SUBJECT: APPEAL OF PLANNING COMMISSION'S DENIAL OF
TENTATIVE TRACT NO. 13630
MAYOR AND COMMON COUNCIL MEETING - February 19, 1990
REOUEST
The applicant, Joseph E. Bonadiman and Associates, Inc., is
appealing the denial of Tentative Tract No. 13630 by the
Planning commission. The applicant requests that the Mayor and
Council reconsider the denial and approve the tentative tract.
BACKGROUND
Tentative Tract No. 13630 is an application to subdivide one
11.42 acre parcel into 35 single-family lots located at the
northeast corner of Belmont and Magnolia Avenues in the RL, Low
Residential, General Plan land use designation. The tract was
effectively denied because a motion for approval was denied by
a 5 to 2 vote of the Planning commission on January 23, 1990.
( See Exhibit "B".)
The Environmental Review Committee reviewed the Initial study
for the project on December 21, 1990, and recommended that a
Mitigated Negative Declaration be adopted. The site is located
in an area susceptible to liquefaction, high wind, high fire
and biological and archaeological resource management overlay
districts.
APPEAL BASIS AND ANALYSIS
The applicant is basing the appeal upon the fact of compliance
with the General Plan land use designation density and
development standards.
Residents in the area do not agree with the density designation
of the General Plan, and their testimony was heard by the
Planning commission. However, the tract is being proposed at a
density of 3.06 units per gross acre, and the General Plan
allows for a maximum density of 3.1 units per gross acre and a
minimum lot size of 10,800 square feet. These requirements are
complied with. In addition, the residents cited the need for
infrastructure in the area.

is scheduled to occur in the Verdemont area has not been
provided. The necessity of having installed or constructed
schools, adequate roads, drainage, fire station, and
landscaping and park facilities prior to development was sited
as the problem with approving this and any other tracts in the
area. This timing and financing issue has been a difficult
policy matter the City has been trying to resolve.
OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL
The Mayor and Council may:
1. Deny the appeal and uphold the Planning Commission's
denial of the tract~
2. Uphold its appeal and approve the tract as originally
conditioned in the Planning Commission's staff report; or,
3. Uphold the appeal, approve the tract as originally
conditioned in the Planning Commission's staff report, and
add conditions of approval which limit the development to
start only after construction of all the infrastructure
improvements have begun and to limit home occupancy to
occur only after completion of all the infrastructure
improvements. (See Exhibit "D" for additional Conditions
of Approval.)
Option 1 supports the Planning Commission's action.
Option 2 supports the Appellant's request and original staff's
recommendation.
Option 3 supports a compromise position of approving the
subdivision, but prior to construction and occupancy of the
homes adequate infrastructure must be built.
RECOMMENDATION
Staff is amending their original recommendation by trying to
resolve the timing issue and making that issue a Condition of
Approval. Therefore, staff is recommending Option 3 as
outlined above. This option places an incentive on the
developer to help solve the financing issue for the needed
improvements and push for their constuction.

REOUEST
The applicant is requesting approval to subdivide one parcel
consisting of approximately 11.42 acres into 35 single-family
lots in an area designated by the General Plan as RL, Resi-
dential Low. The proposed densIty is 3.06 units per gross
acre; the minimum lot size proposed is 10,800 square feet.
The land use designation allows a density of 3.1 units per
gross acre and requires a minimum lot size of 10,800 square
feet.
SITE LOCATION
The 11.42 acre site is located at the northeast corner of
Blemont Avenue and Magnolia Avenue, in the Verdemont Area.
The site has a frontage on Belmont of approximately 735 feet
and a frontage on Magnolia of approximately 645 feet (see
Attachment H, Location Map.)
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed project is consistent with the Municipal Code
and in conformity with the General Plan as shown in Attach-
ment A.
CALIFORNIA ENVIRONMENTAL OUALITY ACT
The Initial Study was prepared by staff and presented to the
Environmental Review Committee (ERC) on December 21, 1989.
The ERC found that no significant impacts will result from
the project and recommended a Negative Declaration. The
Negative Declaration was available for public review from
December 28, 1989 to January 8, 1990. To date no comments
have been received. If comments are received, they will be
presented to the Planning Commission at the January 9, 1990
Planning Commission meeting (See Attachment E, Initial
Study. )
ANALYSIS
site Characteristics
The 11.42 acre site is currently vacant with the exception of
an old foundation. The property slopes slightly (Ca. 5%)
from northwest to southeast and has two natural drainage
ravines that traverse the site in the direction that it
slopes. The property has been recently disced and all that

