On February 7, 2006, the Legislative Review Committee directed staff to prepare the
necessary resolutions to increase the salary of Council members and to place said resolutions on the
agenda for the February 21, 2006 Council meeting.
Currently, Charter Section 24-A states as follows: "The Councilmen shall each receive an
annual salary of six hundred dollars ($600.00), payable monthly." This language has been in the
Charter, unchanged, since 1937.
In July 2002, the Council voted to place on the ballot two proposals to amend the Charter -
one to set the Mayor's annual salary to 50% of the salary ofa Superior Court Judge, County of
San Bernardino, State of California and one to set the annual salary of a Council member to twelve
and one-half percent (12-1/2%) of a San Bernardino County Superior Court Judge. The proposed
Charter amendment regarding the annual salary of a Council member was not approved by the
necessary number of votes in the November 5, 2002 election; however, the proposed Charter
amendment regarding the Mayor's annual salary was approved and went into effect on January I,
2003.
The rationale for basing the proposed salaries on the annual salary of a Superior Court Judge
was that it removes "local politics" from the process because a judge's salary is set by the State
Legislature.
While there is no exact "science" concerning relative time spent by elected officials on city
business, a four-to-one (4-1) ratio of Mayor' s salary to Council member's salary seemed appropriate
to the Council when the item was proposed in 2002. As of February 1,2006, the annual salary of
a Superior Court Judge for the County of San Bernardino is $149,160. Therefore, twelve and one-
half percent (12-1/2%) of$149,160would equate to an annual salary of$18,645, with twelve equal
monthly installments being $1,553.75 each. If approved by the voters, this salary adjustment would
become effective January 1,2007. Thereafter, on each January 1 of each successive year, the annual
salary of a Council member would be adjusted and implemented at 12-1/2% ofthe annual salary of
a Superior Court Judge for the County of San Bernardino then in effect on said January 1 date. The
annual salary would be payable in twelve (12) equal monthly installments.

6 SECTION I. Recitals.

In accordance with the Constitution of the State of California, the City of San
8 Bernardino, a municipal corporation, has adopted a Charter.

(b)
The Mayor and Common Council of the City of San Bernardino desire to submit to
10 the electors the Charter Amendment set forth below in bold type in this resolution.
11 SECTION 2. Submittal to Electors. The following proposed amendment set forth in bold
12 type to the Charter of the City of San Bernardino is submitted to the qualified electors of the City
13 of San Bernardino for their approval or rejection at the consolidated special municipal election to
14 be held on Tuesday, June 6, 2006.
15 PROPOSED CHARTER AMENDMENT NO.
16 It is proposed that Section 24-A of the Charter of the City of San Bernardino be amended in
17 its entirety (strike-out version of current wording is shown first) so that the entire Section (shown
18 in bold type) would now read as follows:
19 Section 24-A. Salary of Council. The Councilmen shall Gaeh lCGGi yG an allliual
20 salary of six hundled dollals ($600.00), pa)abk month!). Effective January 1,
21 2007, the annual salary of each Council member shall be set at twelve and one-
22 half percent (12 1/2%) ofthe salary for a Superior Court Judge, County of San
23 Bernardino, State of California, based on the salary authorized for said
24 Superior Court Judge position(s) as of February 1, 2006. Thereafter, said
25 annual salary shall be adjusted and implemented January 1 of each subsequent
26 year at the same twelve and one-half percent (121/2%) figure of the salary for
27 said Superior Court Judge then in effect on said January 1 date. The annual
28 salary shall be payable in twelve (12) equal monthly installments.

II concerning the annual salary of the council members of the City of San Bernardino.
12 SECTION 2. Special Municipal Election Called. A special municipal election is hereby
13 called and will be held in the City of San Bernardino on Tuesday, June 6, 2006, for the purpose of
14 submitting to the qualified electors of the City, for their approval or disapproval, the proposed
15 Charter Amendment as set forth in Exhibit "A" attached hereto.
16 SECTION 3. Request for Consolidation of Elections. Pursuant to Section 10400 of the
17 California Elections Code, the Mayor and Common Council of the City of San Bernardino request
18 that the Board of Supervisors of the County of San Bernardino consolidate the City's special
19 municipal election with the statewide general election to be held on Tuesday, June 6, 2006.
20 The polls for said election shall be open at 7:00 a.m. of the day of said election and shall
21 remain open continuously from said time until 8:00 p.m. of the same day when said polls shall be
22 closed, except as provided in Section 14401 of the California Elections Code.

6 the California Elections Code. This notice may be combined with a notice of any other municipal
7 election to be held on the same date.
8 SECTION 7. Conduct of Election. The special municipal election so called shall be held
9 in such precincts and at such polling places as shall be determined by the Registrar of Voters of the
10 County of San Bernardino. The Board of Supervisors of the County of San Bernardino is hereby
11 requested to issue instructions to the Registrar of Voters to take all steps necessary for the holding
12 of the consolidated election. The Mayor is hereby authorized to execute a contract for the services
13 necessary for conducting the special municipal election. The City of San Bernardino recognizes that
14 additional costs will be incurred by the County by reasons of this consolidation and agrees to
15 reimburse the County for any such costs.

17 directed to file a certified copy of this Resolution with the Board of Supervisors of the County of San
18 Bernardino and to file a copy of this Resolution with the Registrar of Voters.

Dear Ms, VerJtl:
At the Mayor and Common Council meeting of February 21, 2006, the City of San Bernardino adopted
three resolutions proposing a Charter Amendment for the June 6, 2006 Statewide General Election to be
conducted by the County of San Bernardino. Following are the three resolutions:
I) Resolution No. 2006-61: Resolution of the City of San Bernardino proposing an
amendment to the Charter of said City of San Bernardino relating to the salary of Council
Members.
2) Resolution No. 2006-62: Resolution of the Mayor and Common Council of the City of
San Bernardino calling a Special Municipal Election on a proposed Charter Amendment
relating to the salary of the Council Members and requesting that said City of San
Bernardino's Special Municipal Election be consolidated with the June 6, 2006 Statewide
General Election conducted by the County of San Bernardino.
3) Resolution No. 2006-63: Resolution of the City of San Bernardino submitting to the
qualified electors of said City for their approval a proposed Charter Amendment relating
to the salary of Council Members; transmission of the proposed Charter Amendment to
the Office of the City Attorney for purposes of preparation of an impartial analysis.
Enclosed are two (2) certified copies of each resolution for your files. Respectfully, I am requesting that
the appropriate action be taken to have the Registrar of Voters file Resolution Nos. 2006-61, 2006-62 and
2006-63, and to place the Charter Amendment on the ballot for the regularly scheduled Statewide General
Election to be held on Tuesday, June 6, 2006.
