RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION
APPROVING AMENDMENT NO.2 TO THE AGREEMENT BETWEEN
THE REDEVELOPMENT AGENCY (AGENCY) AND NEIGHBORHOOD
HOUSING SERVICES OF THE INLAND EMPIRE, INC. (NHS),
REGARDING THE DONATION OF PROPERTIES LOCATED AT 1556
MOUNTAIN VIEW AND 1662 SIERRA WAY (NIP TARGET AREA 1),
AND (2) THE APPROPRIATION OF NEIGHBORHOOD INITIATIVE
PROGRAM (NIP) FUNDS IN THE AMOUNT OF $250,000 FOR

DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:

SECTION 1. The Executive Director of the Redevelopment Agency ("Director") is
12 hereby authorized and directed to execute on behalf of said Agency Amendment No.2 to the
13 September 7, 1999 Agreement between the Agency and Neighborhood Housing Services of the
14 Inland Empire, Inc., (NHS) wherein the Agency will donate the properties located at 1556
15
Mountain View and 1662 Sierra Way (the "Properties") to NHS for rehabilitation under the
16
Y outhBuild Program and upon completion sell the Properties to a income qualified homebuyer
17
(the "Project"), and as more fully described in the original Agreement, a copy of which is on
18
file with the City Clerk, and incorporated herein by reference as though fully set forth at
19
length.

SECTION 2. The Director is hereby authorized to disburse $250,000 of Neighborhood
22
Initiative Program (NIP) funds to NHS to pay for stipends and operation costs of the
23
Y outhBuild Program, conditioned upon County of San Bernardino approval.

SECTION 3. The Director is hereby authorized to make minor corrections, additions,
25
and clarifications to the Amendment No. 2 and Agreement, provided said changes are not

substantive in nature and do not increase the monetary impact to the Agency pursuant to the
Amendment No.2 and Agreement.
SECTION 4. The authorization to execute the above referenced Agreement is
rescinded if the parties to the Agreement fail to execute it within sixty (60) days of the passage

AMENDMENT NO.2 TO THE HOME PROGRAM
ACQUISITION, CONSTRUCTION AND RESALE AGREEMENT
DATED SEPTEMBER 7,1999, AS AMENDED
(Neighborhood Housing Services of the Inland Empire, Inc.)

THIS AMENDMENT NO. 2 (the "Amendment No.2") to the Agreement entitled

"HOME Program Acquisition, Construction and Resale Agreement", dated September 7, 1999,
7
as amended by Amendment No.1, dated as of July 24, 2000 (collectively the "Agreement") is
made and entered into as of this .2tlday of October 2000, by and between the Redevelopment
8

Agency of the City of San Bernardino, a public body corporate and politic (the "Agency"), and
10
Neighborhood Housing Services of the Inland Empire, Inc., a California non-profit
11
corporation, (the "Participant") in view of the facts set forth in the following Recitals:
12
RECITALS
13
WHEREAS, the Agency and Participant have previously entered into the Agreement
14
for the purpose of allowing the Agency to convey the land located at 571 Magnolia Street to
15
the Participant for development of a single-family house (the "New Home") and property to
16
convey the property located at 1149 Rialto Avenue, San Bernardino (the "Amendment No.1
17
Home Lot") to the Participant under the Participant's "YouthBuild Program" and then reselling
18
the completed New Home and the Amendment No. 1 Home Lot to a "Qualified Homebuyer"
19
as these are defined in the Agreement; and
20
WHEREAS, the Agency contemplates receiving an assignment and transfer of
21
properties located at 1556 Mountain View, San Bernardino, and 1662 Sierra Way, San
22
Bernardino (the "Amendment No. 2 Properties") from the County of San Bernardino
23
("County") under a program between the County and the Federal Housing Administration
24
("FHA") known as the Neighborhood Initiative Program (NIP). The County has agreed to
25
assign and transfer the Amendment No.2 Properties to the Agency for use consistent with NIP.
The Participant desires to acquire the Amendment No.2 Properties from the Agency, subject to

