CDC/2003-35 2 3 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO APPROVING AND AUTHORIZING THE EXECUTIVE DIRECTOR OF THE AGENCY TO EXECUTE AMENDMENT NO.1 TO THE HOME GRANT AGREEMENT BY AND BETWEEN THE REDEVELOPMENT AGENCY AND TELACU I HOUSING-SAN BERNARDINO, INC., A CALIFORNIA NONPROFIT CORPORATION (6TH AND F STREET TELACU SENIOR HOUSING PROJECT - CENTRAL CITY NORTH REDEVELOPMENT PROJECT AREA) 4 5 6 7 8 WHEREAS, in an effort to carry out the Redevelopment Agency's affordable housing obligations and duties under Section 33000 of the Health and Safety Code of the State of California (the "Act"), the City of San Bernardino (the "City") has designated the Agency as the administrator of the federal HOME Grant Program (the "Program") and said Program is intended to preserve and increase the supply of affordable housing for low- and moderate- 9 10 11 12 13 income households in the City; and WHEREAS, in an effort to facilitate the Agency's responsibilities under the Act, The East Los Angeles Community Union ("TELACU"), a California nonprofit corporation founded in the late 1960s to promote community, economic development and affordable housing activities, TELACU and the Agency entered into an agreement dated January 7, 2002 (the "HOME Grant Agreement") for the development of seventy-five senior housing units (the "Project") located at 602-666 West 6th Street (the "Site"), San Bernardino, in the Central City North Redevelopment Project Area (the "Project Area"); and WHEREAS, the HOME Grant Agreement is proposed to be amended (Amendment No. I) to increase the present HOME Grant amount of $300,000 by $75,000 (for a total HOME 14 15 16 17 18 19 20 21 22 Grant amount of $375,000) for sidewalk replacement and the installation of decorative parkway landscaping and related improvements ("Off-Site Improvements"). 23 24 III III 25 -1- P:\Agendas\Rcsolutions\Rcsolutions\2003\03-11-03 TELACU Amd 1 CDC Rcso.doc CDc/2003-35 2 3 4 5 6 7 8 9 10 11 12 13 14 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS FOLLOWS: Section 1. The Commission hereby approves Amendment No.1 to the Agreement attached hereto and incorporated herein by reference. Section 2. The Executive Director is hereby authorized to appropriate the sum of $75,000 from the federal HOME Grant Program, fiscal year 2003-2004, for the Off-Site Improvements and to execute the Amendment No. 1 to the HOME Grant Agreement on behalf of the Agency in the form attached hereto, together with such nonsubstantive changes therein as may be approved by the Executive Director and the Agency Counsel. Section 3. A Program Environmental Impact Report was certified in connection with the adoption of the redevelopment plan for the Project Area and a finding that the Project is exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15332, in fill development, was determined by the City's Planning Commission, and no further environment review is required pursuant to Section 15168 of the CEQA guidelines. AMENDMENT NO.1 TO THE HOME GRANT AGREEMENT DATED JANUARY 7, 2002 BY AND BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO AND TELACU HOUSING-SAN BERNARDINO, INC. THIS AMENDMENT NO.1 to the HOME Grant Agreement dated January 7, 2002 ("Agreement") referred to as "Amendment," is made and entered into this 3rd day of November, 2003 by and between the Redevelopment Agency of the City of San Bernardino, a public body, corporate and politic, referred to as "Agency," and TELACU Housing-San Bernardino, Inc., a California nonprofit corporation, referred to as "Developer." Agency and Developer agree as follows: RECITALS WHEREAS, Agency and Developer have previously entered into the Agreement dated January 7, 2002 referred to as "Agreement," for the purpose of developing a 75-unit Senior Affordable Rental Housing Complex located at 602-666 West 6th Street (the "Project"); and WHEREAS, Agency and Developer desire to amend the Agreement to increase the Project financing and Agency Grant to accommodate unanticipated off-site improvement costs (such as: sidewalk, curb, gutter replacement or other related off-site improvements) ("Off-Site Improvements") and said Off-Site Improvements are necessary and desirable for the completion of the Project as provided herein. NOW, THEREFORE, in consideration of the mutual covenants herein set forth and the mutual benefits to be derived therefrom, the parties agree to modify the Agreement in the following two areas only: 1. [ ss406] Amount of Agency Grant The Agency Grant shall not exceed the lesser of the difference between the Improvement costs and the HUD Section 202 Capital Advance, or not more than $375,000. Subject to the prior written approval of HUD, any unexpended Agency Grant funds shall be returned to the Agency within 60 days following the completion of the Project and the issuance of the Certificate of Occupancy. All other terms of the HOME Grant Agreement shall remain in full force and effect.
