I ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
15.12.050 OF THE SAN BERNARDINO MUNICIPAL CODE REGARDING
3 MITIGATION PROGRAM FOR UNREINFORCED MASONRY BUILDINGS.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 15.12.050 of the San Bernardino
6
Municipal Code is amended as follows:
7
"15.12.050. Mitigation Program - General Requirements.
8
A. The owner of each building within the scope of this
9
chapter which is within Classifications I, II, III, and IV and
said building has been vacant or unoccupied for one hundred
11
eighty days, or the owner of each building identified as an
12
unreinforced masonry building in the Unreinforced Masonry
13
Building Survey dated January 3l, 1990 conducted by EQE
14
Engineering and on file with the City Clerk, shall obtain a
15
structural analysis of the building by a civil or structural
16
engineer licensed by the State of California for the purpose of
17
determining the magnitude or severity of the structural
18
deficiencies.

B. The owner of any building which fails to meet the
20
minimum earthquake standards as specified in this chapter, as
21
shown in the structural analysis or as determined by the Building
22
Official, shall submit structural plans for upgrading the
23
building to the Department of Planning and Building Services for
24
its review and approval.
Upon approval of the Plans, the owner
shall obtain all necessary permits and make the required
structural alterations and repairs.
The owner may instead
demolish the building upon receiving the required City permits

1 and approval by the Historic Preservation Task Force, if
2 required.

The Director of Planning and Building Services shall

4 propose written procedures, regulations, guidelines, time
5 periods for compliance and fees pertaining to implementation of a

After any order or determination has been made by a

21 and Common Council pursuant to this chapter, it is unlawful for
22 any person to fail, to neglect or to refuse to obey any such
23
order or determination.
Failure to comply with such order or
24 determination is a misdemeanor or an infraction, which upon
25 conviction thereof is punishable in accordance with th~
26 provisions of Section 1.12.010 of this Code, in addition to any
28
27 other civil or administrative remedies provided by law. Each day

F.
If, after any order or determination by a City
5 Official or the Board of Building Commissioners, made pursuant to
6 this chapter becomes final, and the person to whom such order or
7 determination is directed fails, neglects or refuses to obey, the
8 Board of Building Commissioners may direct the Building Official
9 to abate such public nuisance and lien the subject property for
10 expenses."

12 adopted by the Mayor and Common Council of the City of San
13 Bernardino at a meeting thereof, held on the
