3 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF SAN BERNARDINO ACCEPTING THE
4 PRELIMINARY PLAN FOR THE 40TH STREET REDEVELOPMENT
PROJECT.

WHEREAS, on August 16,1999, the Mayor and Common Council of the City of San
7
Bernardino adopted Resolution No. 1999-216, designating a Survey Area for redevelopment
8
study purposes; and
9
WHEREAS, a Preliminary Plan has been formulated, and on September 7, 1999, by
Resolution No.99-02, the Planning Commission selected the Project Area for the 40th Street
10

Redevelopment Project and approved a preliminary plan prepared for the redevelopment of the
12
project area; and
13
WHEREAS, the public health, safety, and welfare would be furthered by the
redevelopment of the proposed 40th Street Redevelopment Project;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AS FOLLOWS:

SECTION 1. The Preliminary Plan prepared for the 40th Street Redevelopment Project,

as submitted herewith and attached hereto as Exhibit "A, is hereby accepted and approved.

SECTION 2. Staff is authorized and directed to make such transmittals as may be
20
required pursuant to Section 33327 of the California Community Redevelopment Law, including
21
a request to establish the 1999-00 equalized assessment roll as the base year valuation roll for the
40th Street Redevelopment Project.

SECTION 3. Staff is authorized and directed to prepare a redevelopment plan for the
40th Street Redevelopment Project.

40TH STREET REDEVELOPMENT PROJECT
I. INTRODUCTION
This document is the Preliminary Plan ("Plan") for the 40th Street Redevelopment Project
("Project"). The Plan's purpose is to designate the boundaries of the proposed Project Area and
to provide a general description of the proposed 40th Street Redevelopment Project.
This Plan has been prepared in accordance with Section 33324 of the California Community
Redevelopment Law ("CRL") which states that the Plan should:
(a) Describe the boundaries of the project area;
(b) Contain a general statement of land uses and of the layout .of principal streets,
population densities, building intensities and standards proposed as the basis for
the redevelopment of the project area;
(c) Show how the purpose of the preliminary plan would be attained by
redevelopment;
(d) Show how the preliminary plan conforms to the community's general plan; and
(e) Describe, generally, the impact of the Project upon residents of the project area
and surrounding neighborhoods.
II. PROJECT AREA LOCATION AND DESCRIPTION
Exhibit A presents the map depicting the boundaries of the area proposed for inclusion in the
40th Street Redevelopment Project ("Project Area"). The proposed Project Area includes
approximately 73.28 acres (excluding public rights of way) of commercial and residential uses
along major thoroughfares in the northern portion of the City. The Project Area is generally
bounded by 44th Street to the north, Waterman Avenue to the east, Electric and Mountain View
Avenues to the west, and Ralston Avenue and Sonora Drive to the south. An additional section
is generally bounded by Waterman Avenue to the east, Leroy Street and Sierra Way to the west
and parcels fronting 49th Street on the north and south.
The Project Area is predominantly urbanized pursuant to Section 33320.1 of the CRL. Existing
development includes commercial, office and residential uses. Physical and economic blighting
conditions that are proposed to be addressed through redevelopment include structural
deterioration, substandard design, lack of parking, incompatible adjacent uses,

depreciated/stagnant property values, impaired investments, and inadequate public
improvements.
III. GENERAL STATEMENT OF PROPOSED PLANNING ELEMENTS
As a basis for the redevelopment of the proposed Project Area, it is proposed that uses be
permitted in conformance with the General Plan of the City, as it exists and as amended from
time to time, and all other applicable state and local codes and guidelines.
A. Land Uses
Within the proposed Project Area, land uses shall be those permitted by the City of San
Bernardino General Plan ("General Plan"). Among the permitted uses are:
. Commercial
. Office
. Residential Single Family
. Residential Multiple Family
. Residential Multiple Family High Density
. Residential High Density
B. General Statement of Proposed Layout of Principal Streets
The principal streets within the Project Area are shown on Exhibit A. In general, these
include:
East- West Streets:. 40th Street, 41 st Street, 42nd Street, 44th Street, 49th Street,
Ralston Avenue, and Sonora Drive.
North-South Streets:. Electric Avenue, Genevieve Street, Leroy Street, Lugo
Avenue, Mountain View Avenue, Sierra Way, Sepulveda Avenue, and Waterman
A venue.
The layout of principal streets and those that may be developed in the future shall
conform to the Circulation Element of the City of San Bernardino General Plan, as
currently adopted or hereafter amended.
Existing streets within the Project Area may be widened or otherwise modified and
additional streets may be created as necessary for proper pedestrian and/or vehicular
circulation.

