SUBJECT: APPEAL OF PLANNING COMMISSION'S APPROVAL OF
TENTATIVE TRACT NO. 14528

REOUEST
The appellants, seven neighbors in the area (see appeal
letter Attachment "A") , are appealing the approval of
Tentative Tract No. 14528 by the Planning commission on
December 12, 1989. The appellants request that the Mayor and
Council reconsider the approval and deny the proposed
subdivision.
BACKGROUND
Tentative Tract No. 14528 is a proposal to create a 14
single-family home subdivision in the RL, Residential Low,
land use designation. The project is located on a 5.0 acre
site at the northwest corner of Meyers Road and Magnolia
Avenue in the Verdemont area. The minimum parcel size that
is proposed is 11,549 square feet, with a density of 2.8
units per gross acre (3.1 units per gross acre is allowed).
The Environmental Review Committee, on November 2, 1989,
recommended a Negative Declaration for the project. No
comments were received during the public comment period.

The site is located within the high wind, high fire,
Greenbelt Zone B and an archaeologically sensitive area. The
project was conditioned to comply with all standards that
mitigate being located in these zones.
The subdivision was also conditioned to provide secondary
access by the construction of a 24 foot wide, paved temporary
emergency access by extending Meyers Road westerly from the
project to Little League Drive.

BASIS OF APPEAL
Belmont Avenue is in poor condition and is not able to
provide adequate access to the subdivision.
Magnolia Avenue is a one lane road and is not able to provide
adequate access to the subdivision.
The area is located in a high wind area.
The area is "out of olace" among the nine homes that exist
on one acre parcels.
ANALYSIS OF APPEAL
The Engineering Department has reviewed the road circulation
system supporting subdivision and has required improvements
along Magnolia and Meyers Roads. In addition, the road
system in Verdemont is proposed to be upgraded by the
Development Fee Program the City has initiated.
The project was conditioned to construct the residences in
compliance with the mitigation standards for high wind.
The density issue in the Verdemont area was debated by the
Planning commission and Council during the General Plan
hearing process. It was decided by Council to designate this
area as RL, Residential Low, which allows parcels to
be a minimum of 10,800 square feet and not 1 acre. This
designation and the General Plan were adopted on
June 2, 1989.

deveJepment of Tentative Tract 14528. We moved to this area to get away from the busy
residential streets that exist all over the City elf San Bernardino. 'C'l~e ~jcU) t~fO 9Hiet
country like living and the openness of not having homes built so cl~se ~&gJ(her that you
can see the color of your neighbor's eyes from your own front doors.
Who will purchase these proposed homes? Couples from surrounding cities who want to
move here because housing is more affordable? Couples that work in cities other than San
Bernardino, spend more time and money in other cities, but send their children to already
over crowded San Bernardino schools? The major~ty residents in the immediate area work in
San Bernardino and own businesses in San Bernardino. Business owners that pay business
license fees, utility tax on their business utilities, and property tax on their business.
The present home owners want to work in the City and enjoy living "out in the country".
We want to keep this area of Verdemont in a country like atmosphere and oppose the
proposed development of Tentative Tract 14528 ior the following reasons:
The condition of Belmont Avenue, which is the main road off of Palm
Avenue and leads up to the proposed development, is very poor. There are
numerous patched pot holes, dips, bumps and mud when;tt rains. Belmont
Avenue is wide enough to let two cars pass if one car uses the dirt
shoulder. The proposed tract will bring 14 new families to this area.
Considering that there will be at least two cars per home, that would
mean at least 28 cars traveling along Belmont Avenue. During the Little
League Baseball Tournament, baseball fans park their cars along both
sides of Belmont Avenue causing one way traffic. Just this last tourna-
ment, a car was traveling too fast down Belmont Avenue, hit one of the
dips and rolled over. There was one paramedic truck, two ambulances and
two police cars at the scene blocking traffic either way.

Magnolia Avenue, which is an access road to the proposed development,
is a one lane road, A car coming up or down Magnolia Avenue has to pul~
over and stop,to let a car coming in the opposite direction to pass. ~e
impact of 28 more cars in this small area is overwhelming.

This area is a high wind area, Since October 4, 1989 alone, ther~has:
been 33 days of very strong wind. Because these strong ,,;c:old winds amP ,::2
other harsh weather elements we face up here are impossible to walk in;owe
have to drive our children to the school bus stop (corner of Belmont a~
Magnolia Avenues). One morning there were three cars parked there wit~
children for the school bus. If the proposed development is completed:-
will there be 14 more cars parked at the corner with children waiting for
the school on windy and rainy days?

We live in a unique area. Where else in the City of San Bernardino can you find
homes on one acre lots? We would like to see this area stay unique, to stay quiet from
the traffic and development of track homes. We do not want to see 14 homes built on only
five .acres.
The residents now living in this area built their homes on' their one acre plus lots
when the zoning was for acre lots only, It was our understanding then that this area would
qy one acre lots only, We built our homes with pride and a lot of time and effort. We
~~n't want to see homes built so fast that they fall apart before the tenants move in. We
are not opposed to new housing in this area on one acre lots. This proposed track is
~ of place among the nine homes that already exist on one acre parcels.

This project looks good on paper but we do not live on paper. Please consider this a
little more than how it appears on paper. Before you make a final decision that will have
a lasting effect on the area and on over nine families already living here, come up and
visit this area. You will see how out of place this track will be. Can .the City of San
Bernardino have at least one place where you can still see hawks flying overhead and the
only sound you hear all day and night is the train whistle? As the Sun stated in the
December 6, 1989 newspaper, this is "the city 's last large reserve oTOpen space". Can
we keep it that way?

