CITY OF SAN BER8RDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
In the process of completing the General Plan project, the
city purchased a mapping computer which included three
terminals. While the basic software was purchased, the
programming of attribute data was not done, nor was training
of staff to digitize information. Attributes are the
physical factors to be represented on the various maps.
with the departure of the former Data Systems Manager, it was
found that some small increment of the necessary work was
being done. In order to facilitate the program, this
agreement was prepared.
You will note the work project is attached and is primarily
oriented to providing a product tied to the Norton Reuse
project. Amounts not paid by the Norton project will be paid
from Professional/Contractual Services of Data Processing.
Currently, Planning and Engineering Departments' staff are
receiving training on the equipment.
The GDS or Mapping system is the basis for the Refuse
Routing, Permit tracking Fire station locators, Sewer and
Storm Drain, Street light, Police incident analysis, and
General Plan zoning system. Your council has approved the
scanning of the city maps to provide a single base map of the
entire city. That project is proceeding.

SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said city
an agreement with Greg
ziak (3-D Consulting) to perform
consulting services for the Data Processing Division, a copy of
which is attached hereto marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
SECTION 2.
The authorization to execute the above

A G R E E MEN T
THIS AGREEMENT is made and entered into this day
of , 1990, by and between the CITY OF SAN BERNARDINO
a municipal corporation, 300 North "D" Street, San Bernardino,
California 92418, (herein referred to as "City"), and Greg Ziak
(3-D Consulting), 22875 Leo Lane, El Toro, California 92630,
(herein referred to as "Consultant."
city and Consultant agree as follows:
1. General Description of Work to be Done.
City hereby engages Consultant, and Consultant hereby
accepts such engagement, to perform the services herein
described for the compensation herein provided. Consultant
hereby assures and covenants to City that he has the
qualification, experience and facilities to properly perform
said services, and hereby agrees to undertake and complete the
performance thereof for the compensation herein provided.
2. Term.
The term of this agreement shall commence January 9, 1990
and end June 30, 1990. This agreement may be extended on a
month-to-month basis for a maximum of twelve (12) additional
months upon the express written consent of Consultant to such
extension and the approval thereof by the City Administrator.
3. Payment and provision of Payment.
A. Maximum Compensation.
(1) Maximum total compensation to be paid under this
agreement shall be Twenty Thousand Dollars ($20,000).
(2) Consultant shall provide a minimum of 60 hours of
service per calendar month.

B. Manner of Compensation
(1) Consultant shall maintain and file with the Data
Division a record of all hours work on assigned
Said projects shall be listed by work order.
(2) The Data systems Manager shall submit a claim or
request for payment based on such record to the Finance
Department in such manner that Consultant shall be paid bi-
weekly.
Processing

(3) Consultant shall assume and pay all out-of-pocket
expenses and costs of performing services under this agreement
except as otherwise specifically provided herein, and City shall
not be liable for any such costs and expenses.
4. General Description of Work To Be Done.
City hereby retains Consultant to perform programming
and training services as set forth in Exhibit A dated November
9, 1989, and perform other related programming and training
services which may be required by the Division in relating to
the G.D.S. functions which are or may be utilized in the City
services as determined by the Data Systems Manager in the
exercise of his sole discretion.
5. Amendments
This agreement may be amended or modified only by
written agreement executed by both parties.
6. Assiqnment.
Consultant's rights under this agreement shall not be
assigned by Consultant to any other person, firm or corporation
without the prior written consent of the city.
7. Relationship of Parties.
Consultant is acting as an independent contractor, and
not as an employee of the city. In the performance of personal

services pursuant to the provisions of this agreement,
Consultant shall not be supervised, directed, or under the cont-
rol or authority of any City officer or employee, except and to
the extent as may be expressly or implicitly required by the
terms and provisions of this agreement. Issues of compatibility
and consistency with the city's Charter and ordinances shall be
discussed with the City Attorney. Any direction or control so
required under this agreement shall be limited to broad
objectives or goals of the project or program to be accomplished
and not to the details and procedures to accomplish such
objectives or goals. Consultant shall not be obligated to
conform to the supervision or direction of city officers or
employees which are not authorized herein. Changes or
modifications of said objectives and goals may be made by
written recommendations of either party subject to the
concurrence of the .other party in writing.
8. Hold Harmless.
Consultant hereby agrees to, and shall hold City, its
elective and appointive boards, commissions, officers, agents
and employees, harmless from any liability for damage or claim
for personal injury, including death, as well as from
Consultant's operations under this agreement. Consultant agrees
to, and shall defend City and its elective and appointive
boards, commissions, officers, agents and employees from any
suit or actions at law or in equity for damages caused or
alleged to have been caused by reason of Consultant's
performance hereunder including any claims that may arise
against city by reason of Consultant's legal relationship with
City being categorized as other than that of an independent
contractor.

