Synopsis of Previous Council action:
1. Items reviewed at various meetings of the Hayor and Common Council
2. 2-05-90 - Mayor and Common Council directed staff to delete certain
items and to include lists of programs/projects! equipment previously
discussed, in order that Mayor and Council may consider additional
priorities.
3. 2-l9-90 - Mayor and Common Council approved the expenditure of
designated bond proceeds to be spent on certain equipment subject
to the approval of a benefit resolution. The Mayor and Council
approved the paving of certain streets by the Public Services Director
with funds from various bond proceeds and the General Fund. Certain
streets were subject to adoption of benefit resolutions.

STAFF REPORT
At the Council meeting of February 19, 1990, the Mayor and Council
approved the expenditure of certain bond proceeds for the purchase
of City equipment listed in Exhibit "A" in the attached resolution.
This approval was subject to the adoption of a benefit resolution that
needs to be adopted by the Council and Community Development Commission.
Attached is the benefit resolution that makes the appropriate findings
to allow for the expenditure of these funds.
At the same meeting the Mayor and Common Council approved the expenditure
of various bond proceeds and General Fund dollars to be spent
on the paving and reconstruction of various city streets. Some of
the streets designated in the list presented by the Director of
Public Services and approved by the Mayor and Council need a benefit
resolution before work can proceed. Attached are two benefit resolutions
for street improvements for the Mayor and Council to adont. One
resolution is for the State College Project Area and the other resolution
is for the Southeast Industrial Park Project Area.

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, MAKING
FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF
THE PROVISION OF CERTAIN EQUIPMENT ITEMS FOR
VARIOUS REDEVELOPMENT PROJECT AREAS OF THE CITY
WHEREAS, the City of San Bernardino, California (the
lOCi ty"), is a municipal corporation and a charter city duly created
and existing pursuant to the Constitution and the laws of the State
of California (the "City"); and
WHEREAS, the Community Development Commission of the City
of San Bernardino (the "Commission") on behalf of the Redevelopment
Agency of the City of San Bernardino
(the "Agency"),
is a
redevelopment agency, a public body, corporate and politic of the
State of California,
organized and existing pursuant to the
Community Redevelopment Law (Part 1 of Division 24) commencing with
Section 33000) of the Health and Safety Code of the State of
California (the "Act"); and
WHEREAS, pursuant to Section 33445 of the Act, the Agency
may, with the consent of the Mayor and Common counci 1 of the Ci ty
(the "Council"), pay all or a part of the cost of installation and
construction
of
any
building,
facility,
structure or other
improvement which is publicly owned either within or without the
boundaries
of
a
redevelopment
project
area
if
the Council

determines: (1) that such buildings, facilities, structures or
other improvements are of benefit to the redevelopment project area
or the immediate neighborhood in which the project is located,
regardless of whether such improvement is wi thin another project
area, or in the case of a project area in which substantially all
the land is publicly owned that the improvement is of benefit to an
adjacent project area of the Agency, and (2) that no other
reasonable means of financing such buildings, facilities, structures
or other improvements is available to the community, and such
determination by the Agency and the Council shall be final and
conclusive; and
WHEREAS, in order to provide for the construction and
installation of buildings, facilities and structures the Agency must
acquire, install and utilize certain equipment which is necessary in
order to implement the redevelopment projects of the Agency; and
WHEREAS, in connection with assisting in the provision of
pOlice facilities, fire facilities, rights-of-way facilities and
other such public faci Ii ties, certain equipment inherent to such
facilities is required in order to allow for the proper functioning
of such facilities; and
WHEREAS, certain additional equipment is necessary for the
day-to-day operation and functioning of the Agency in order to allow
the Agency to provide for the construction and installation of
buildings, facilities and structures which are of benefit to the
various redevelopment project areas of the Agency; and

WHEREAS, it is in the interests of the City and the Agency
that the City causes the acquisition of certain equipment, as
described in Exhibit "A" attached hereto and incorporated herein by
this reference and as hereinafter designated as the "Equipment", to
be used in connection with the implementation of various
redevelopment projects within the various redevelopment project
areas of the City; and
WHEREAS, the provision of the Equipment will promote the
development of redevelopment proj ect areas wi thin the City which
proj ect areas include: the Meadowbrook-Central City Proj ect Area,
Central City North Project Area, Central City East Project Area,
Central City South Project Area, Central City West Project Area,
Tri-Cities Project Area, Southeast Industrial Park Redevelopment
Project Area, South Valle Project Area, State College Project Area
and the Uptown Project Area, to the extent that it will enable the
Agency to undertake and promote redevelopment activities within such
areas and thereby assist in the elimination of blight wi thin such
areas; and
WHEREAS, in order to promote the City's health, safety and
welfare and ensure the orderly development of the Agency's project
areas, it is important that the Equipment necessary for the
implementation of the redevelopment plans within the Agency's
project areas be financed by the Agency; and

WHEREAS, it is appropriate at this time for the Council to
make certain findings and determinations and take certain action
with respect to the acquisition of the necessary Equipment.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
Section l. The Recitals hereinabove are
correct and are incorporated herein by this reference.