remains are grasses and a small stand at ornamen~a~ ~ree

The property currently has frontage on Belmont to the south,
Magnolia to the west and Meyers Road to the north. Belmont
and Magnolia are paved but are not improved with curb, gutter
or sidewalks. Meyers Road is improved on the north side with
curb and gutter. All three of the roads are in very poor
condition.
Surrounding Area
The property to the south and northeast are vacant. One
residence is located adjacent to the southeast corner of the
site and single-family residences are located to the north,
across Meyers Road and to the west, across Magnolia.
Density and General Plan
The General Plan allows a maximum density of 3.1 dwelling
units per gross acre with a minimum lot size of 10,800 square
feet. The proposed project proposes a density of 3.06 units
per acre with a minimum lot size of 10,800 square feet.
Access and Circulation
The proposed tract proposes two cul-de-sacs and a temporary
cul-de-sac at the east terminus of Meyers Road. Meyers Road
currently dead ends at the east terminus of the project site
and has residences located on the north side of it. Meyers
Road is approximately 760 feet in length. The Subdivision
Code (Title 18, San Bernardino Municipal Code) and the
Verdemont Area Plan does not allow dead end streets or cul-
de-sacs in excess of 500 feet in length. Therefore, the
Engineering and Fire Departments are requiring that a tempo-
rary cul-de-sac be constructed at the east terminus of Meyers
Road and that lots 27, 28 and 29 not be developed until such
time as Meyers Road is extended to the east and provides a
secondary access. Those three lots mentioned are located
more than 500 feet from Magnolia Avenue and would be at risk
in the event of evacuation for a disaster. A condition has
been included. (See Attachment C, Conditions.)

Grading
The applicant has indicated that there will be 41,000 cubic
yards of cut and 39,000 cubic yards of fill. There will be
approximately 3,000 cubic yards of export. A permit from
Public Services will be required for truck route approval and
hours of operation.

Hazards
The site is located within an area susceptible to liquefac-
tion, high wind, high fire and Greenbelt Zone C. A liquefac-
tion report will be required and must be reviewed by the
Engineering Division prior to the issuance of any permits.
Tile roofs with hurricane clips are required on all construc-
tion and standard requirements for development within Green-
belt Zone C are required. (See Attachment C, Conditions.)
The site is located within the Chestnut Storm Drain Assess-
ment District. The developer will be required to comply with
Resolution No. 89-116 for development of the site. The site
is located in the Verdemont Area and is also subject to the
Development Fee Program. Compliance with the resolution and
fee program were found to be necessary for health and safety
of existing and future Verdemont residents. This is required
as a standard requirement (Attachment D.
Biological Resources
The site is located in the Biological Resources Management
Overlay District. A biological assessment was prepared by
Michael P. Hamilton and Associates in September of 1989. The
assessment indicates that lithe habitat quality of the site is
of minimal biological value . No endangered, threatened,
rare or sensitive species are likely to be directly impacted
by this project."
An arborist report was prepared by Knapp Associates in May,
1989 at the request of the Park and Recreation Department.
The site has approximately 30 randomly planted trees. The
report recommended preserving the Eucalvptus qlobulus (Blue
Gum) . There are three of these trees located on the site.
The report recommends replacing the other trees due to
structural defects, regrowth from stumps and loss of vitality
from lack of cultural care. The Park and Recreation Depart-
ment and the Environmental Review Committee agree with this
conclusion.
To mitigate the loss of these trees, the ERC recommends

