This is to request that the Mayor and Common Council adopt a resolution
expressing appreciation to the members of the Citizen Advisory Committee (CAC)
for the Mt. Vernon Corridor Project Area and dissolving the Committee. Also,
that a resolution be adopted approving the Bylaws for the Mt. Vernon Corridor
Project Area Committee.
BACKGROUND
Initial efforts to establish the Mt. Vernon Corridor Redevelopment project
area consisted of three community meetings to ascertain a level of public
interest and support for the project. Following those initial meetings, the
City approved a redevelopment survey area on October 2, 1989, and amended on
November 6, 1989 to include additional public-owned land. Following the
approval of the amended survey area, the Planning Commission designated
proposed project area boundaries and approved the preliminary plan on
November 7, 1989.
The preliminary report, the draft redevelopment plan, and the draft
environmental impact report (DEIR) were approved by the Mayor and Common
Council on January 29, 1990. Negotiations are being conducted with several
taxing agencies and ultimately a noticed public hearing will be conducted to
consider the adoption of a redevelopment plan. It is our goal to have the
Mt. Vernon Corridor plan in effect by July, 1990.
CITIZEN ADVISORY COMMITTEE
On November 13, 1989, the Mayor and Common Council established a Citizen
Advisory Committee (CAC) for the Mt. Vernon Corridor Redevelopment Project
Area, comprised of various residents and representatives of existing community
organizations who expressed an interest in serving in an advisory capacity.
The Committee met with staff and provided input, advice, suggestions and
expertise in connection with the Redevelopment Plan for the project area.
In accordance with Health and Safety Code Section 33385 et seq. and by
Resolution No. 90-1, the Mayor and Common Council have now established a
Project Area Committee (PAC) which, among other things, has succeeded to the
responsibilities of the CAC.
It is the recommendation of the Mt. Vernon Task Force, with concurrence by the
PAC, that the CAC be commended for its unselfish commitment to the betterment
of the Mt. Vernon Area and that the Committee be dissolved.
Upon adoption of the attached resolution, staff will forward a certificate of
commendation to each member accompanied by a letter from the Mayor and Common
Council expressing the gratitude of the citizens of the City of San Bernardino
for dedicated community service.

PROJECT AREA COMMITTEE BYLAWS
The PAC established bylaws to govern its day-to-day operations on February 13,
1990. The primary function of the PAC is to act as an advisory body to the
Agency during consideration of the Redevelopment Plan. The seventeen (17)
member committee includes one or more representatives from one of the
following groups: residents, property owners, tenants, business persons and
representatives of community organizations within the project area.
The PAC established bylaws and elected its officers on February 13, 1990.
Mr. Jose Gomez was elected as Chairman, Mr. R. Wade Byars, Sr. as
Vice-Chairman and Ms. Esther Mata as Secretary.
The PAC will remain in effect to comment on any matter affecting the project
area during a period of three years after the adoption of a Redevelopment Plan
for the project area.
It is recommended that the Mayor and Common Council adopt the attached
resolution marked Attachment "B", approving the bylaws of the Project Area
Committee.
RECOMMENDATION
It is, therefore, recommended that the CAC be commended for its unselfish
commitment to the betterment of the Mt. Vernon area and the Mayor and Common
Council express gratitude of the Citizens of the City of San Bernardino for
such dedication in the community's service, and that the Committee be
dissolved. It is, also recommended that the Mayor and Common Council approve
and ratify the bylaws of the Project Area Committee for the Mt. Vernon
Corridor Redevelopment Project Area.