the terms and conditions as set forth in this Amendment No.2, to use for its YouthBuild
2 Program; and
3 WHEREAS, the Agency and Participant desire to further amend the Agreement to
4 enable the Agency to transfer title to the Amendment No.2 Properties to the Participant and
5 allow the Participant to commence rehabilitation of the Amendment No.2 Properties pursuant
6 to this Amendment No.2 and reserve the completed Amendment No.2 Properties for resale to
7 Qualified Homebuyers, subject to the approval of the County; and
8 WHEREAS, under the September 7, 1999 Cooperative Agreement between the County
9 and the Agency ("County NIP Agreement") for the use of NIP Grant Funds, it was
10 contemplated that a portion of the $2 million ("First Year Funding") under the County NIP
11 Agreement would be used by the Agency to expand the Y outhBuild Program to enable the
12 students who shall be under the supervision and training of the Participant to work in NIP
13 Target areas as set forth in the County NIP Agreement, predominately, in NIP #1. Subject to
14 the County transfer of the Amendment No.2 Properties to the Agency, the Agency will also
15 appropriate $250,000, of NIP Funds as transferred to the Agency by the County, to pay for
16 operations and stipends of the YouthBuild Program (Program Year 2000-2001) pursuant to this
17 Amendment No.2. Said Y outhBuild Program and itemized budget for the use and application
18 by Participant of the NIP Funds as may hereafter be disbursed by the Agency to the Participant
19 is more specifically described in Exhibit "H" attached hereto and incorporated herein by this
20 reference.
21 WHEREAS, the Community Development Commission, acting as the governing board
22 of the Agency, has previously determined that the implementation of the Y outhBuild Program
23 by the Participant will benefit the low- and moderate-income housing needs of the City, the
24 various redevelopment project areas of the City, and assist the Agency in fulfilling its goals
25 and objectives to provide affordable housing pursuant to the Community Redevelopment Law.

This Amendment No.2 will further assist the City and Agency in accomplishing their mutual
2 goals.
3 NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
4 HEREIN SET FORTH AND THE MUTUAL BENEFITS TO BE DERIVED THERE FROM,
5 THE PARTICIPANT AND AGENCY HERETO AGREE AS FOLLOWS:
6 SECTION I. The meaning of words and phrases as used in the Amendment No. 2
7 shall be the same as set forth in the Agreement, except as the context of usage of a particular
8 term or phrase as set forth in the Recitals of this Amendment No.2. The text of the Agreement
9 (and all exhibits accompanying the Agreement) is hereby incorporated into this Amendment
10 No.2 by this reference.
11 SECTION 2. The Participant and the Agency mutually acknowledge and agree that as
12 of the date of approval of this Amendment No.2 by the governing board of the Agency, no
13 default exists under the Agreement, nor is either party aware of any fact, with the giving of
14 notice and the passage of time, would constitute a default under the Agreement.
15 SECTION 3. The Agreement is hereby amended to add a new Section 28 thereto
16 which reads as follows:
17 "Section 28 Amendment No.2 to the Agreement
18 a) Subject to the approval of Amendment No.2 to this Agreement by the
19 governing board of the Agency and the transfer or assignment of the
20 Amendment No. 2 Property by the County to the Agency under the
21 County NIP Agreement, the Agency hereby agrees to convey the
22 Amendment No.2 Properties to the Participant and the Participant hereby
23 agrees to purchase the Amendment No.2 Properties from the Agency for
24 closing costs and other good and valuable consideration as set forth in this
25

Section 28 of the Agreement, as amended. A legal description of the
2 Amendment No.2 Properties is attached hereto as Exhibit "G".
3 b) The Agency and the Participant shall accomplish the transfer of the fee
4 title interest of the Amendment No.2 Properties from the Agency to the
5 Participant (subject to corresponding action by the County authorizing the
6 transfer or assignment of the Amendment No. 2 preparation to the
7 Agency) pursuant to the terms and conditions of the "Agency Participant
8 Purchase and Sale Agreement" and escrow instructions as prepared by
9 Arrowhead Escrow as approved by Agency and Participant substantially
10 in the form as Exhibit "E" to the Agreement. The Agency and the
11 Participant shall have each caused the Agency Participant Purchase and
12 Sale Agreement and other documents to be fully executed and delivered to
13 the escrow holder, as identified in the Agency Participant Purchase and
14 Sale Agreement, by a date not later than December 30,2000."
15 SECTION 4. The Agreement is hereby amended to add a new Section 29 thereto
16 which reads as follows:
17 "Section 29. Improvement of the Homes on the Amendment No.2 Properties
18 a) Provided that the escrow for the transferring of the Amendment No.2
19 Properties as described in Section 28 has closed, the Participant shall
20 commence the construction and improvement of the existing Homes on
21 the Amendment No.2 Properties within sixty (60) days following the date
22 of recordation of the Agency Grant Deed as provided in the Agency
23 Participant Purchase and Sale Agreement. The descriptions of the Homes
24 to be rehabilitated and reconstructed by the Participant on the Amendment

