Synopsis of Previous Council action:
09-06-89 __ Authorization to proceed was given, and Plan No. 7885 was
approved.

with the Interim Policy Document was made.

STAFF REPORT
A request was received by this office to vacate a portion of the EastfWest alley
between "G" street and "H" Street, and between Spruce Street and 6th Street, from
Ed Linder, one of the partners of Sun 1 and Properties. This request represents
most of those owners who adjoin the area proposed for vacation, as they are all
concerned with the increase in vandalism and loitering in the area around the bus
depot.
On 09-06-89, authorization was given to proceed with the proposed vacation, and
Plan No. 7885 was approved.
All of the interested City Departments and Utility Companies were notified
of the proposal on 10-03-89, with a reply due by 11-03-89. The responses are
attached for your information. A reservation of an easement for public utility
purposes, which will have to be reserved, as set forth in the attached Resolution
of Intention.
On 12-18-89, a Negative Declaration was adopted and a finding of consistency with
the General Plan was made.
The remaining fee of $200.00 has been paid and it is recommended that favorable
consideration be given to the requested vacation. The Resolution of Intention,
which sets a protest date of 04-02-89 has been attached hereto for your action
also.
Upon the approval of said Resolution, all adjacent property owners will be
notified by mail of the hearing date.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF THAT CERTAIN EAST/WEST ALLEY BETWEEN
3 "G" STREET AND "H" STREET AND BETWEEN SPRUCE STREET AND 6TH STREET AND
RESERVING AN EASEMENT FOR PUBLIC UTILITIES THEREIN.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO AS FOLLOWS:

SECTI ON 1.
That the Mayor and Common Council of the City of San
Bernardino
hereby declares its intention to order the vacation of a
8 portion of that certain EastfWest alley between "G" Street and "H" Street,
9 and between Spruce Street and 6th Street, described as follows:
10 That certain EastfWest alley, being a portion of the
Kingman and Hampson Subdivision, as per plat recorded in
11 Book 3 of Maps, Page 81, in the Office of the County
Recorder of San Bernardino County, State of California,
12 described as follows:

Beginning at the Southwest corner of Lot 12 of said
subdivision, said point also being the East line of "H"
Street, 82.50 feet wide; thence East along the South
lines of said Lot 12 and Lots 11, 10, 9, 8, 7 and 6 of
said subdivision, a distance of 351.40 feet, to the
Southeast corner of said Lot 6; thence South, along a
straight line, to the Northeast corner of Lot 19 of said
subdivision; thence West along the North lines of said
Lot 19, and Lots 18, 17, 16, 15, 14 and 13, a distance of
350.6 feet, to the intersection of the Northwest corner
of said Lot 13 and the East line of said "H" Street;
thence North along said East line, to the Southwest
corner of said Lot 12, and the Point of Beginning.
SECTION 2.
That the Mayor and Common Council of the City of
San
21 Bernardino, in vacating the above described portion of said streets ,elects
22 to proceed under and in accordance with the provisions of the "Public
23 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
24 the Streets and Highways Code of the State of California.

SECTION 3.
That the hour of 10:00 A.M. on the 2nd day of
26 April, 1990, in the Council Chamber of the City Hall,
San Bernardino,
27 California, be, and the same hereby is fixed as the time and place when and
28 where all persons interested in or objecting to 'the proposed vacation may

appear before the said Mayor and Common Council and offer evidence in
relation thereto.
For further particulars as to the proposed vacation of
the hereinbefore described portion of said streets, reference is made to
that map marked "Plan No. 7885" approved September 6, 1989, on file in
the office of the City Clerk of said City.
SECTION 4. Nothing in this Resolution shall in any way affect or
disturb any existing easements for sanitary sewer and appurtenant facilities
and an easement for public utility purposes belonging either to the
City of San Bernardino or to any public utility, and there is hereby
specifically reserved for the Southern California Edison Company, an
easement to construct, place, operate, inspect, maintain, repair, replace
and remove such aerial and underground communication structures and
electrical transmission structures as the company may from time to time
require, consisting of poles, anchors, wires, cables, conduits, manholes,
markers and necessary fixtures and appurtenances, including the right of
ingress and egress thereto.
SECTION 5. That the City Engineer of the City of San Bernardino
hereby is directed to cause Notices of Street Vacation to be posted as
required by the Public Streets, Highways and Services Vacation Law.
SECTION 6. That the City Clerk shall certify to the adoption of
this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper published and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
