Synopsis of Previous Council Action:
The Mayor and Common Council approved FY 2005-06 CIP Budget.
The Mayor and Common Council authorized the Director of Finance to amend the FY 05/06 Budget
by transferring $157,100.00 from Account No. 129-367-5504-7245 [State Street Construction - Phase
IB & 3 (SS04-09)] to Account No. 129-367-5504-7231, for Street Widening Improvements on Palm
Avenue at BNSF Railroad Grade Crossing north of Cajon Boulevard (S04-04), per Plan No. 11354;
and adopted the Resolution for the Contract with Olivas Valdez, Inc.

Authorization for the Director of Development Services to execute Contract Change Order No. One to the
Contract with Olivas Valdez, Inc., for Street Widening Improvements on Palm Avenue at BNSF Railroad Grade
Crossing North of Cajon Boulevard (SS 04-04) per Plan No. 11354.
Backeround:
In 2002, the City entered into Agreement No. 53-R946 with BNSF and the State Department of Transportation
(Caltrans) to widen Palm Avenue in the vicinity of the BNFS tracks to compliment the relocation of the crossing
gates and the installation of a third Transcontinental track. The original agreement called for the project to be
completed by December 31, 2003 or funding for the project would be revoked. The deadline was extended once
by Caltrans to December 31, 2004. The deadline was further extended to December 31, 2005, only due to the
City Engineer's commitment to have the project complete by December 31, 2005. The work was substantial1y
completed in January 2006, and Caltrans recently agreed to an additional extension of time necessary to
complete the work and bill the project.
Funding for this project was allocated as part of the FY 2005/06 Capital Improvement Program (CIP) for Street
Widening Improvements on Palm Avenue at BNSF Railroad Grade Crossing North of Cajon Boulevard (SS 04-
04) per Plan No. 11354.
A contract for the work was awarded to Olivas Valdez, Inc. in the amount of $248,265.00 for Street Widening
Improvements on Palm Avenue at BNSF Railroad Grade Crossing north of Cajon Boulevard (SS 04-04) per
Plan No. I135i
Contract Change Order No. One, in the amount ofS20,668.00, consists of the fol1owing changes:

Installation of K-rails in order to conform to the requirement of BNSF traffic control to create a
positive barrier between the work and traffic while construction of road and crossing gates was
proceeding. During construction BNSF required K-rails to be placed across Palm Avenue to
create a positive barrier for vehicle traffic. This was a safety provision during the construction
phase when the railroad crossing gates were removed.
Placement of additional crushed aggregate base which was not specified in the original contract.
This additional crushed aggregate base was necessary to create a safe transition from the
existing pavement to the widened lanes.
