the City on the Del Rosa Property
(15.05-181B), all proceeds from the sale of that particular property will go the
City Library.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO GIVING NOTICE INVITING
COMPETITIVE SEALED AND ORAL BIDS FOR THE SALE OF CERTAIN PARCELS OF REAL
3 PROPERTY OWNED BY SAID CITY, SAID PARCELS BEING WITHIN SAID CITY, AND
ESTABLISHING A MINIMUM SALES PRICE FOR EACH SEPARATE PARCEL.

WHEREAS, the City of San Bernardino, a municipal corporation, is
6 the owner of the hereinafter described parcels of real property situated in
7 the City of San Bernardino, State of California; and
8
WHEREAS, the Mayor and Common Council of the City of San
9 Bernardino find and determine. that there is no further need or necessity for
10 the use of said real property; and
11
WHEREAS, the Mayor and Common Council of the City of San
12 Bernardino believe it to be in the best interest of the said City that said
13 parcels of real property be disposed of at the highest price obtainable in
14 the open market.

21 the Director of Public Works/City Engineer, Real Property Section, City

SECTION 3. Each sealed bid proposal must be accompanied by a
15 cashier's check in an amount equal to ten percent (10~) of the total

purchase price bid.
SECTION 4.
Sealed bids must be delivered to the office of the
18 Director of Public Works/City Engineer, Real Property Section, 3rd floor,
19 City Hall, 300 North "D" Street, San Bernardino, California, on or before
20
the hour of 2:00 p.m., May 15, 1990, at which time said sealed bids shall be
21 opened (in the large conference room), and publicly declared. The results
22 of said bidding shall be submitted to the Mayor and Common Council at the
23

hour of 2:00 p.m., at the Council Chambers, City Hall, 300 North "D" Street,
San Bernardino, California, at the next regularly scheduled Council Meeting
25 following the opening of bids (May 21, 1990). At that time, oral bids may

2 be required to make a non-refundable deposit with the
3 City Clerk prior to the end of the meeting in an amount
4 equal to ten percent (101) of the total price bid.
5 The oral bidding for the sale or disposition of the property shall be
6 continued in the same manner until all bidding shall have been completed,
7 and an award made to the highest bidder by a 5/7th vote of the City
8 Council. The successful bidder, as determined by the Mayor and Common
9 Council, shall make a non-refundable deposit by cash, cashier's check or
10 money order in an amount, which together with any deposit made with a sealed
11 bid of bidder, shall equal ten percent (101) of the total price bid for the
12 property. Such deposit shall be made with the City Clerk prior to the end
13 of the meeting or within two (2) hours of the awarding of the bid, whichever
14 shall occur later. The Mayor and Common Council shall have the right to
15 reject all bids. The total price bid for any property shall be considered
16 net of any broker's' fees. Full payment shall be made in accordance with Bid
17 Specifications No. 15.05-181A - 15.05-181D, as appropriate.
18 SECTION 5. Copies of the "Description of Property Requirements of
19 Bidders, Requirements of Sale and the Official Bid Form" may be obtained in
20 the office of the Director of Public Works/City Engineer, Real Property
21 Section, 3rd floor, City Hall, 300 North "D" Street, San Bernardino,
22 California.
23 SECTION 6. All written bid proposals must be signed, sealed and
24 delivered as indicated in Section 4. No bid proposal will be considered
25 which fails to offer a sum equal to or greater than the minimum acceptable'
26 bid prices established herein (total bid prices are considered net of any
27 broker's fees), or which is filed at a later time or at a different place or
28 with a different person than as stated in Section 4.

DISPOSITION OF CITY OWNED LAND
SOUTHEAST CORNER OF GARNER STREET AND COLIMA ROAD
NOTICE is hereby given inviting competitive bids for the sale of a parcel of City
owned land consisting of approximately 14,614.60 square feet, located at the
Southeast corner of Garner Street and Colima Road, in the City of San Bernardino.
1. LOCATION AND DESCRIPTION OF SUBJECT PROPERTY:
(A) Property location: Southeast corner of Garner Street and Colima Road,
property is improved.
(B) Le~al Description: Lots 8 and 9, Tract No. 3525, as per plat recorded
in Book 46 of Maps, Page 55, records of the County Recorder of San
Bernardino County, State of California.
(C) Zonin~:
Subject property is currently zoned RS (residential suburban),
suitable for single family dwellings.

which time the sealed bids will be publicly opened, examined and declared.
The results of said bidding shall be submitted to the Mayor and Common
Council at their regularly scheduled meeting of May 21, 1990, or any
adjourned or continued date thereof.
5. SEALED BID DEPOSIT:
Each sealed bid shall be accompanied by a cashier's check or a money order in
an amount equal to at least ten percent (lOt) of the price bid, made payable
to the CITY OF SAN BERNARDINO. Failure to provide such bid deposit shall
result in the rejection of the sealed bid.
6. ORAL BIDS:
Oral bids shall be received by the Mayor and Common Council at 9:00 a.m., on
May 21, 1990, or as soon thereafter as the matter may be heard, unless the
Mayor and Common Council determine, on the basis that no written bids had
been received, to re-advertise or remove the property from sale. The first
oral bid shall be in an amount of at least two hundred fifty dollars
($250.00) greater than the highest written bid submitted, and thereafter oral
bids shall be in amount of at least two hundred fifty dollars ($250.00)
greater than any prior oral bid. If no written bids were received, then the
first oral bid shall be made in an amount of at least the minimum bid, as
stated in Paragraph enti tIed "MINIMUM BID".
7. SUCCESSFUL BIDDER'S DEPOSIT:
The successful bidder, as determined by the Mayor and Common Council after
hearing oral bids, shall make a non-refundable deposit by cashier's check or
money order, in an amount which, together with any deposit made with a sealed