9. Attornev's Fees.
In the event an action is filed by either party to
enforce rights under this agreement, the prevailing party shall
be entitled to recover reasonable attorney's fees in addition to
any other relief granted by the court.
10. Termination bv city.
Notwithstanding any other provision of this Agreement,
the city, by notifying Consultant in writing, may terminate all
or a portion of the services agreed to be performed under this
Agreement with or without cause. Consultant shall be given five
(5) days written notice for failure of Consultant to perform
obligations under the contract in a satisfactory manner, and
thirty (30) days written notice if termination is for other
reasons. Notice shall be mailed posted to the address set forth
herein for the receipt of notices. In the event of any
termination, Consultant shall have the right and obligation to
immediately assemble work in progress and forward same to the
City. All charges outstanding at the time of termination shall
be payable by the City to Consultant within thirty-five days
following submission of final statement by Consultant.
11. Acceptance of Final Payment Constitutes Release.
The acceptance by Consultant of the final payment made
according to the terms of this Agreement shall operate and be a
release to the City, and every employee and agent thereof, from
all claims and liabilities to Consultant for anything done or
furnished for or relating to the work or services, or for any
act or failure to act of the city relating to or arising out of
work and this agreement.

12. Acknowledqment.
a. Consultant acknowledges and agrees that City is
the sole and exclusive owner of all rights and remedies in and
to certain confidential ideas and secrets concerning the
operations of city, any products or information resulting, in
whole or in part, from the work performed under this agreement,
and all products or information derived or to be derived from
said work, regardless of whether city's or Consultant's work is
subject to patent, copyright, or other protection.
b. In the event that any work performed under this
agreement is or becomes the subject of a patent application,
patent, copyright, or other rights under the laws of the united
states or any other country, Consultant agrees and understands
that city shall have all the rights and remedies available to
City under the law as a result of such patent applications,
patents, copyrights, or other rights.
13. Confidentialitv and Non-Disclosure.
a. Consultant acknowledges that during the consultat-
ion, Consultant has had and/or shall have access to and has
become and/or shall or may become aware of secret information.
Consultant agrees to hold in confidence all such secret
information disclosed to Consultant or developed by Consultant
in connection with the work performed under this agreement,
either in writing, verbally, or as a result of the Consultant
except:
1. Information which, at the time of
disclosure, is in the public domain or which, after disclosure,
becomes part of the public domain by publication or otherwise
through no action or fault of consultant; or

2. Information which Consultant can show is in
its possession at the time of disclosure and was not acquired,
directly or indirectly, from city;
3. Information which was received by Consultant
from a third party having the legal right to transmit that
information. Nothing in this paragraph is intended to nor shall
make confidential records or information which is otherwise made
open to public inspection by law.
b. Consultant shall not, without the written
permission of the City Administrator, use the secret
information, which Consultant is obligated hereunder to maintain
in confidence, for any reason other than to enable Consultant to
properly and completely perform under this agreement.
c. Consultant shall not reproduce or make copies of
the secret information or Consultant's output, except as
required in the per.formance of this agreement. Upon termination
of the agreement for any reason whatsoever, Consultant shall
promptly deliver to city all correspondence, drawings,
blueprints, manuals, letters, notes, notebooks, reports, flow-
charts, programs, proposals, or documents concerning city.
d. Except as may be required for performance of this
agreement, Consultant shall not, during or at any time
subsequent to this agreement, unless city has given prior
written consent, disclose or use the secret information or
engage in or refrain from any action, where such action or
inaction may result (1) in the unauthorized disclosure of any or
all such secrets to any person or entity; or (2) in the
infringement of any or all such rights.
e. Consultant shall immediately notify city of any
information which comes to Consultant's attention which does or