b)
No. 2 Properties are attached hereto as Exhibit "H" and incorporated
herein by this reference.
All of the following provisions of the Agreement shall also apply to the
construction, improvement and resale of the completed Home on the
Amendment No.2 Properties by the Participant:
Section 4 through Section 24, inclusive.
In each such Section of the Agreement as referenced in the preceding
sentence, where the words "HOME Lot" and "New Home" may be used in
9 any such Section, such words, for the purposes of Amendment No.2 the
10 Agreement, shall refer to the Amendment No.2 Properties and the Homes
11 described in Exhibit "H" to be reconstructed and improved on the
12 Amendment No.2 Properties by the Participant and offered for resale by
13 the Participant to a Qualified Homebuyer.
14 c) Notwithstanding the provisions of Section 4(b) of the Agreement to the
15 contrary, the Participant shall complete the construction and improvement
16 of the Homes on the Amendment No.2 Properties by a date not later than
17 June 31,2001."
18 SECTION 5. The Agreement is hereby amended to add a new Section 30 thereto
19 which reads as follows:
20 "Section 30. Disbursement of the NIP Funds for Y outhBuild Operations
21 a) Subject to approval by the County in its discretion of certain conforming
22 changes to the County NIP Agreement by a date not later than December
23 30, 2000, and receipt thereafter of funds by the Agency from the County
24 for use and application as provided in this Section 30, the Agency hereby
25 allocates the sum of Two Hundred Fifty Thousand Dollars ($250,000) of

such Neighborhood Initiative Program Funds as transferred by the County
2 to the Agency ("NIP Funds") to be used for Y outhBuild stipends and
3 operations in connection with the construction, improvement and resale of
4 the Amendment No.2 Properties set forth in Section 29 of this Agreement
5 and any other NIP Target Area #1 ("Target Area") projects are more
6 specifically shown in Exhibit "0". No other source of Agency funds is
7 available or allocated for such purpose except from NIP Funds transferred
8 to the Agency by the County under the County NIP Agreement. The
9 itemized NHS Y outhBuild budget and a description of the Y outhBuild
10 Program are depicted in Exhibit I attached hereto and incorporated by this
11 reference.
12 b) The Participant shall be responsible for all costs, I.e., development,
13 building, public facilities capital charges, school district fees, and
14 marketing fees as identified in Exhibit "H" as it relates to Amendment No.
15 2 Properties.
16 c) The NIP Funds shall be disbursed in monthly installments by the Agency
17 to Participant provided that the Participant submits adequate
18 documentation to support amount of each such monthly request.
19 d) Section 30 of this Agreement as amended by Amendment No.2 may be
20 terminated by the Agency upon thirty (30) days written notice to the
21 Participant if NIP Funds either are not approved by the County or are no
22 longer available to the Agency from the County.
23 SECTION 6. Section 19 of the Agreement is hereby amended to add a new
24 subsection 19(d) to read as follows:

Amendment No. 2 to this Agreement may be terminated for the

convenience of either party who is not then in default upon sixty (60) days

notice to the other party at any time prior to the date on which the Agency

Grant Deed for the Amendment No.2 Properties is recorded as provided
5
in the Agency Participant Purchase and Sale Agreement"
6 SECTION 7. The Agreement is hereby amended to add three (3) additional exhibits
7 thereto as follows:

General Information
This Project is a rehabilitation of a 1300 Sq. Ft. Single Family Residence, 2
Bedroom one bath The current garage needs to be removed and a new one
built The~e are two' shed in the back yard that must be removed along with the
concrete pads they are on. The kitchen and bath will be totally gutted and
remodeled. All electrical will be updated. HVAC will be updated to a forced air.
The current roof shingle will be removed and new applied according to specs
and code. The roof over the back entrance will be reframed with trusses or hip
construction to give an overhang over the entrance.
General Requirements
100 Cleaning Yard shall be raked and free of all debris and rubbish.
102 Debris Disposal: Dispose of all debris from worksite and yard in a code legal
landfill
Sitework
200 Seed Lawn by Hand: Seed all areas disturbed by construction with the
appropiate seed for location and amount of sunshine
Concrete
300 General Requirements: All concrete shall be air entrained, Portland cement,
2500 PSI. maximum 4" slump, unless otherwise specified. All concrete shall be
placed on original soil or compacted fill, against straight solid forms, when the
temperature is between 40-100 degrees F. All concrete shall be free of voids
and cavities and shall be protected from the weather while curing. All forms and
soils shall be inspected before pouring.
302 Sidewalk Form and pour 4" thick concrete with control joints every 4' at right
angles to edge of walk. Widths of concrete to match existing, float and broom

Carpentry
600 General Requirements: All Framing is to be done with #2 or better lumber.
Pressure treated lumber must be used for all bottom plates and anywhere that
lumber meets concrete or ground.
601 Rough Framing: All aspects of framing will be done to current code.
604 Trusses: Trusses will be engineered and installed according to specification
from the manufacture.
605 , Hardware: All hold down hardware and stress panels will be installed according
to the plans and the manufacture specs.
Finish Carpentry
651 Cabinet - Wood Base: Install base cabinets with doors of solid wood stiles and
plywood panels. Frame with solid wood stiles, 1/2" (minimum) plywood sides
and metal or plastic comer braCing. Drawers shall be made of wood or
composition material. Cutout counter top for sink. Check with plumbing specs
for sink dimensions.