bid of said bidder, shall equal at least ten percent (10%) of the total price
bid for the subject property. The successful bidder's deposit shall be made
with the City Clerk prior to the end of the meeting or within two hours of
the awarding of the bid, whichever shall occur later.
8. UNSUCCESSFUL BIDS:
All sealed bid deposits of unsuccessful bidders will be promptly returned,
without interest, after determination of the successful bidder by the Mayor
and Common Council, or upon rejection of all bids.
9. RESERVED RIGHTS:
The Mayor and Common Council shall have the right to reject any and all bids.
10. SUCCESSFUL BIDDER:
The successful bidder, as determined by the Mayor and Common Council, will be
required to enter into escrow within ten (10) days after said determination.
The escrow instructions shall include, but not be limited to:
(A) The recording of the Grant Deed from the City, and the closing of escrow
within a sixty (60) day period.
(B) The amount bid by the successful bidder shall be paid into escrow by
cashier's check in an amount equal to the total price bid, minus the
successful bidder's deposit.
(C) Escrow, title policy and all other fees and closing costs shall be paid
fifty percent (501) by the City, and fifty percent (501) by the
successful bidder, except for the documentary tax, which will be paid by
the successful bidder.
(D) The parties hereby agree that it would be extremely difficult or
impossible to determine the amount of damages suffered by the City as a
result of any failure by the successful bidder to execute escrow

instructions within the allotted time, or to deposit the agreed upon
terms of the purchase price; therefore, it is a condition of the bidding
procedure that the successful bidder's deposit shall be retained by the
City as liquidated damages, and not as a penalty in the event of any
said failure on the part of the successful bidder.

NOTICE is hereby given inviting competitive bids for the sale of a parcel of City
owned land consisting of approximately 39,875 square feet, located on the West
side of Del Rosa Avenue between Eureka Street and Marshall Boulevard, in the City
of San Bernardino.
1. LOCATION AND DESCRIPTION OF SUBJECT PROPERTY:
(A} Property location: West side of Del Rosa Avenue, between Eureka Street
and Marshall Boulevard, the property is unimproved.
(B) Le~al Description:
The North 100 feet of that portion of Lot 6, Block 21, Orange
Grove Tract West Highlands, as per plat recorded in Book 11
of Maps, Page 14, records said County, described as follows:
Beginning at the intersection of the center line of Marshall

5. SEALED BID DEPOSIT:
Each sealed bid shall be accompanied by a cashier's check or a money order in
an amount equal to at least ten percent (101) of the price bid, made payable
to the CITY OF SAN BERNARDINO. Failure to provide such bid deposit shall
result in the rejection of the sealed bid.
6. ORAL BIDS:
Oral bids shall be received by the Mayor and Common Council at 9:00 a.m., on
May 21, 1990, or as soon thereafter as the matter may be heard, unless the
Mayor and Common Council determine, on the basis that no written bids had
been received, to re-advertise or remove the property from sale. The first
oral bid shall be in an amount of at least two hundred fifty dollars
($250.00) greater than the highest written bid submitted, and thereafter oral
bids shall be in amount of at least two hundred fifty dollars ($250.00)
greater than any prior oral bid. If no written bids were received, then the
first oral bid shall be made in an amount of at least the minimum bid, as
stated in Paragraph entitled "MINIMUM BID".
7. SUCCESSFUL BIDDER'S DEPOSIT:
The successful bidder, as determined by the Mayor and Common Council after
hearing oral bids, shall make a non-refundable deposit by cashier's check or
money order, in an amount which, together with any deposit made with a sealed
bid of said bidder, shall equal at least ten percent (101) of the total price
bid for the subject property. The successful bidder's deposit shall be made
with the City Clerk prior to the end of the meeting or within two hours of
the' awarding of the bid, whichever shall occur later.

8. UNSUCCESSFUL BIDS:
All sealed bid deposits of unsuccessful bidders will be promptly returned,
without interest, after determination of the successful bidder by the Mayor
and Common Council, or upon rejection of all bids.
9. RESERVED RIGHTS:
The Mayor and Common Council shall have the right to reject any and all bids.
10. SUCCESSFUL BIDDER:
The successful bidder, as determined by the Mayor and Common Council, will be
required to enter into escrow within ten (10) days after said determination.
The escrow instructions shall include, but not be limited to:
(A) The recording of the Grunt Deed from the City, and the closing of escrow
within a sixty (60) day period.
(B) The amount bid by the successful bidder shall be paid into escrow by
cashier's check in an amount equal to the total price bid, minus the
successful bidder's deposit.
(C) Escrow, title policy and all other fees and closing costs shall be paid
fifty percent (501) by the City, and fifty percent (501) by the
successful bidder, except for the documentary tax, which will be paid by
the successful bidder.
(D) The parties hereby agree that it would be extremely difficult or
impossible to determine the amount of damages suffered by the City as a
result of any failure by the successful bidder to execute escrow
instructions within the allotted time, or to deposit the agreed upon
terms of the purchase price; therefore, it is a condition of the bidding
procedure that the successful bidder's deposit shall be retained by the
'City as liquidated damages, and not as a penalty in the event of any
said failure on the part of the successful bidder.
