1 ORDINANCE NO.
2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
12.04.055 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO
3 ENCROACHMENT PERMITS FOR TRAFFIC LANE CLOSURES.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 12.04.055 is hereby added to the San
6
Bernardino Municipal Code to read as follows:
7
"12.04.055 Encroachment Permits For Traffic Lane Closures
8
a. Any Traffic lane closure occurring between the hours of
9
7:00 a.m. to 8:30 a.m. and/or 3:30 p.m. to 5:30 p.m. on
Monday through Friday or for all or part of two or more
successiv8 calendar days in anyone block area shall
12
require an Encroachment Permit from the Director of Public
13
Services at least 24 hours in advance of the scheduled
14
closure.
Applications for such permits may be sent by
15
telecopier (fax) to the Department of Public Services.
16
b. Except as otherwise provided herein, any traffic lane
17
18
closure occurring during the hours or times specified above
without a previously issued permit shall subject the
19
responsible party to a fee to compensate for administration
20
and enforcement which shall be based on actual cost but not
21
to exceed Two Hundred Fifty Dollars ($250.00). In addition
22
future permits issued to said party shall be subject to
23
additional conditions as determined necessary by the
24
Director of Public Services.

c. Emergency closures shall not require an Encroachment
26
Permit.
The Director of Public Services shall be
27
immediately notified of the need for an emergency closure

by te1ecopier or by telephone, followed by telecopier or
2
personal written notice.
As used in this subsection
3
"emergency" means an actual, threatened, or anticipated
4
incident or situation which seriously threatens the public
5
health or safety.

Approved traffic lane closures must be barricaded by

permittee in accordance with the 'WATCH' manual approved by

The provisions of this Section shall apply to all
public agencies, private commercial enterprises, and all
other entities of any type whatsoever except those entities
or agencies not subject to the jurisdiction of the City.

The provisions of this Section 12.04.055 shall only
apply to those streets within the City described as
follows:

Projects involving the use of "Rule 20" funds are
exempt from the provisions of this Section."
h.
Projects done under contract with the City and
administered by the City's Department of Public Works are
exempt from the provisions of this Section, but
notification shall be given to the Department of Public

Services of any lane closures. Notification by the Public

Any temporary closure of a lane for a period of less

work, such as changing a traffic signal lamp, shall be