801 Door - Prehung Metal Entrance: Install a prehung metal insulated, 6 panel
entrance door and jamb including interior and exterior trim, threshold and
entrance lock set.
802 Door-Garage entrance from Living Space: Install a prehung Metal door with a
minimum of a1 hour fire rating
803 Interior Door-Wooden: Install a pre-hung hollow core door
805 Garage Door-Metal: Install a metal panel door with an opener
807 Window - Aluminum Double Hung D.G.:Field measure, order and install a
aluminum white double hung low "En and double glazed window with screen.
Finishes

901 Drywall 1/2": Hang, Tape and 3 coat finish 1/2" drywall. Screw 8" a.c. Run
sheets with long dimension horizontal.
902 Painting - General Requirements: All paint lead free. All surfaces clean and
dry for application. Secure all loose materials, set nails, and fill holes, dents and
cracks. Paint when temp is from 40-100 degrees F. No show- through, runs,
sags or brush marks. Prime with latex primer. Finish coat to be latex semi-
gloss. Color to be selected at a later time.
905 Floor Covering. General Requirements: Unless otherwise specified, all
materials shall be new and match existing as to size, style, color and
method of installation. All interior carpeting shall be FHA approved. All

and underlayments shall be well secured, dry, clean, level, and free of cracks,
depressions, voids, bumps and squeaks before installation of finish floor
covering.
Carpet and Pad: Install FHA approved nylon carpet over 1/2" medium density
polyurethane pad with a minimum of seams. Stretch carpet to eliminate
puckers, scallops and ripples. Include tackless strips, metal edge strips, and
mending tape to cover entire floor including closets. On stairs, fasten carpet
and pad at top and bottom of each riser.
Underlay and Vinyl Sheet Goods: Install 1/4" underlayment grade plywood,
using 7d screw shank or rink shank nails 6" O.C. in all directions. Install .070"
thick, backed vinyl sheet goods with a minimum of seams, per manufacturer's
recommendations. Caulk edges of vinyl with clear silicone caulk to create a
positive seal. Install metal edge strips in openings, and shoe or vinyl base
around perimeter.
HVAC - General Requirements: Unless otherwise specified, all materials shall
be new. Equipment shall operate safely without leakage, noise or vibration. All
penetrations of building components shall be neat, sleeved and fire stopped and
shall not compromise structural integrity.
Furnace and duct: Install a 80%+ AFUE Gas Fired forced air furnace include
any sheet metal work necessary to the installation of the unit.
Plumbing
1100 Plumbing - General Requirements: Unless otherwise specified, all materials
shall be new. All items shall operate safely without leakage, noise, vibration or

General Information
This Project is a rehabilitation of a 1200 Sq. Ft. Single Family Residence, 2
Bedroom, one bath. The current garage needs to be removed and a new one
built. New garage will be stick built with Stucco exterior. The kitchen and bath
will be totally gutted and remodeled. All electrical will be updated. HVAC will be
updated to a forced air. The current roof will be removed and new one applied
according to specs and code. The spanish tile will be carefully removed and
reapplied after the roof is reframed. The multipul front entrances will be changed
to one and the exterior of the house will be have a final stucco coat applied.

temperature is between 40-100 degrees F. All concrete shall be free of voids
and cavities and shall be protected from the weather while curing. All forms and
soils shall be inspected before pouring.
302 Sidewalk: Form and pour 4" thick concrete with control joints every 4' at right
angles to edge of walk. Widths of concrete to match existing, float and broom
finish. Remove all forms, regrade and spot seed

600 General Requirements: All Framing is to be done with #2 or better lumber.
Pressure treated lumber must be used for all bottom plates and anywhere that

from the manufacture.
605 Hardware: All hold down hardware and stress panels will be installed according

sags or brush marks. Prime with latex primer. Finish coat to be latex semi-

underlayments shall be well secured, dry, clean, level, and free of cracks,
depressions, voids, bumps and squeaks before installation of finish floor

906 Carpet and Pad: Install FHA approved nylon carpet over 1/2" medium density
polyurethane pad with a minimum of seams. Stretch carpet to eliminate
puckers, scallops and ripples. Include tackless strips, metal edge strips, and

and pad at top and bottom of each riser.

Description

5 The Program consists of three components:
6 1. Pre-apprenticeship construction training, in which participants build or rehabilitate
affordable housing that is sold to low-income families.

2. Scholastic preparation tailored to enable participants to earn the Graduate
Equivalence Diploma (GED).

3. Leadership development focusing on "life" skills and community civic
responsibilities.

The three primary Program components are supported by full-time counseling services,
opportunities to participate in internships and job shadows, adult mentoring, and other types of
assistance that enable the target population of under-educated, under-employed youth to
transform their lives.