WHEREAS, the Common Council of the City of San Bernardino
by Resolution No. 89-439 designated an amended redevelopment
survey area (The "Survey Area") in connection with consideration
of a Redevelopment Plan for the Mt. Vernon Corridor Redevelopment
Project (the "Redevelopment Plan"); and
WHEREAS, by its Resolution No. PC 89-2 adopted on November
7, 1989, the Planning Commission of the City of San Bernardino
selected the Mt. Vernon Corridor Redevelopment Project Area (The
"Project Area") from within the boundaries of the Survey Area;
and
WHEREAS, various residents and representatives of existing
community organizations in the Project Area expressed an interest
in being involved as an advisory group with respect to the
consideration of the Redevelopment Plan; and
WHEREAS, by Resolution No. 89-440, the Mayor and Common
Council did appoint a Citizens Advisory Committee (The
"Committee") made up of those individuals and representatives
shown on Exhibit "A" attached hereto and incorporated herein, as
an advisory body in connection with the consideration of a
Redevelopment Plan for the Project Area; and
WHEREAS, the Committee as dedicated volunteers did meet
with staff and provided input, advice, suggestions and expertise
in connection with the consideration of a Redevelopment Plan for
the Project Area; and
WHEREAS, in accordance with Health and Safety Code Section
33385 et seq. and by Resolution No. 90-1, the Mayor and Common
Council have now established a Project Area Committee which,
among other things, has succeeded to the responsibilities of the
Committee,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

WHEREAS, by Resolution No. 89-439 the Mayor and Common
Council of the City of San Bernardino approved a Survey Area for
a proposed Mt. Vernon Corridor Redevelopment Project (The
"Project"); and
WHEREAS, by Resolution No. 90-1 the Mayor and Common
Council established a Project Area Committee (The "PAC") with
members as designated therein; and
WHEREAS, the PAC has established By-laws to govern its day-
to-day operations under the provisions of the Community
Redevelopment Law (Health and Safety Code Section 33000 et seg.),
the Ralph M. Brown Act (Government Code 54950 et seg.) and other
applicable laws and ordinances,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO that the By-laws of the
Project Area Committee for the Mt. Vernon Corridor Redevelopment
proj ect Area as attached hereto as Exhibit" A" and incorporated

BY LAWS
MT. VERNON CORRIDOR REDEVELOPMENT PROJECT AREA
PROJECT AREA COMMITTEE
Section 1.
GENERAL
These Rules and Regulations are provided to inform and promote the orderly
participation of the Redevelopment Project Area Committee ("PAC") for the Mt.
Vernon Corridor Redevelopment Project ("Project" or "Project Area") in
consulting with and advising the Community Development Commission and the
Redevelopment Agency (collectively, "Agency") members, staff, and consultants
on: (1) those matters which deal with the planning and provision of
residential facilities or replacement housing for those to be displaced by
Project activities; (2) those matters which deal with' the development of new
commercial facilities and public improvements in the Project Area; (3) other
policy matters which affect the businesses and residents of the Project Area;
and (4) any other matters regarding the Project Area which may be submitted to
the PAC by the Common Council, the Agency or the Planning Department. Without
prior consultation as required above, the PAC may also comment on any other
matter before the Common Councilor Agency affecting the Project Area during a
period commencing upon the creation of the PAC and ending at the third
anniversary of the adoption of a redevelopment plan for the Project Area. For
purposes of these Byl aws, "Project Area" shall i nc 1 ude that area proposed to
be included within a redevelopment project area by virtue of Resolution
No. PC 89-2 approved by the Planning Commission on November 7, 1989.
Section II. MEMBERSHIP
A. Selection
The PAC shall initially consist of those seventeen (17) members
approved by the Common Council by its Resolution No. 90-1 approved on January
3, 1990.
B. Qualifications
To be eligible for membership on the PAC, a person must be either a
residential owner-occupant, a residential tenant, a businessman, or a member
of an existing organization within the Project Area boundaries. If a member
ceases to qualify on one of these bases (e.g., by removal of residence or
business or membership), he shall resign from the PAC; or if he fai 1 s to
resign within sixty (60) days of the date that he ceases to qualify, his
membershi p shall be deemed vacated. Any vacancy shall be fill ed by
appointment by the Common Council which may act upon nomination by the PAC.

