Synopsis of Previous Council action:
08-09-88 Tentative Tract No. 13307 denied by Planning Commission.
10-03-88 -- Developer's appeal of decision of the Planning Com-
mission regarding Tentative Tract No. 13307 was
continued.
10-24-88 -- Developer's appeal was heard and Mayor and Common
Council reversed the decision of the Planning Com-
mission and approved Tentative Tract No. 13307.
Recommended motion:

STAFF REPORT
Tentative Tract No. 13307 was denied by the Planning
Commission on August 9, 1988.
At the meeting of the Mayor and Common Council of
October 3, 1988, the developer's request to appeal the decision
of the Planning Commission regarding Tentative Tract No. 13307
was continued.
At
October 24,

adopted the
No. 13307,
approval and
the meeting of the Mayor and Common Council of
1988, the developer's appeal was heard. The Mayor
reversed the decision of the Planning Commission,
Negative Declaration and approved Tentative Tract
subject to the findings of fact, conditions of
standard requirements.
Tentative Tract No. 13307 is a seventy (70) Lot, Single
Family Subdivision, with an RS - 10800 Land Use designation.
The required improvement securities and certificates of
insurance have been filed with this office, and the prescribed
fees have been paid. Also, the improvement and grading plans
have been prepared and are in the process of being approved.
The Final Map has been reviewed and found to be in sub-
stantial compliance with the Tentative Map and the Subdivision
Map Act. Therefore, we recommend that the Final Map be
approved.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
FINAL MAP FOR SUBDIVISION TRACT NO. 13307, LOCATED EAST OF
3 CHESTNUT AVENUE, BETWEEN BELMONT AVENUE AND IRVINGTON AVENUE,
ACCEPTING THE PUBLIC DEDICATIONS AS SET FORTH ON SAID MAP; AND
4 AUTHORIZING EXECUTION OF THE STANDARD FORM OF AGREEMENT FOR THE
IMPROVEMENTS IN SAID SUBDIVISION, WITH TIME FOR PERFORMANCE
5 SPECIFIED.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
7 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1: The Mayor and Common Council find that
9 proposed Subdivision Tract No. 13307, located east of Chestnut
10 Avenue, between Belmont Avenue and Irvington Avenue, together
11 with the provisions for its design and improvements is consistent
12 with the General Plan of the City of San Bernardino.

SECTION 2.
The Mayor of the City of San Bernardino is
14 authorized on behalf of said City to execute the standard form of
15 agreement adopted by Resolution No.
84-8 with McClellan
16 Development, for the improvements in said subdivision tract as
17 are required by Title 18 of the San Bernardino Municipal Code and
18 the California Subdivision Map Act.
Section 12(b)(l) of said
19 Agreement is hereby amended to require public liability insurance
20 in an amount of not less than $250,000 per person and $500,000
21 per occurrence.
The time for performance is specified at 24
22 months.
Said improvements are specifically described and shown
23 on Drawings approved and on file in the Office of the City
24 Engineer of the City of San Bernardino.

SECTION 3:
The Final Map of said subdivision tract is
26 hereby approved and the City of San Bernardino hereby accepts G~
27 public property all dedications within the subdivision

1 as shown on said Final Map for streets, alleys, (including access
2 rights), drainage and other public easements. As a condition
3 precedent to approval of the Final Map, the Subdivider shall
4 first execute the agreement referenced in Section 2 hereof for
5 the improvements within said subdivision. The City Clerk shall
6 certify the approval and acceptance of the Mayor and Common
7 Council as set forth in this resolution.
S SECTION 4. This resolution is rescinded if the parties
9 to the agreement fail to execute it within sixty (60) days of the
10 passage of this resolution.
