Synopsis of Previous Commission/Council/Committee Action:
05-14-84 Resolution 4612 approved an OPA with Arrowhead Magazine Co.
01-21-85 Resolution 4705 approved First Amendment to the OPA.
03-12-90 The Committee recommended that the item be forwarded to the CDC for
adoption.

BACKGROUND
In 1984, the Agency entered lnto an agreement wlth Arrowhead Magazlne Co.,
whereby Arrowhead would develop a 50,000 square foot dlstrlbutlon center wlth
a value not less than $1,425,000.
Staff has revlewed the terms of the Agreement and verlfled that Arrowhead
constructed a 50,000 square foot concrete tllt-up bul1dlng wlth a value ln
excess of $1.7MM, thereby satlsfylng the terms of the Agreement. Pursuant to
Paragraph 9 of the Agreement:
"Upon comp1etlon by the Partlclpatlng Owner. . . Agency
wl11 cause to be prepared and recorded a Certlflcate of
Comp11ance . . . ."
Staff, therefore, requests that the Actlng Executlve Dlrector be authorlzed to
execute the attached Certlflcate of Compllance.
RECOMMENDA nON
On March 12, 1990, the Redevelopment Commlttee recommended that thls agenda
ltem be forwarded to the Communlty Development Commlsslon for adoptlon.

CERTIFICATE OF COMPLIANCE
FOR PROPERTY OWNER'S PARTICIPATION AGREEMENT
WHEREAS, ARROWHEAD MAGAZINE CO., INC., hereinafter referred
to as the "Owner Participant", has entered into a Property
Owner's Agreement with the REDEVELOPMENT AGENCY OF THE CI TY OF
SAN BERNARDINO, CALIFORNIA, hereinafter called the "Agency"; and
WHEREAS, said Property Owner's Participation Agreement,
dated the 18th, day of May, 1984, was recordep on June 27, 1984,
in Book 84 on Page 151084, in the Official Records of the County
Recorder of the County of San Bernardino, State of California;
and
WHEREAS, in Section 9 of said Property Owner's Participation
Agreement the Owner Participant and the Agency agreed that upon
the completion by the Owner Participant of the improvements,
namely a 50,000 square foot concrete tilt-up warehouse and
distribution center with a total land and building value of no
less than $1,425,000, in a manner satisfactory to the Agency and
subsequent to the issuance of a Certificate of Occupancy by the
City of San Bernardino, the Agency would cause to be prepared and
recorded a Certificate of Compliance.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency
of the City of San Bernardino, California, that the Agency does
hereby determine, conclusively certifies, and gives notice that
the Owner Participant has fully satisfied, terminated and
completed, for itself, its successors and assigns, all covenants
and agreements with respect to the Obligations of Owner

Participant for the building upon and improvements to said land,
carried out in conformity with the fire, health, and building
code requirements for the City of San Bernardino, and the
provisions of the Redevelopment Plan for the Southeast Industrial
Park Project Area, and the Declaration of Restrictions, and in
accordance with the final plans and specifications approved by
the Agency, and the date for the beginning and completion
thereof, provided for in said Agreement, upon the hereinafter
described real property:
IN WITNESS WHEREOF, the Agency has caused this certificate
to be duly executed on its behalf and its seal to be hereunto
affixed and attested on this
