STAFF REPORT
On November 6, 1989, authorization was given to proceed with the proposed annexation
of the area generally located South of Hill Drive, East and West of Third Avenue. This
action was a result of a petition received by the City from a property owners who
represents 50~ of the area proposed for annexation. The actual petition was filed by
the property owners directly with LAFCO. LAFCO, as part of their proceedings, expanded
the area to include the parcel on the West side of Third Avenue.
On November 6, 1989, Resolution No. 89-435 was adopted, determining the amount of
property tax to be transferred to the City from the County of San Bernardino, relative
to the proposed annexation.

A RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING ANNEXATION
3 NO. 341, (LAFCO 2570) FOR THE TERRITORY GENERALLY LOCATED SOUTH OF HILL
DRIVE, AND EAST AND WEST OF THIRD AVENUE AND DETACHMENT FROM CSA 38, CSA 70
4 AND CSA SL-1 AND TO PROCEED WITHOUT HEARING.

WHEREAS, pursuant to the provisions of the Cortese-Knox Local
Government Reorganization Act of 1985, Division 3, commencing with section
56000 of the California Government Code, proceedings were initiated by the
Common Council of the City of San Bernardino, to annex to the City of San
Bernardino, certain contiguous uninhabited territory hereinafter described;
and
WHEREAS, a Landowner in the proposed annexation has requested
annexation to the City of San Bernardino to receive extended urban services;
and
WHEREAS, the Local Agency Formation Commission has set forth the
following terms and conditions in its Resolution No. 2239 :
"Condition No. 1. The
conducting authority for this
proceeding shall be the City Council of the City of San Bernardino.
"Condition No.2. The boundaries are approved as set forth
in Exhibit "A" attached.
"Condition No.3. The fo 11 owing distincti ve short form
designation shall be used throughout this proceeding: LAFC 2570.
"Condition No.4. Included
in the City's
resolution
depicting final action shall be the detachment of County Service Area 38,
County Service Area 70, and County Service Area SL-1 without split of assets
or liability.
"Condition No.5. Approval is hereby granted to proceed
without notice, hearing or election with 1001 consent of the property
owners.

"Condition No.6.
The date of issuance of the Certificate
of Completion shall be the effective date of this annexation.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Said territory herein described as Annexation No. 341,
designated as LAFCO 2541, is hereby annexed and incorporated in and made a
part of the City of San Bernardino.
SECTION 2. The territory herein referred to as being annexed to
the City of San Bernardino is more particularly described in Exhibit "A",
which said Exhibit is attached hereto and incorporated by reference as fully
as though set forth in length herein.
SECTION 3.
The above described territory will be subject to
taxation equally with the property within such municipal corporation.
SECTION 4. The regular County Assessment Roll is utilized by the
City of San Bernardino.
SECTION 5. The property herein annexed is declared to be a part
of Ward 5 and the boundaries of Ward 5 are hereby altered to include said
annexed territory, zoned as RS (Residential Suburban).
SECTION 6. The area included in the above annexation is hereby
detached from County Service Area 38, Improvement Zones G and L of County
Service Area 38, County Service Area 70, Improvement Zone A of County
Service Area 70, and County Service Area SL-1, without split of assets or
liabil i ty .

ANNEXATION
TO
CITY OF SAN BERNARDINO
Lot 31, Arrowhead Suburban Farms, Tract C, in the county of
San Bernardino, State of California, as per map recorded in Book
23 of Maps, Page 23, records of said County, that portion of Lot
1, Arrowhead Suburban Farms, Tract E, as per map recorded in Book
25 of Maps, Page 59 and those portions of the adjoining street,
described as follows:
Beginning at a point in the center line of Hill Drive which
is East 330 feet from its intersection with the center line of
Third Avenue, said point being also on the Northerly prolongation
of the East line of said Lot 31 and on the existing city limits
line of San Bernardino;
Thence West along said center line of Hill Drive and said
city limits line to a point which is 90 feet West of the center
line of Third Avenue, said point being also an angle point in
said city limits line;
Thence South along a line that is parallel with and 90 feet
West, measured at right angles, from the center line of Third
Avenue and along said city limits line 157 feet to the South line
of said Lot 1, being also an angle point in said city limits line;
Thence East, 90 feet along said South line and said city
limits line to the center line of Third Avenue, being also an
angle point in said city limits line;
Thence leaving said city limits line East along the
prOlongation and South line of said Lot 31, 330 feet to the
Southeast corner of said Lot 31;
Thence North 157 feet along the East line of said Lot 31 and
its prolongation to the POINT OF BEGINNING.