C. General Statement of Proposed Population Densities
Permitted densities within the Project Area shall conform to the City of San Bernardino
General Plan and Zoning Ordinance, as currently adopted or as hereafter amended, and
other applicable codes and ordinances. This Plan and the Project do not propose any
changes to population densities, development densities, or land use designations.
D. General Statement of Proposed Building Intensities
Building intensity shall be controlled by limits on: (1) the percentage of the building site
covered by the building (land coverage), (2) the ratio of the total floor area for all stories
of the building to the area of the building site (floor area ratio), (3) the size and location
of the buildable area on the building site; and (4) the height of the building. The limits
on building intensity shall be established in accordance with the provisions of the General
Plan and the Zoning Ordinance of the City of San Bernardino, as they now exist or are
hereafter amended. This Plan and the Project do not propose any changes to population
densities, land use designations, or building intensities.
E. General Statement of Proposed Building Standards
Building standards shall conform to the building requirements of applicable codes and
ordinances.
IV. A TT AINMENT OF THE PURPOSES OF THE LAW
Selection of the Project Area boundaries was guided by the existence of blight, as defined by the
CRL. Redevelopment of the Project Area would attain the purposes of the CRL by alleviating
blighting conditions that the private sector, acting alone, cannot remedy. Among the blighting
conditions existing in the Project Area are the following:
. Structural deterioration and dilapidation;
. Defective design;
. Inadequate utilities;
. Substandard design;
. A lack of parking;
. Incompatible adjacent uses;
. Parcels of irregular form and shape and inadequate size which are under multiple
ownership;
. Depreciated/stagnating property values;
. Low lease rates;
. Residential overcrowding; and
. Impaired investments.

In addition, public infrastructure systems, such as streets, curbs, gutters, and sidewalks, are
substandard in some areas and existing capacity is insufficient.
The purposes of the CRL would be attained by the proposed redevelopment through, among
other things: (1) the elimination of blighting influences and the correction of environmental
deficiencies, including, among others, small and irregular lots, incompatible land uses, aged
building types, and inadequate public improvements; (2) the assemblage of land into parcels
suitable for modem integrated development with improved pedestrian and vehicular circulation;
(3) the replanning, redesign and development of undeveloped or underdeveloped areas which are
stagnant or improperly utilized; and (4) the participation of owners and tenants in the
revitalization of their properties. Redevelopment of the proposed Project Area would also attain
the purposes of the CRL by stimulating construction activity and increasing employment
opportunities.
V. CONFORMANCE TO THE GENERAL PLAN OF THE CITY
This Plan conforms to the City of San Bernardino General Plan. It proposes an identical pattern
ofland uses, and includes all roadways and public facilities as indicated by the General Plan.
VI. GENERAL IMPACT OF THE PROPOSED PROJECT UPON THE RESIDENTS
OF THE PROJECT AREA AND SURROUNDING NEIGHBORHOODS
The impact of the Plan upon existing residential uses within the proposed Project Area and
residences lying outside of the proposed Project Area will generally be in the areas of improved
living environment and economic activity. It is the desire of the San Bernardino Community
Development Commission ("Commission") to avoid or minimize the displacement of residents
as a result of redevelopment activities and focus on improving commercial properties. However,
if displacements were to occur, pursuant to the CRL, the Commission will be responsible for
relocating residents displaced by the Commission and for providing last resort housing if
necessary, as well as replacing any low and moderate income housing units removed from the
housing stock.
It is anticipated that the impact of the plan will be positive. It is the intent to address and rectify
only adverse conditions within the proposed Project Area. Further, any adverse environmental
impacts will be identified by the environmental review process with mitigation measures
identified to address specific impacts.
Plan implementation will be subject to future review and approval by the City Council,
Community Development Commission, Planning Commission, and other appropriate bodies as
directed by the Community Development Commission Board after input from affected property
owners, business owners, residents, and other interested parties.