might indicate that there has been any loss of confidentiality
of such secrets or breach of such rights.
f.
Consultant shall limit the disclosure of the
secret information to those persons in Consultant's organization
or the City, who have a need to know all or part of the secret
information. Consultant shall make such disclosure to each such
person limited to that portion of the secret information that
that person needs to know. Consultant shall inform each such
person of the provisions of this agreement regarding secret
information and shall make reasonable efforts to insure that
each such person shall abide by those provisions.
g.
To the extent not prohibited by state or federal
law, the city acknowledges that the work product provided by
Consultant shall be treated as proprietary, and not released or
given to another city or entity without the permission of the
Consultant. Moreov.er, under any circumstance, should any work
product be provided to another City or entity, it shall contain
a disclaimer that such work product may have no applicability or
enforceability in another City or entity.
14. Notices.
Any notices required to be given hereunder shall be
deemed to have been given by depositing said notice in the
united states mail, postage prepaid, and addressed as follows:

15. Entire Aqreement.
This contract constitutes the entire Agreement between
city and consultant and may be modified only by further written
agreement between the parties.

IMPLEMENTATION TASKS
FOR THE
NORTON AIR FORCE BASE LAND USE STUDY PROJECT
The following discussion of tasks is intended as a guide in getting started on the GIS input for
the Norton Air Force Base Land Use Study project effort. This is not meant to imply that this is
the order that the tasks should be done. The order should depend on the availability of the
data sources and completion of prior steps that are required. To help implement this project,
three phases will be set up to distribute the work schedule.
Phase 1 (Total Hours is 150 Hrs.)
Administrative
1. Establish the directory structure in VMS to hold all the drawing files for the land use study
project. Subdirectories identified should include names similar to those of the eleven utlity
plans to be scanned in. A VMS logical for the disk drive and project address, NORTON_DISK,
should be established for convenience in identifying the main directory.
2. Design windows for the regularly used map products. A convenient way to do this is to
create an input file that can be modified easily if changes are made in the future. A simple
GDS macro may be required for the cases when the window inclusion lists need to be modified
by a key facet in the object names. The windows presented above for the plat and Assessor's
page are examples of this situation.
3. Create a window file [MASTER]WINDOW.FGB, and add to it the windows that can be used
by simply recalling a window and redefining the extent. Define all the types of windows
needed for this type of recall (i.e. street names, quadrants, tracts, zoomin and zoom out fac-
tors, levels of detail in the zoom factors)
4. Create a library file [MASTER]CSBLlB.FGB that will contain the character styles, line styles,
and symbols needed for the project and subsequent implementation. This file should contain a
subset of the styles provided in the libraries issued with GDS. Standard map symbols can be
created as preferred objects on another sheet. Symbols for survey monuments and individual
trees are among the symbols that will likely be required. The Iinestyles known at this time are
from the city of San Bernardino, not Norton Air Force Base which is needed to help determine
what type of character and line styles will be needed for the project. If the above mentioned

styles are not provided then we will default to whatever the city uses.
5. Create a property format file [MASTER]PROPERTY.FGB that will contain the definitions of
the attribute data properties. Schema input files should be created for convenience in setting
up schemas for the various drawings that will contain data. This type of attribute data needs to
be accumulated from Norton Air Force Base, the City's Planning, Engineering and Public
Services.
6. Create an application menu filegroup [MASTER]MENU.FGB that will contain the menus
created for the land use study applications. These can be further broken down to file groups
for Main, Personal and Application menus.
7. Create an XBASIC filegroup [MASTER]BASIC.FGB that will contain the XBASIC programs
that will be used for the land use study applications.
8. Design symbology for all the graphics that will be created as part of the land use study proj-
ect. For every object name proposed in this discussion a choice of line style and character
style should be made as appropriate to the city's mapping standards. New line styles and
character styles can be created to exactly meet the city's needs for line weight, pattern, and
color.
9. Create lists of possible choices for the many objects that had "type" as one of the facets.
While it may be difficult to anticipate entirely what "types" of things will be encountered in the
land use study project area. a fairly complete list can be used to create menus that will ease
and encourage proper object naming. "Types" that have been identified include: monuments
types, easement types. individual tree types, spot elevation types. soil types, land use types,
vegetation types, roadway ownership types (Dedicated, Serviced. Unserviced. etc.), roadway
surface types (Paved, Gravel, Dirt) and source document types
10. Establish a finite list of the possibilities for keys that are text, and a range of possible val-
ues for keys that are numeric. Keys that are used as an object name facet must be 8 charac-
ters or less. Key examples that could be used in this document are:

