STAFF REPORT
A reauest was rerei ved bv thi s orfi (~e to vocate the remaInIng portion of "J"
Street North of Oak Street and South of that portion of ".1" Street previouslv
vacated (Resolution No. 89-181 ordering the vacation was recorded June 29, lQ8<.J:
Document No. 89-236238, see file no. 15.30-256). The previouslv vacated portion
lies South of the Lvtle Creek Channel and North of Oak Street. The new owners
of the propertv to the East of ".1" Street, Silveira - Leonard, were unable to
become a part of the earlier vacation proceedings and had to wait until an escrow
closed in order to begin their own vacation proceedings. The ad.iacent property
owners are in agreement with the procedure.
On 09-06-89, authorization was given to proceed with the proposed vacation, and
Plan No. 7881 was approved.
All of the interested City Departments and Utilitv Companies were notified
of the proposal on 10-03-89, with a reply due by 11-03-89. The responses are
attached for your information. A reservation of an easement for sanitary sewer
and appurtenant far.ilities was requested, along with a request from Southern
California Edison for a public uti lities easement, both of which will have to be
reserved, as set forth in the attached Resolution of Intention.
On 12-18-89, a Negative Declaration was adopted and a finding of consistency
with the General Plan was made.
The n~maining fee of S200.00 has been paid and it is recommended that favorable
ronsidf'ration he given to the reauested vacation. The Resolution of Intention.

also. Umm the approval of said Resolution, all adiacent property owners will be
notified by mail of the hearing date.

2 A RESOLUTION OF THE CIn OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF THE REMAINDER OF '\1" STREET. NORTH OF OAK STREET
3 AND SOLffH OF THE AREA PREVIOUSLY VACATED SOUTH OF THE LYTLE CREEK CHANNEL
AND RESERVING EASEMENTS FOR SANITARY SEWER AND PUBLIC UTILITIES THEREIN.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO AS FOLLOWS:
6 SECTION 1. That the Mavor and Common Counci 1 of the City of San
7 Bernardino hereby declares its intention to order the vacation of a
8 portion of "J" street, North of Oak Street and South of that portion of "J"
9 Street previouslv vacated South of Lytle Creek Channel, described as
10 follows:

That portion of "J" Street. 55.00 feet wide, in
of San Bernardino, County of San Bernardino,
California, described as follows:

1999. Bunker Hill Park. as per man recorded in Book 29 of
Maps, Page ~3, in the office of the County Recorder of
said County. said point also bt'ing the East line of said
"J" Street, as deli.neated 011 the map of said Tract;
thence North. along said East line, to the Northwest
corner of said Lot 15; thence West along the prolongation
of the North line of said Lot 15 to a point on the West
line of said "J" Street, as dedicated by a document
recorded July 23, 1965, in Book 6462, Page 61, Official
Records of said County; thence South along said West line
to the North line of Lot 12, Block 13, Rancho San
Bernardino, as per plat recorded in Book 7 of Maps, Page
2, in the office of the County Recorder of said Countv,

3 California, be, and the same hereby is fixed as the time and place when and
4 where all persons interested in or objecting to the proposed vacation may
5 appear before the said Mayor and Common Council and offer evidence in

relation thereto. For further particulars as to the proposed vacation of
the hereinbefore described portion of said streets, reference is made to
that map marked "Plan No. 7881" approved September 6, 1989, on file in
the office of the Citv Clerk ot said Citv.
SECTION 4. Nothing in this Resolution shal I in anv way affect or

11 disturb anv existinll easements for sanitary sewer and appurtenant facilities

and an easement for public utility purposes belonginll either
the

of San Bernardino or to any public utility, and there is hereby
14 specifically reserved for the Citv of San Bernardino, an easement in, over,
15 under and across the proposed area of vacation, for sanitary sewer and
16 appurtenant facilities, including the right of egress and ingress thereto;
17 and there is also specifically reserved for Southern California Edison
18 Companv, an easement to construct, place, operate, inspect, maintain,
19 repair, replace and remove such aerial and under~ound communication
20 structures and electrical transmission structures as the company may from
21 time to time require, consisting of poles, anchors. wires, cables, conduits,
22 manholes, markers and necessary fixtures and appurtenances, including the
23 right of ingress and egress thereto.

SECTION 5. That the City Engineer of the Citv of San Bernardino
25 hen~bv is directed to cause Notices of Street Vacation to be posted as
26 recruired bv the Public Streets, Hillhwavs and Services Vacation Law.

SECTION 6. That the Citv Clerk shall certifv to the adoption