replacing any tree removed with a 24" box tree. Tnl.s
requirement is in addition to required street trees and front
yard landscaping requirements. In order to save the Euca-
lyptus trees, the developer is proposing to render the lot
located at the northwest corner of the site non-buildable and
to place the lot within an Assessment District for mainte-
nance. This is reflected on the ~ract map (Attachment G) and
in the conditions (Attachment C).
Archaeological Resources
The site is located within an area identified by the General
Plan as having potential archaeological resources. A cul-
tural assessment was performed by Victor C. de Munck in June,
1989. This study included a review of the archaeological,
ethnographic and historical literature pertinent to the study
area, and an intensive field investigation of the subject
property.
A series of cement foundations were located in the northeast
corner of the subject property. The foundations were part of
a single-family residence built by the Triena family in the
late 1930's. The residence was donated to the San Bernardino
Fire Department District in the late 1950's and was burned to
the ground as part of their fire training drills. The Triena
family also cultivated a grape vineyard on the subject
property. No remnants of this grape vineyard remain. The
historical significance of the foundations was assessed in
accordance with the National Register Criteria and it was
determined not to be significant. No other cultural
resources were located during the field survey.
A condition has been included that, if subsurface cultural
deposits are exposed during development, a qualified archae-
ologist shall be consulted to evaluate these resources and
shall be empowered to halt constructed until appropriate data
recovery/protection measures have been implemented (See
Attachment C, Conditions).
Comments Received
All City Departments reviewed the proposal at the Environ-
mental Review Committee meeting. The Engineering Division
and Parks and Recreation Department have attached standard
requirements. The San Bernardino Unified School District
commented that the project would be subject to school facil-
ity fees as established by the Board of Education. The
Southern California Edison Company (SCE) commented that the

developer would be required to furnish two copies of the
final map prior to recordation and comply with all rules and
regulations of SCE, as filed with the Public utilities
Commission for the installation of underground or overhead
electric utilities within this tract.

CONCLUSION
Tentative Tract No. 13630 meets all of the development
standards of the Municipal Code and is consistent with the
General Plan and the Subdivision Map Act. Impacts associated
with the project will be mitigated and reduced to a level of
insignificance. A mitigation monitoring program has been
prepared to ensure that all mitigation required in the
Initial Study will be complied with.
RECOMMENDATION
It is recommended that the Planning commission:
1. Adopt the Mitigated Negative Declaration; and,
2. Approve the Mitigation Monitoring/Reporting Program
(Attachment F); and,
3. Approve Tentative Tract No. 13630, subject to the
attached Findings of Fact (Attachment B), Conditions of
Approval (Attachment C) and Standard Requirements
(Attachment D).

1. The requested subdivision is consistent with the ml.nl.mum
lot development standards of the RL, Residential Low,
land use designation and is consistent with the General
Plan adopted by the Mayor and Common Council on June 2,
1989, in that the density of the proposed tract is 3.06
dwelling units per gross acre while the plan will allow
3.1 dwelling units per gross acre.
2. All lots created meet Municipal Code requirements in
that they and each rectangular lot has a minimum width
of 80 feet (88 feet on corner lots) and depth of 100

COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.
a. The Covenants, Conditions and Restrictions (CC & R's) shall
be reviewed and approved by the Planning Department prior
to final approval of the tract maps. The CC & R's shall
include liability insurance and methods of maintaining the
open space, recreation areas, parking areas, private roads,
and exterior of all buildings. The CC & R's shall also
include a statement that no radio frequency antenna shall
be included within the complex except for central antenna
systems.
b. No lot or dwelling unit in the development shall be sold
unless a corporation, association, property owner's group,
or similar entity has been formed with the right to assess
all properties individually owned or jointly owned which
have any rights or interest in the use of the common areas
and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity,
and with authority to control, and the duty to maintain,
all of said mutually available features of the development.
Such entity shall operate under recorded CC & R's which
shall include compulsory membership of all owners of lots
and/or dwelling units and flexibility of assessments to
meet changing costs of maintenance, repairs, and services.
Recorded CC & R's shall permit enforcement by the City of
provisions required by the City as conditions to approval.
The developer shall submit evidence of compliance with this
requirement to, and receive approval of, the Commission
prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.
c. Every owner of a dwelling unit or lot shall own as an
appurtenance to such dwelling unit or lot, either (1) an
undivided interest in the common areas and facilities, or

