2 RESOLUTION ,OF THE CITY OF SAN BERNARDINO ADOPTING
PROCEDURES AND TIME PERIODS FOR IMPLEMENTING A MITIGATION PROGRAM
3 FOR UNREINFORCED MASONRY BUILDINGS.

WHEREAS, the City of San Bernardino is located on and to
5 the southeast of the intersection of the San Andreas and the San
6 Jacinto earthquake faults, and
7
WHEREAS, the City of San Bernardino is located within
8 seismic zone 4 as defined in Chapter 2-23 of Part 2 of Title 24
9 of the California Administrative Code, and
10 WHEREAS, Sections 8875.1 of the California Government Code
11 requires all cities within a seismic zone 4 to identify all
12 unreinforced masonry buildings by January 1, 1990, and to
13 establish a mitigation program, and
14 WHEREAS, the City has identified all unreinforced masonry
15 buildings in the City of San Bernardino in an Unreinforced
16 Masonry Building Survey performed by EQE Engineering and on file
17 with the City Clerk, and
18 WHEREAS, Chapter 15.12 of the San Bernardino Municipal Code
19 sets forth the structural standards for evaluating and
20 structurally upgrading unreinforced masonry buildings, and
21
WHEREAS, the City of San Bernardino, in an effort to
22 eliminate unsafe, unreinforced masonry buildings and to reduce
23 the potential loss of life and property damage caused by a major
24 earthquake, needs to establish a mitigation program,
25 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
26 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION I.
Mitigation Program for Unreinforced Masonry
Buildings

In accordance with Chapter 15.12 of the San Bernardino
3
Municipal Code, the following procedures and time frame is
4
established for mitigation of unreinforced masonry buildings.
5
A. The Building Official shall notify by mail the owners
6
of all unreinforced masonry buildings in the City of San
7
Bernardino as identified by the Unreinforced Masonry Building
8
Survey dated January 31, 1990, (hereinafter called "Survey")
9
conducted by EQE Engineering.
The notice shall state the
following:
(1) a building they own has been identified as
unreinforced masonry by the Survey;
(2) as owner of an unreinforced masonry building, they

have the responsibility to make their buildings
15
structurally safe and earthquake resistant or to
16
demolish their buildings;
17
(3) the time deadlines for compliance with the mitigation
18
program; and
19
(4) the owner's have a right to appeal to the Board of
Building Commissioner's for good cause within 15 days
of the notice.
B. The following time limits are established to
accomplish the Unreinforced Masonry Building Mitigation Program:
(1) By May 15, 1990, a notice shall be sent by the
Building Official to all owners of unreinforced
masonry buildings at the last known address on the tax
assessment records.

(2) By August IS, 1990, the City's Planning and Building

Services Department shall be notified in writing by
3
the owners of unreinforced masonry buildings, of the
4
name of the California licensed civil or structural
5
engineer, that they hired to do a detailed structural
6
analysis for the purpose of determining the magnitude
7
or severity of the structural deficiencies.
8
(3) By March lS, 1991, the owners of unreinforced masonry
9
buildings shall submit structural plans to the City's
Department of Planning and Building Services,
indicating how the structural defects will be
corrected or the owners shall obtain permits for
demolition of the buildings, said demolition to be
completed by June 1, 1991.
(4) By July 1, 1992, the owners of unreinforced masonry
buildings shall have completed all structural
alterations and repairs pursuant to approved plans.
C.
Extensions of the above time limits may be granted by

19 the Board of Building Commissioners if requested prior to the

Vacant Buildings.

The establishment of Unreinforced Masonry Building
3 Mitigation Program shall not prevent the City from enforcing City
4 Codes against the owner's of an unreinforced masonry building
S when the building has been vacant for more than 180 days, or, is
6 vacant, open and apparently abandoned, or constitutes an urgent
7 public nuisance.

SECTION 4.
Enforcement.
9 The Building Official or his representative is authorized
10 to take enforcement action against the owner of an unreinforced
11 masonry building who fails to comply with the above deadlines in
