Bobbitt, dba Golden Valley Medical and Oxygen Service, for that certain real property located at 269 South Mt. Vernon Avenue, for a term of twelve (12) years, with Option to Purchase at end of term. Recommended motion: 1. DescriPtion) Finance: Council Notes: 02/26/90 75.0262 Agenda Item No. ~6 CITY OF SAN BERNARDINO - REQUEST r:OR COUNCIL ACTION STAFF REPORT Escrow has been opened at First American Title Insurance Company, as directed in the Lease, for the sale of the subject property. Also, as instructed in the Lease, the Buyer is paying all costs of the sale, including title insurance. In order for the escrow to close by March 30, 1990, the Grant Deed must be signed by the Mayor and the City Clerk and deposited into escrow before that date. The subject surplus property (269 South Mt. Vernon Avenue) was leased to Patricia A. Bobbitt, dba Golden Valley Medical and Oxygen Service on 04-01-78 with a term of twelve (12) years - 04-01-90. The Lease contains a Purchase Option (Paragraph 7), the contents of which are outlined below: 1. Lessee paid an option deposit of three thousand three hundred dollars ($3,300) for the option to purchase the subject property at the end of the lease term for the sum of thirty-three thousand dollars ($33,000). 2. Lessee notified Staff, in writing, at least thirty (30) days prior to the end of the lease term as to her intention to exercise the purchase option. as per the terms in Paragraph 7. 3. Paragraph 7 states that Lessee shall be entitled to an offset against the purchase price of the sum of Three Thousand Three Hundred dollars ($3,300) (the option deposit) and the sum of one hundred sixty-six dollars ($166.00) per month for monthly rentals paid by Lessee. The total of these offsets is twenty seven thousand two hundred and four dollars ($27,204.00) for the term of the Lease. The net residual cost to Ms. Bobbitt is five thousand seven hundred ninety-six dollars ($5,796.00). Therefore, Staff recommends the execution, by the Mayor and City Clerk, of the Grant Deed for the sale of the surplus real property located at 269 South Mt. Vernon Avenue. 75.0264 n? I?f. VERNON AVENUE, IN THE CITY OF SAN BERNARDINO, TO PATRICIA BOBBI'IT. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. The Mayor and City Clerk of the City of San 7 Bernardino, are authorized and directed to execute on behalf of the City, a 8 Grant Deed conveying certain surplus property located at 269 South Mt. 9 Vernon Avenue, between Congress Street and the Lytle Creek Channel, to 10 Gary M. Bobbitt and Patricia A. Bobbitt, Trustees of the Gary and Patricia 11 Bobbitt Revocable Trust, a copy of which is attached hereto, marked Exhibit 12 "A" and incorporated herein by reference as fully as though set forth at 13 length. 14 The deed shall be deposited into escrow with First SECTION 2. 15 American Title Insurance Company, to be recorded upon the payment, by 16 17 18 19 20 21 22 23 24 25 26 27 28 Patricia A. Bobbitt, of Five Thousand Seven Hundred Ninety Six Dollars ($5,796.00), as the total price for the property.
