Staff Report
SUBJECT:
Resolution authorizing the execution of a Quitclaim Deed for abandoned waterlines located in
the University Park area, generally southwesterly of North park Boulevard and southeasterly of
Campus Parkway.
BACKGROUND:
The City of San Bernardino reserved easements for Municipal Water purposes on Parcel Map
No. 16307 relative to the development southwesterly Northpark Boulevard and southeasterly of
Campus Parkway. known as the University Park project. The easements were for existing
waterlines across this area, which was previously owned by the City of San Bernardino Water
Department.
The property was purchased from the City by J.R. Watson & Associates, Inc. and subsequently
sold to Richmond American Homes, to develop a 160 unit housing project (Tract No. 16509).
Relative to the development of this area, the waterlines in the previously reserved easements
have been relocated into newly dedicated streets at the expense of the builder. Since the old
waterlines are no longer needed. the builder has requested that the City quitclaim the old
easements. Consideration for the quitclaim is the builder's cost of installing new waterlines.
On November 7, 2005, the Board of Water Commissioners approved the release of these
easements to Richmond American Homes (See attached copy). The attached resolution
authorizes the execution of a Quitclaim Deed. Richmond American Homes will pay the
necessary recording fees.
FINANCIAL IMP ACT:
None. Recording fees will be paid by grantee. Consideration for quitclaim is the grantee's cost of
installing new waterlines.

At a regular meeting of the Board of Water Commissioners held on Tuesday, November 22, 2005,
the Board unanimously voted to approve a request from Richmond American Homes to release the
Water Department's interest in an easement held by the City of San Bernardino, and request that the
City of San Bernardino quitclaim back to Richmond American Homes the recorded easement
(Document No. 2003-0786277) for the proposed 160-units housing project (Tract 16509).
Les, I have attached the subject staff report, and the property description and maps that were
included with the staff report to the Board. Please prepare the appropriate documents for submittal
to the Mayor and Common Council for approval. Should you have questions, please contact Mike

BACKGROUND:
The City of San Bernardino reserved easements for Municipal
Water purposes as indicated on Parcel Map 16307. The City of
San Bernardino Mayor accepted these easements on September 23,
2003, and the Parcel Nap was recorded by the County on October
17, 2003 under Document No. 2003-0786277. The easements were
reserved for existing San Bernardino Municipal Water Department
water mains.
Richmond American Homes has purchased the property surrounding
the above-mentioned easements to develop a new 160-units housing
project (Tract 16509). The existing water mains have been
relocated into newly dedicated streets at the expense of
Richmond American Homes. Richmond American Homes has requested
the unused easements be qui t claimed back to them for further
build out. The Engineering staff and the City I S Real Property
section have reviewed these documents and found them to be
acceptable for recordation.
RECOMMENDATION:
It is recommended that the Board of Water Commissioners consider
the following motion for approval:
approve the request of Richmond American Homes to
release the San Bernardino Municipal Water Department
interest in the easement held by the City of San
Bernardino and request that the City of San Bernardino
quit claim back the recorded easement (Document No.
2003-0786277) to Richmond American Homes for the
proposed 160-units housing project (Tract 16509) .

SECTION 1. That the Mayor of the City of San Bernardino is hereby authorized and
