The Mayor and Common Council of the City of San Bernardino authorize the Mayor to execute a third amendment to the agreement between the City of San 12 Bernardino Police Department and the County of San Bernardino Probation Department to 13 administer the grant funded juvenile accountability program known as Intervention and 14 Management of Probationer Accountability and Compliance of Terms (IMPACT). 15 16 SECTION 2. HARPER, Chief Probation Officer Probation Department SUBJECT: MEMORANDA OF UNDERSTANDING WITH THE CITY OF SAN BERNARDINO RECOMMENDATION: Approve Amendment No.2 to Agreement 01-366 between San Bernardino County and the City of San Bernardino (City) for the Intervention and Management of Probationer Accountability and Compliance of Terms (IMPACT) program, in the amount of $111,000, for the period July 1, 2004 to June 30, 2005. BACKGROUND INFORMATION: On April 27, 2004 the Board of Supervisors approved the submission of a fourth-year IMPACT program plan/application to the Department of Justice (DOJ), in the amount of $247,369. The program reduces juvenile violence and crime in the City through intervention by probation officer/police officer teams. The collaborative program was designed to target youthful offenders to reduce gang involvement, remove firearms, provide intensive supervision of high-risk offenders, and provide alternatives to delinquent conduct by directing at-risk youth into positive activities. The Department received electronic notification of the 2004-05 grant award on September 3, 2004, and staff developed an amended MOU to update the mutual responsibilities between the County and City. On October 26, 2004 the Board accepted the grant award from the DOJ. The Department indicated at that time it would return to the Board for approval of the signed MOU upon receipt from the City, which occurred on November 15,2004. The current MOU with the City serves as the operating agreement that governs both the collaboration between agencies and the provision of funding for one team's police officer portion of program services, with the provision that additional teams may be created if additional funding becomes available. Approvai of this Recommendation would authorize the distribution of grant funds to the City in the amount of $111,000 for the period July 1,2004 to June 30, 2005. REVIEW AND APPROVAL BY OTHERS: This item has been reviewed and approved as to legal form by County Counsel (Dawn Stafford, 387-5471, Deputy County Counsel) on November 22, 2004; and the County Administrative Office (Laurie Rozko, 387-8997, Administrative Analyst) on November 23,2004. FINANCIAL IMPACT: There is no local cost impact associated with this item. Staffing costs associated with this program are fully funded by the grant award. BACKGROUND INFORMATION: On September 26, 2000, the Board of Supervisors accepted a grant award from the U.S. Department of Justice (DOJ), to develop a probation program modeled after the highly successful "Boston Night Light" crime reduction program. The Department's program, Intervention and Management of Probationer Accountability and Compliance of Terms (IMPACT), was developed to reduce juvenile violence and crime in the City of San Bernardino (City) through intervention by probation officer/police officer teams. The collaborative program with the San Bernardino Police Department was designed to reduce gang involvement, remove firearms from youthful offenders, provide intensive sLJpervision of high-risk youth, and provide alternatives to delinquent conduct by redirecting at-risk youth into positive activities. A Memorandum of Understanding was developed with the City for the transfer of grant funds to cover the cost of pOlice positions. On June 14, 2005, the Board approved an application for a fifth-year earmark in the amount of $394,657 for 2005-06. The increase of $147,288 over the prior fiscal year would expand the current program to include one new probation officer position for a prevention program in four (4) elementary schools with -~11igh-risk minors in lower-Income areas of the City. I hese Gity schools would act as the pilot sights for the first year of the program, to be known as IMPACT/Day Light. On September 6, 2005, the Department was notified electronically that the award had been approved. The MOU for one police officer position, in the amount of $145,688, was subsequently submitted to the City for approval. On October 5th, the Office of Justice Programs notified the Probation Department that the necessary paperwork had to be submitted no later than October 15th to accept the award. In order to meet the grant acceptance deadline, the Chairman authorized the Chief Probation Officer to sign and submit the grant acceptance paperwork by October 15, 2005. The City approved MOU was received by the Department on November 21, 2005, and is being submitted to the Board on the first available date following completion of the review process. Grantee agrees to comply with all confidentiality requirements of 42 U.S.C. section 3789g and 28 C.P.R. Part 22 that are applicable to collection, use, and revelation of data or information. Grantee further agrees, as a condition of grant approval, to submit a Privacy Certificate that is in accord with requirements of28 C.F.R. Part 22 and, in particular, section 22.23. 12. The recipieot agrees to submit quarterly financial repotts on StandsnI Form SF 269A. These repotts will be submitted within 45 days after the end of the calendar quarter, and a final report is due 120 days following the end of the awan! period. The reports sba11 be submitted to the Office of 1ustice Programs, Grants Management System. 13. The recipient sba1I submit semiannual progress repotts. Progress repotts sba1I be submitted within 30 days after the end of the reporting periods, which are June 30 and December 31, for the life of the award. These repotts will be submitted online through the Office for 1ustice Programs Grants Management System. 14. The CUlTcttt edition of the OIP Financial Guide provides guidance on allowable printing activities. In addition, the recipient must submit all repotts and written products resulting from thia awan! to 01IDP for review and comment prior to publishing. The recipient must submit to OJIDP for approval any repotts or written products that the grantee will publish using grant funds. Any publication, report or other written products produced with grant funds must promineotly display the OJIDP logo on the cover page (or other location as agreed to by the program office) and sball contain the following statement: "This projcet was supported by Grant # ( ) awarded by the Office of 1uvenile 1ustice and Delinquency Prevention, Office of 1ustice Programs, U.S. Department of 1ustice".