Base Map Drawing
1. Set up the attribute data schema for drawing BASEMAP.
2. Have a scanning company scan in the Norton Air Force Base's maps for the sole purpose of
using them as a master 'underlay' where data can be later layered on top of it for reporting and
displaying purposes.
3. Have the scanning company provide 11 auxiliary files to be linked to the master base sheet.
Each auxiliary file will display a diferent type of utility plan, as per the City of San Bernardino's
Engineering, Public Services and Planning departments' specifications.
4. Check the assembled graphics for accuracy and completeness. A report on attribute data
could be used to check that attribute data has been entered and assigned properly.
5 Create polygon Pclusters for the lots, parcels, and right-of-way. A "simple parcel input"
XBASIC or VMS/DCl program can be tailored to the city's specific needs for constructing the
Pclusters from the previously assembled boundary segments and labels.
6. Create polygon Pclusters for the sections. The "simple parcel input" XBASIC or VMS/DCl
program could be used here to construct the Pclusters from the section boundary segments.
Utility Information
1. Decide what utility information will be included for the GIS project. and the level of detail that
is appropriate.

2. Decide on object names and symbology for the utility information.
3. Create menus and macros to facilitate the input of the utility information.
4. Input the utility information for the GIS project area.
Roads and Other Transportation
1. Create menus and macros required for roadway input and manipulation.
2. Move or create the street centerlines on the ROADS drawing.
3. Design a simple data annotation scheme for labeling the roads with the recorded street
name, common street name, or PlNid and segment. The supporting attribute data prepara-
tions should be included in this step.
4. Store attribute data for the three name data items.
5. Create various window displays, per street name.
Phase Three (Total Hours, as yet to be determined)
Precision Plat and Parcel Drawings
1. Create menus and macros for setting object names and styles. All the objects that are likely
to be input from a plat or Assessor's page should be included. The new user variable features
in GDS should be incorporated to assign the value for the source attribute data item as the
new objects are created. These macros should be made available for use when working with
the other sources of data for the base maps, also.
2. Modify and create XBASIC or VMS/DCl programs for convenience in annotation. Parcel
and lot numbering could be handled easily this way.
3. Enter the plats in the land use study project area, while referring to the Assessor's records
for the parcel information. The attribute data schema will need to be input for each drawing
created.

Planimetric Features
1. Create menus and macros for working with the planimetric feature object names and styles.
2. Translate in the planimetric files from possible aerial survey work. The objects may need to
be renamed and split along the subdrawing boundaries.
3. Create an XBASIC macro for renaming objects in the second class of planimetric features.
This macro is not essential, but would save considerable effort if there is a desire to work with
features associated with particular polygons. The macro would determine the parcel or right-of-
way segment in which the feature was contained. The key information from this Pcluster would
then be used to determine the facets for the feature object name.
Contours and Spot Elevations
1. Create menus and macros for setting names and styles for contours and spot elevations.
2. Digitize the contours available for the land use study project area, using the macros previ-
ously defined.
Land Use and Types
1. Create menus and macros for the land use applications. These macros should set the object
names and styles for the boundary segments.
2. Input the boundary segments from whatever sources are available. The base map and
planimetric feature drawings may be useful background drawings for this step.
3. Create Pcluster polygons for the various land use areas. The "simple parcel input" XBASIC
or VMS/DCl program should be helpful with this task.
Political and Administrative Boundaries
1. Create menus and macros for setting object names and styles.
2. Input the boundary segments that separate the various districts in the area.

3. Input the building outlines or a suitable symbol for any facilities connected with the district.
4. Create Pcluster polygons for the districts that are being included.
Data Sources
1. Move in plat and Assessor's page boundaries from the base map.
2. Move in, or create source boundaries from the other drawings which were used.
3. Create Pcluster polygons for the source boundaries. The "simple parcel input" program will
be helpful with this task.

Public Services and Engineering to discuss the Norton Air Force
Base Land Use Plan Project. Also met afterwards with Janis to
discuss a possible position for an intern in the GIS and Norton
Projects. Went to Cal Poly Pomona and talked to several students
about the GIS and Norton Land Use Projects to see if any of them
might be interested in the position of GIS/Norton Projects assistant.

on the Norton Air Force Base. Steve did not provide the maps we
discussed so tried to find them on my own. Talked to John Montgomery
of Planning about the maps and he said he didn't have them, went to
CAL TRANS and talked to Keith Jones and Ken Andrews to see if they
might have the plans to Norton Air Force Base, they didn't.
