CITY OF SAN BERNARDINO - REQUEST FUR COUNCIL ACTION
STAFF REPORT
Tentative Tract No. 14356 was approved by the Planning
Commission on May 16, 1989, subject to the Findings of Fact,
conditions of approval and standards conditions.
Tract No. 14356 is a reversion to acreage to re-combine
lots originally created by the recording of Tract 11407, 11745,
11746, 11747 and 11748. No improvements have been constructed
in connection with these tracts; therefore, the subdivision
bonds can be released, except that the City will retain
sufficient right of way and bonding to cover the completion of
Sun Valley Drive since it is a through street and the alignment
has been set.
A new tentative map, Tract No. 14388, was approved by
the Planning Commission on November 7, 1989. This new tentative
tract cover the same land as reversion to acreage Tract No.
14356. The new tentative tract proposes to divide the land into
98 single family lots. Barratt Homes will construct the streets
under conditions of approval of the new tentative tract.
The required improvement securities and certificates of
insurance have been filed with this office, and the prescribed
fees have been paid. Also, the improvement plans have been
approved.
The Final Map has been reviewed and found to be in sub-
stantial compliance with the Tentative Map and the Subdivision
Map Act. Therefore, we recommend that the Final Map be
approved.

RESOLUTION NO.
RESOLUTION OF THE CI'fY OF SAN BERNARDINO APPROVING THE
FINAL MAP FOR REVERSION TO ACREAGE IN TRAOT NO. 14356, LOCATED AT
SUN VALLEY DRIVE AND FORTY-EIGHTH STREET, ACCEPTING THE PUBLIC
DEDICATIONS AS SET FORTH ON SAID MAP; AND AUTHORIZING EXECUTION
OF THE STANDARD FORM OF AGREEMENT FOR THE IMPROVEMENTS IN SAID
REVERSION TO ACREAGE, WITH TIME FOR PERFORMANCE SPECIFIED.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1: The Mayor and Common Council find that
proposed reversion to acreage in Tract No. 14356, located at Sun
Valley Drive and 48th Street, together with the provisions for
its design and improvements is consistent with the General Plan
of the City of San Bernardino.
SECTION 2.
The Mayor of the City of San Bernardino is
authorized on behalf of said City to execute the standard form of
agreement adopted by Resolution No. 84-8 with Barratt Homes,
Incorporated, a Delaware Corporation, for the improvements in
said reversion to acreage in the tract as are required by Title
18 of the San Bernardino Municipal Code and the California
Subdivision Map Act.
Section 12(b) (1) of said Agreement is
hereby amended to require public liability insurance in an amount
of not less than $250,000 per person and $500,000 per occurrence.
The time for performance is specified at 24 months.
Said
improvements are specifically described and shown on Drawings
approved and on file in the Office of the City Engineer of the
City of San Bernardino.
SECTION 3:
The Final Map of said subdivision tract is
hereby approved and the City of San Bernardino hereby accepts as
public property all dedications wi thin the reversion to acreage

1 as shown on said Final Map for streets, alleys, (including access
2 rights), drainage and other public easements.
As a condition
3 precedent to approval of the Final Map, the Subdivider shall
4 first execute the agreement referenced in Section 2 hereof for
5 the improvements wi thin said subdivision. The City Clerk shall
6 certify the approval and acceptance of the Mayor and Common
7 Council as set forth in this resolution.

SECTION 4. This resolution is rescinded if the parties
9 to the agreement fail to execute it within sixty (60) days of the
10 passage of this resolution.