diverging from the front to rear of the lot, shall have a width
of not less than 60 feet measured at the right angle to the lot
depth at the midway point between the front and rear lot lines,
and a width of not less than 40 feet measured along the front
lot line as delineated on the tract map.
Where lots occur on the bulb of the cul-de-sac, a minimum lot
depth of lOO feet will be permitted. If the proposed depth is
less than 100 feet, a plot plan must be submitted to
demonstrate that a buildable lot area is possible and to justify
the lesser depth.
Variable front building setback lines of at least -12- feet and
averaging 30 feet, and side street building setback lines 15
feet shall ~delineated on the final tract map. All garage
entrances on a dedicated street shall have a minimum setback of
18 feet.
Perimeter walls and walls required along the rear of all double
frontage lots shall be designed and constructed to incorporate

COMPOSITE DEVELOPMENT PLAN
A composite Development Plan (CDP) shall be filed with the
Engineering, Planning, and Building & Safety Departments prior
to Final or Parcel Map processing by the City pursuant to
Ordinance No. MC-592. The COP shall provide additional survey
and map information including, but not limited to, building
criteria (e.g. setbacks), flood control criteria, seismic and
geological criteria, environmental criteria and easements of
record. The COP shall be labeled with the title "Composite
Development Plan", and contain a section entitled "Composite

Tentative Tract No. 13630 Mitigated Negative Declaration
Introduction
In compliance with Public Resource Code Section 21081.6
(enacted by passage of A83180 (Cortese)), public agencies
approving projects which may cause significant environmental
impacts must monitor the mitigation of those impacts. This
Mitigation Monitoring/Reporting Plan, ensures implementation
of the mitigation measures adopted by the Planning Commission
in approving the project and the Mitigated Negative
Declaration.
Mitigation Measures and Monitoring/Reporting Activities
Prior to beginning construction the applicant shall furnish
the City Planning Department with a checklist chart to use in
tracking the mitigation monitoring and reporting activities.
The chart shall list each mitigation measure, monitoring or
reporting action and be ruled into columns that are designed
to record responsible agency, dates of completion, inspector
or other certifying persons and the person recording the
information.
Biological Resources Mitigation Measures
1. A tree removal permit shall be obtained from the
Planning Department prior to the removal of trees.
2. Preserve the Eucalyptus trees as recommended by the
Arborist Report.
3. Comply with the City of San Bernardino Park and Recrea-
tion Department in preserving and/or relocating trees.
4. Replace any tree removed with a 24" box tree.
Biological Resources Monitoring/Reporting Action

impacts to less-than-significant.
3a. During grading and development of the site there
will be changes in absorption rates, drainage
patterns and the rate of surface waters due to
impermeable surfaces. This impact is considered
to be less-than-significant with the proposed
improvements to handle the runoff.
3d. The proposed project may reduce the guantity of
water seeping into the ground. This is not
considered to be significant due the small size
of the project and thus the small difference in
the quantity.

drainage facilities and easements be provided reduce

4c. The project site has approximately 30 randomly
planted trees. Gradinq and development will
require removal of the trees. An arborist
report was submitted. The report recommends
preserving the Euclayptus qlobulus (Blue guml.
There are three of these trees located on site.
It is necessary not to disturb the sni1 within
fifteen feet from the base of thp trpp~ tn h~
preserved. The report states thnt th~ r~m~inner
of the trees should be replaced due to structural
defects, regrowth from stumps and less of vitality
from lack of cultural care. The Parks and
Recreation Department agrees with this conclusion.
The developer is proposing to render the ~ot located
closet to the corner lot may be saved. The developer
shall work with Parks and Recreation and Engineering
to save the tree if at all possible.
To mitigate the loss of the mature trees the
developer shall:
1. Obtain a tree removal permit from the
Planning Department prior to removal of any
trees.

total of thirty (30) randomly planted trees and founda-
tion plants. They are existing in an environment they
have established over the past forty-plus years.
In preservation it will be necessary not to disturb the
so:: ~ithi~ fifteen feet (15') from the base of the trees.
:nj~ries and stress become of paramount when existing
trees are urbanized and preserved. If preservation guide-
lines cannot be followed, I recommend replacement of all
existing trees ~nd shrubs.