C. Proiect Ar Boundaries
The Project Area boundaries are those which have been adopted as the
official boundaries of the Project Area. If the Project Area boundaries are
amended, then the PAC shall be reconstituted, If necessary, by procedures
established by the Common Council to reflect the circumstances.
D. Membership Term
The terms of the PAC members are from the date of approval of the PAC
until the 31st day of December, 1990. At the end of that time, the Common
Council may reappoint members or appoint other members on a year-to-year basis
as deemed desirable in light of the current Project activities and in
conformity with applicable legal requirements.
Section III. OFFICERS
A. The Offi cers of the PAC shall be a Cha I rman and Vi ce-Cha i rman and
Secretary.
B. The Chairman, Vice-Chairman and Secretary of the PAC shall be elected
by the PAC members at Its first meeting. The Chairman, Vice-Chairman and
Secretary shou 1 d thereafter be elected duri ng the month of December in each
calendar year and shall take office effective immediately upon such election.
The Chairman shall preside at all meetings of the PAC and sign all documents
necessary to carry out the business of the PAC. The Vice-Chairman shall, in
the absence of the Chairman, act as Chairman. The Secretary shall keep
records of all meetings of the PAC.
Section IV. MEETINGS AND OFFICE
A. Regular and Special Meetings
The PAC shall meet at the Villasenor Library, 525 N. Mt. Vernon
Avenue, San Bernardino, California, or such other place the PAC might from
time-to-time designate. Regular meetings shall be held on the second
Wednesday of each month. Notice of meetings shall be sent to members at least
fi ve (5) days in advance of the meeti ng. The Secretary of the PAC, upon
notification by the Chairman, shall be responsible for the posting of said
notice and an agenda of all matters to be discussed or acted upon at a pUblic
meeting at least seventy-two (72) hours prior to the time specified in the
notice of the meeting. All meetings shall be conducted and notice thereof
shall be given in conformity with the Ralph M. Brown Public Meeting Law
(Government Code Section 54950, et seg.).

B. Meetinqs to be Open and Public
All meetings of the PAC shall be open and public to the extent
requi red by 1 aw. All persons shall be permi tted to attend any such meeti ngs
except as otherwise provided by law.
C. Mi nutes
Minutes of all meetings of the PAC will be kept in a file in the
offices of the Redevelopment Agency and the City Clerk.
D. Quorum
Nine (9) members of the PAC shall constitut~ a quorum, and a quorum
shall be necessary for the PAC to conduct its business. A smaller number of
PAC members may adjourn a meeting from time-to-time until a quorum is
present. Except as otherwise provided herein or as otherwise provided by law,
concurrence by nine (9) members of the PAC shall be required for any action of
the PAC.
E. Rules of Order
All business and matters before the PAC shall be transacted in
conformance with Robert's Rules of Order (newly revised).
F. Attendance
Any member who, without good cause as determined by the PAC, shall be
absent from three (3) consecutive regular meetings, shall be deemed to have
vacated his membership.
Section V.
DISCLOSURES AND CONFLICTS OF INTEREST
The members of the PAC shall make written di sclosures to the Agency,
Common Council, and the PAC of the fact and location of all direct or indirect
interests in the property presently owned or hereafter acquired in the Project
Area; such disclosures shall be accomplished in conformity with the Political
Reform Act (Government Code Section 87000, et ill.) and any applicable local
conflict of interest code promulgated pursuant thereto. Members shall
cooperate with staff and Agency legal counsel (which shall be the office of
the City Attorney) in the review of interests in property, and shall refrain
from voting or participating in decisions where they are disqualified by
virtue of a conflict of interest. Failure to make such written disclosure, or
to refrain from acting where a member has a conflict of interest. shall be
grounds for removal from the PAC.

For the purposes of this Section V., the term "direct or indirect
interest" shall be defined to include, but not be limited to, any monetary
interest in property, or benefit arising from the sale, lease, mortgage, or
disposition of property, owned by, in trust for, or subject to inheritance by
a member of the PAC, his or her spouse, his or her children, and his or her
parents.
Section VI. ADOPTION OF BYLAWS
The form of these Bylaws shall be initially approved by the PAC, and shall
be effective upon ratification by the Common Council. Any amendment may be
made by 2/3 vote of the PAC membership and ratification by the Common Council.
