Buildings

Like much ofCalifomia. the City of San Bernardino is situated in a seismically active region.
However, the City is unique in that it is faced with several factors that seismologists believe
currently places the City at greater risk than most other areas of the State. Of primary concern is
the fact that the City is intersected by two (2) major faults; the San Andreas and San Jacinto
Faults. Based on the geological record, both of these faults are overdue for a significant seismic
event. Additionally, the City is at greater risk due to the potential for liquefaction in areas of
high groundwater. Most of the area below Highland Avenue is subject to moderate to high
liquefaction potential.
The inherent danger associated with unreinforced masonry (URM) buildings became apparent as
a result of widespread failures during the 1933 Long Beach Earthquake. The Uniform Building
Code was subsequently amended to prohibit the use of unrein forced masonry in seismically
active areas. Existing URM buildings continued to experience catastrophic failures resulting in
deaths or injuries in subsequent earthquakes.
Recognizing the potential risks to public safety posed by the approximately 25,000 URM
buildings in the State, Senate Bill 547 (Govt. Code 8875) was adopted by the State in 1986. SB
547 required cities to 1) inventory URM buildings by January 1, 1990, 2) develop
mitigation programs to reduce risks, and 3) report to the Seismic Safety Commission.
Mitigation Programs were required to include notification to building owners, and were allowed
to have optional features such as the adoption of a Hazardous Building Ordinance, requirements
for mandatory strengthening, measures to reduce occupancy levels, measures to demolish
buildings, rehabilitation assistance, and the adoption of structural standards for strengthening
URM buildings.
In 1993 the State added Govt. Code Section 8875.8 which required that building owners post
warning placards on URM buildings. More recently, the State adopted AB 2533, which became
effective on January 1,2005. Known as the "Jennifer Lynn Myrick Memorial Bill' in honor of a
young lady who died in a URM building in the San Simeon Earthquake of December, 2003, the
law strengthens the posting requirements of Govt. Code 8875.8. In addition to requiring larger
warning placards, it also authorizes local building departments to impose fines for
noncompliance. Another provision of this law allows any concerned citizen to take legal action
against an owner who fails to comply with the posting requirements.
The City has taken a number of steps over the years to address the problems associated with
URM buildings. In 1983 the Mayor and Common Council adopted MC-265 (SBMC 15.12)
which required strengthening ofURM buildings prior to reoccupancy if they were vacant more
than 6 months. Later, in a effort to comply with SB 547 the City completed an inventory of
URM buildings in January 1990 and adopted Resolutions 90-117,90-214, and Ord. No. 718
requiring building owners to strengthen their buildings by October, 1992. In 1993 the deadlines
for strengthening the buildings were extended an additional three (3) years by the adoption of
Ord. No. MC-873. In 1994-95 the Economic Development Agency funded a program that
provided preliminary engineering evaluations ofURM buildings. Approximately 100 buildings
participated in this voluntary program intended to identify building deficiencies and to quantify
the costs of repair. In 1996 SBMC 15.12 was again amended to require the posting of warning
placards and to provide an additional three (3) years to seismically strengthen the buildings. In
1999 SBMC 15.12 was repealed, with the exception of the requirement to post warning placards.
In late 2005 the Department resurveyed the URM buildings in the City in order to update the
URM Building List, gauge progress, and provide information for future reports. A copy of the
updated list is attached (Attachment A). The results are summarized below:

Proposed Ordinance:
The proposed Ordinance codifies within the San Bernardino Municipal Code the provisions of
AB 2533. It requires larger warning placards and provides for the imposition of fines. The fines
speci fied in the law are $250 for the first offense, subject to a 15-day grace period, and a $ 1000
fine for subsequent offenses, subject to a 30-day grace period.
In addition to codifying AB 2533 this Ordinance also includes provisions to address vacant URM
buildings. Of the 25 currently vacant URM buildings, the average vacancy period is 14 years.
The following table provides information regarding the duration of vacancy for these 25
buildings: .
The proposed Subsection 15.12.300A requires URM buildings that are vacant for one (I) year or
more to be strengthened prior to reoccupancy. The proposed Subsection 15.12.300B declares
URM buildings that are vacant three (3) years or longer to be public nuisances and requires them
to be either strengthened or demolished.
This proposed ordinance, except for the posting requirement, does not address occupied URM
buildings. The Mayor and Common Council may wish to considered additional options such as:

Financial Assistance for Strengthening
Annual Notification to Owners
Mandatory Strengthening Timelines
Targeting URM Buildings for Redevelopment Projects
Subsequent to the Legislative Review Committee meeting on January 24, 2006, and as a result of
discussions with the staff of the City Attorney's Office, City Administrator's Office. and the
Development Services Department. minor changes were made to the proposed Section 15.12.300
B. These changes included replacing the reference to SBMC Chapter 15.28 with a reference to
SBMC Chapter 8.30 relating to abatement procedures, and a change to the last sentence that
would permit the Building Official to allow alternate means of hazard mitigation, in lieu of
strengthening or demolition for buildings that are vacant more than three (3) years.
Financial Impact:
The financial impact to the City is expected to be negligible. The amount of revenue from fines
would be dependent on the level of compliance with the placarding requirements and is not
expected to be significant. Any revenues received would offset the cost of enforcement.
Recommendation:
That the said ordinance be laid over for adoption.

15.12 OFTHE SAN BERNARDINO MUNICIPAL CODE CONCERNING THE MITIGATION
3 OF EARTHQUAKE HAZARDS IN UNREINFORCED MASONRY BUILDINGS.

ORDAIN AS FOLLOWS:

6 SECTION 1: Section 15.12.200 of the San Bernardino Municipal Code is amended by adding
7 subsection D.
8 15.12.200 D. If the owner of a building is not in compliance with the posting requirements
9 of subsection A above on or after December 31, 2004, and the owner has received actual or
10 constructive notice from the Building Official that their building is of unreinforced masonry
11 construction and has not been retrofitted to the standards identified in Section 15.12.010, the
12 owner shall post and maintain in a conspicuous place at the entrance of the building, a sign not
13 less than 8"x 1 0" with the following statement, with the first two words printed in 50-point
14 bold type and the remaining words in at least 30-point type: "Earthquake Warning. This is an
15 unreinforced masonry building. You may not be safe inside or near unreinforced masonry
16 buildings during an earthquake." The posting shall be visible from the exterior entrance of the
17 building.
18 An owner who is subject to this section and who does not comply with the posting
19 requirements shall be subject to an administrative citation pursuant to San Bernardino
20 Municipal Code Chapter 9.92 and subject to an administrative fine of two hundred fifty dollars
21 ($250) no sooner than 15 days after notification by the Building Official that the owner is
22 subject to the administrative fine. Thereafter, if the owner does not comply with and maintain
23 compliance with the posting requirements, within 30 days of the first administrative fine, the
24 owner shall be subject to an additional administrative citation and an additional administrative
25 fine of one thousand dollars ($1000).

SECTION 2: Section 15.12.300 is added to the San Bernardino Municipal Code to read as

Vacant Unreinforced Masonry Buildings.

A.
Any unreinforced masonry building that has been continuously vacant or abandoned
for a period of one year or more shall be strengthened to comply with the standards
identified in Section 15.12.010 prior to reoccupancy. A vacancy, as determined by the

Building Official, has occurred when there is no lawful occupancy or business activity
within the structure for one year. The lack of business registration records, business

receipts, utility and other records for a given period may be used to determine if a
vacancy has occurred.

B.
Any unreinforced masonry building that has been continuously vacant or abandoned
for a period of three (3) years or more shall be considered a public nuisance and shall
be subject to abatement as a public nuisance in accordance with Chapter 8.30 of this
Code. Once deemed to be a public nuisance the building shall be strengthened in
accordance with the standards identified in Section 15.12.010, or demolished, or the

hazards associated with the building shall be otherwise mitigated to the satisfaction of

the Building Official.