Section 2. The Counci 1 consents to the payment by the
Agency of the costs of the Equipment described in Exhibit "A" to be
acquired for use by the Agency in order to implement the
redevelopment plans of the Agency for the reasons set forth in the
Recitals hereinabove. The Council further finds and determines that
no other reasonable means of financing the acquisition of the
Equipment is presently available to the City and that the City and
the Agency require the use of revenues generated from the project
areas of the Agency in order to fund the acquisition of the
Equipment.
Section 3. The provision of the Equipment wi 11 allow
the Agency to promote redevelopment within the project areas of the
City which will help stimulate development of such project areas and
their immediate neighborhoods which will in turn help eliminate
blight within such project areas and surrounding neighborhoods.

Section 4.
The City Clerk is hereby authorized and
directed to cause this Resolution to be transmitted to the
Commission for consideration in connection with appropriate action
by that body.
Section 5.
This Resolution shall take effect upon the
date of its adoption.

FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF

WHEREAS, the City of San Bernardino, California (the
"Ci ty"), is a municipal corporation and a charter city duly created
and existing pursuant to the Constitution and the laws of the State
of California (the "City"); and
WHEREAS, the Community Development Commission of the City
of San Bernardino (the "Commission") on behalf of the Redevelopment
Agency of the City of San Bernardino
(the "Agency" ) ,
is a
redevelopment agency, a public body, corporate and politic of the
State of California,
organized and existing pursuant to the
Community Redevelopment Law (Part 1 of Division 24) commencing with

WHEREAS, the City and the Commission have previously
approved and adopted the Redevelopment Plan for the State College
Redevelopment Project (the "Redevelopment Plan"); and
WHEREAS, it is in the interests of the present landowners
within the project area subject to the Redevelopment Plan (the
"proj ect Area") and the res idents, both wi thin the Proj ect Area and
within the City generally, that the City causes the acquisition,
construction and installation of certain public right-of-way
improvements to 40th Street between Waterman Avenue and Sierra Way
(the "Public Right-of-Way Improvements"); and

WHEREAS, the aforementioned public right-of-way is a major
east-west arterial providing access to and from the Project Area and
its improvement is necessary in order to ensure the health, safety
and welfare of Project Area residents and occupants; and
WHEREAS, development of the Public Right-of-Way
Improvements will improve traffic circulation and will create safer
traffic conditions in and around the Project Area which in turn will
make the Project Area more desirable for commercial, industrial and
residential development thereby benefiting said Project Area; and
WHEREAS, in order to promote the City's health, safety and
welfare, it is important that the Public Right-of-Way Improvements
required for the Project Area be financed in order to ensure the
orderly development of the Project Area and neighboring areas; and
WHEREAS, it is appropriate at this time for the Council to
make certain findings and determinations and take certain action
with respect to the installation and construction of the Public
Right-of-Way Improvements.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF

"Project Area") and the residents, both within the Project Area and
within the City generally, that the Agency causes the acquisition,
construction and installation of certain public right-of-way
improvements to (i) Arrowhead Avenue between Mill Street and 3rd
Street, (ii) Mill Street between "E" Street and Waterman Avenue,
(iii) "E" Street between Mill Street and Orange Show Road and (iv)
Orange Show Road (hereinafter collectively referred to as the
"Public Right-of-Way Improvements"); and

WHEREAS, the aforementioned rights-of-way are major
arterials which either run directly into the Project Area or are
located adjacent to the Project Area and provide traffic circulation
to and from the Project Area: and
WHEREAS, development of the Public Right-of-Way
Improvements will alleviate traffic congestion problems, will
improve traffic ci rculation and traffic safety conditions in and
around the Project Area which in turn will facilitate commercial and
industri a 1 development wi thin the Proj ect Area thereby benefiting
said Project Area; and
WHEREAS, in order to promote the City's health, safety and
welfare, it is important that the Public Right-of-Way Improvements
required for the Project Area be financed in order to ensure the
orderly development of the Project Area and neighboring areas: and
WHEREAS, it is appropriate at this time for the Counci 1 to
make certain findings and determinations and take certain action
with respect to the installation and construction of the Public
Right-of-Way Improvements.