FINDINGS OF FACT
1. The requested subdivision is in accordance with the
minimum lot development standards of ,the R-1-10,800
single family residential zone and is consistent with
the General Plan adopted by the Mayor and Common Council
on June 2, 1989, in that the density of the proposed
tract is 2.8 dwelling units per gross acre while the
plan will allow 3.1 dwelling per gross acre.
2. All lots created meet Municipal Code requirements in
that they and each rectangular lot has a minimum width
of 80 feet and depth of 100 feet. The irregular lots
meet code requirements.
3. The design of the subdivision and proposed improvements
are not likely to cause substantial environmental damage
or cause serious public health problems, in that
development will occur according to the conditions of
approval and standard requirements contained in this
report.
4. The proposed tract meets or exceeds the minimum require-
ments of the City's Subdivision Ordinance (Title 18) and
the state Subdivision Map Act. All lots will have
frontage on dedicated streets.
5. All proposed streets meet the minimum requirements of
the Department of Public Works for street improvements.

Proposed Tentative Tract 14528 is consistent with the
Municipal Code and General Plan as shown in Attachment A.
CALIFORNIA ENVIRONMENTAL OUALITY ACT
An Initial Study was prepared by staff and presented to the
Environmental Review Committee (ERC) on November 2, 1989. The
ERC found that no significant impacts will result from the
project and are recommending a Negative Declaration. The
proposed Negative Declaration was advertised and available
for public review from November 7, 1989 to November 22, 1989.
No comments were recieved from the public during that period
(See Attachment liE II , Initial study).
ANALYSIS
site Characteristics
The 5.0 acre site consists of vacant land located at the
northwest corner of Meyers Road and Magnolia Avenue. The
property slopes from north to south at approximately 6.5 per-
cent. The site is located in the Verdemont area and within
the High Wind, High Fire, Greenbelt Zone B, and an
archaeologically sensitive area.

south across Meyers Road are existing residences. To the
east across Magnolia Avenue is an existing residence.
Density and the General Plan
The General Plan allows a density of 3.1 units per gross acre
with minimum lot size of 10,800 square feet. This project
proposes a density of 2.8 units per gross acre, and all lots
proposed are greater than 10,800 square feet.
Access and Circulation
The proposed project is required to have two points of
access. The project will be required to provide secondary
access by construction of 24 foot wide temporary emergency
access extension of Meyers Road westerly from the project to
Little League Drive. All of the interior streets have been
designed to meet the requirements of the Verdemont Area Plan
(VAP) and the city Engineering Department.
ENVIRONMENTAL CONCERNS
As stated above, the project is located within the High Wind,
High Fire, and Greenbelt Zone B areas. The project will be
required to comply with all applicable Verdemont Area plan
standards, which will mitigate the potential hazards of being
located in those zones. The project is also located in an
archaeologically sensitive area. A Cultural resources
records search was conducted by the Archaeological
Information Center of San Bernardino County Museum, which
recommended that a field survey was not necessary. A
biological resource survey was performed for the site on
August 29, 1989, which found no evidence of any sensitive or
endangered species of plants or animals.
Drainage
The project site slopes from north to south at approximately 6.5
percent. A six foot high decorative screen wall is proposed
along the northerly property line. Off-sLtestorm water will
enter the site through weep holes in the walls and be
conveyed into cross lot drainage through lots 10 and 11,
confluenced with on~site water, and conveyed westerly onto
Meyers Road. All on-site drainage will be conveyed into the
interior streets and then into Meyers Road. This project is
located within the assessment district being formed for the
Chestnut Avenue Storm Drain. The property owners will be
required to join this assessment district as a condition of
approval of this map.

Comments Received
All City Departments reviewed the proposal at the
Environmental Review Committee meeting. The Engineering and
Water Departments have attached Standard Requirements. The
San Bernardino Unified School District commented that the
project would be subject to school facility fees as
determined by the Board of Education. The Southern
California Gas Company commented that it has a three inch gas
main in Meyers Road which ends at Little League Drive from
which distribution lines could be extended to serve the
proposed project without any significant impact on the
environment.
CONCLUSION
Tentative Tract 14528 meets all of the development standards
of the Municipal Code, and is consistent with the General
Plan and the State Map Act. Potential impacts associated
with the development of the project will be reduced to a
level of insignificance.
RECOMMENDATION
It is recommended that the Planning commission:
1. Adopt the Negative Declarationi and,
2. Approve Tentative Tract No. 14528 subject to the
following Findings of Fact (Attachment B), Conditions of
Approval (Attachment C) and Standard Requirements
(Attachment D).

COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.
a. The Covenants, Conditions and Restrictions (CC & R's) shall
be reviewed and approved by the Planning Department prior
to final approval of the tract maps. The CC & R's shall
include liability insurance and methods of maintaining the
open space, recreation areas, parking areas, private roads,
and exterior of all buildings. The CC & R's shall also
include a statement that no radio frequency antenna shall
be included within the complex except for central ante~na
systems.
b. No lot or dwelling unit in the development shall be sold
unless a corporation, association, property owner's grc~p,
or similar entity has been formed with the right to assess
all properties individually owned or jointly owned which
have any rights o~ interest in the use of the common areas

Such entity shall operate under recorded CC & R's which

Recorded CC & R's shall permit enforcement by the City of
