Description) Finance: -'uncil Notes: 75-0262 Agenda Item No. IE CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT The Board of Water Commissioners entered into negotiations with representatives of Van Loon Mutual Water Company to determine terms and condi t ions for havi ng the Water Department take over thei r service area. Van Loon Mutual Water Company provides water service for one hundred forty-one (141) service connections. Forty-two percent (42%) of the service connections are within the corporate limits of the City. The company recently experienced the loss of their production facilities and we provided water through our Mutual Aid Agreement. The service area for Van Loon is bounded on the north by Gilbert Street, on the east by East Twin Creek Channel, on the south by 01 i ve Street and on the west by Cedar Street. That port i on of the i r serv ice area along Base 1 i ne and be low Base 1 i ne Street is within the corporate boundaries of the City of San Bernardino; the remainder is in the unincorporated area of the county. Terms for the acquisition of the service area and all physical assets of the company have been agreed to, and the Purchase Agreement approved by the Board of Directors of Van Loon Mutual Water Company and the Board of Water Commissioners. The terms of the agreement require the company to reimburse the Water Department the costs to intertie their system to ours, and for each service connection to be metered. The date of the transfer of all assets and the service area is April 1, 1990. In accordance with Section 2.28.030 of the Municipal Code, water service outside the corporate 1 imits of the City shall not be authorized or approved by the Board of Water Commissioners except with the approval of the Mayor and Common Council. 75-0264 1 2 3 4 5 6 7 8 9 RESOLUTION NO. A RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE BOARD OF WATER COMMISSIONERS TO PROVIDE WATER SERVICE FOR THOSE PROPERTIES WITHIN THE SERVICE AREA OF VAN LOON MUTUAL WATER COMPANY, LOCATED OUTSIDE THE CORPORATE LIMITS OF THE CITY OF SAN BERNARDINO. WHEREAS, the Van Loon Mutual Water Company provi des water service to all shareholders within their service area boundaries as set forth in Exhibit "AU; and 10 WHEREAS, the Van Loon Mutual Water Company is desirous of 11 selling all of its assets to the Board of Water Commissioners, City 12 of San Bernardino; and 13 WHEREAS, Van Loon Mutual Water Company currently has one 14 hundred forty-one (141) service connections, of which eighty-two 15 (82) are located outside the corporate limits of the City of San 16 Bernardino, and are located as follows: on the east side of Cedar 17 Street between Baseline and Gilbert Streets; on the south side of 18 Gilbert street between Cedar Street and Canyon Road; and on Canyon 19 Road between Baseline and Gilbert Streets; and 20 WHEREAS, the balance of fifty-nine (59) service connections 21 served by Van Loon Mutual Water Company, are within the corporate 22 limits of the City of San Bernardino; and 23 WHEREAS, terms and conditions for the sale of Van Loon Mutual 24 Water Company have been agreed to with the Board of Water 25 Commissioners, with an effective takeover date of April 1, 1990. 26 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL 27 OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 28 SECTION ONE: Pursuant to a Purchase Agreement between Van 1/25/90 RESOULTION APPl LNG THE BOARD OF WATER COMMISSI"..iRS TO PROVIDE WATER SERVICE FOR THOSE PROPERTIES WITHIN THE SERVICE AREA OF VAN LOON MUTUAL WATER COMPANY, LOCATED OUTSIDE THE CORPORATE LIMITS OF THE CITY OF SAN BERNARDINO. 1 2 3 4 5 6 7 8 9 Loon Mutual Water Company and the Board of Water Commissioners, the Board of Water Commissioners may provide water service to those properties within the service area of Van Loon Mutual Water Company that are located outside the corporate limits of the City of San Bernardino.
