Authorization to refund a portion of the $149,194.70 Traffic Systems Fee paid by Hillwood Development for
the Mattei Warehouse Distribution Center (DPII 03-15) approved on June 26, 2003.

Pursuant to City Municipal Code Section 3.26 (Ordinance No. MC-628 and Resolution 88-140), every project
must pay a Traffic Systems Fee prior to issuance of building permits. At the time that the Mattei project was
permitted, the Traffic Systems Fee was $18.148 per daily trip. Per Section 3.26, the fee amount is to be
established based upon the estimated number of daily trips, which are determined using the information presented
in the latest edition of Trip Generation, published by the Institute of Transportation Engineers.
The project approval included Conditions of Approval and Standard Requirements of the Development Services
Department, Public Works Division (Attachment 1). Condition No. 6(e) of the Public Works conditions indicates
that a Traffic Systems Fee of $149, 194.70 was to be paid prior to issuance of a building permit. The fee amount
was based upon an estimated 8,221 daily trips based upon Trip Generation. The developer paid $128,629.98 on
September 9, 2003, toward the Traffic Systems Fee for the project. Public Works Condition of Approval No.
6(e) further indicates that the City would obtain traffic volume counts within one and one-half years after the
issuance of the Certificate of Occupancy and, at that time, the City would reevaluate the traffic data and adjust
the Traffic Systems Fee amount accordingly.
Pursuant to that condition, 24-hour traffic volume counts were conducted at the Mattei facility driveways for
several days during October and November 2005, using machine counters that recorded results every 15 minutes
over several multi-day count periods. The count volume data obtained during the week of November 8, 2005
through November 15,2005 was determined to be the most reliable and representative data for the facility (see
Attachment 2). The volume count data indicates that the facility operates 7 days and 24 hours a day, but on
Sunday the operation is considerably reduced and this is reflected in the count volumes obtained for that day.
The Sunday volume counts were not considered in determining the average daily traffic volumes for the project.
The peak volume, counted on Friday, November 11, 2005, was the equivalent of 4,398 passenger cars, with
trucks converted to Passenger Car Equivalents (PCE's). The average traffic volume accessing the site during the
six primary operating days (Monday through Saturday) was 4,170 PCE's per day.
Based upon the traffic volume counts obtained for the facility, the actual average daily traffic volume is 4,170
trips per day, which relates to a fee amount of $75,677.16, resulting in a difference of $52,952.82.
Financial Impact:
The fees that need to be refunded were received in FY 2003-04. At the end of the fiscal year, revenues received
roll over into the fund balance to be appropriated. A budget amendment is required to appropriate the refund
amount of $52,952.82 from the Traffic System Construction Fund balance to Acct. No. 250-370-5181.
Recommendation:
1. Authorize the Director of Finance to amend the FY 2005-06 CIP budget and appropriate $53,000
(rounded) from the Traffic System Construction Fund balance to Acct. No. 250-370-5181 (other operating
expenses) .
2. Authorize the Director of Finance to issue a refund to Hillwood Development in the amount of

. NOTE TO APPLICANT: Where separate Engineering plans are required. the applicant is
responsible for submitting the Engineering plans directly to the Engineering Division. They
may be submitted prior to submittal of Building Plans.
1. Drainaae and Flood Control
a) A local drainage study will be required for the project. Any drainage
improvements, structures or storm drains needed to mitigate downstream
impacts or protect the development shall be designed and constructed at
the developer's expense, and right-of-way dedicated as necessary.
b) All drainage from the development shall be directed to an approved public
drainage facility. If not feasible, proper drainage facilities and easements
shall be provided to the satisfaction of the City Engineer.
c) If site drainage is to be outletted into the public street, the drainage shall
be conveyed through a parkway culvert constructed in accordance with
City Standard No. 400. Conveyance of site drainage over the Driveway
approaches will not be permitted.
d) The applicant shall mitigate on-site storm water discharge sufficiently to
maintain compliance with the City's NPDES Storm Water Discharge
Permit Requirements. A "Notice of Intent (NOI)" shall be filed with the
State Water Quality Control Board for construction disturbing 1 acre more
of land.
e) The applicant shall submit an Erosion Control Plan concurrent with
submittal of the grading plan. The plan shall be designed to control
erqsion due to water and wind, including blowing dust, during all phases of
construction, and graded areas which are not proposed to be immediately
developed.

2. Gradina and Landscapina
a) If more than l' of fill or 2' of cut is proposed, the site/plot/grading and
drainage plan shall be signed by a Registered Civil Engineer and a
grading permit will be required. The grading plan shall be prepared in strict
accordance with the City's "Grading Policies and Procedures" and the
City's "Standard Drawings", unless otherwise approved by the City
Engineer.
b) If more than 5 trees are to be removed from the site, a tree removal
permit conforming to the requirements of Section 19.28.090 of the
Development Code shall be obtained from the Department of
Development Services, Planning Division prior to issuance of any grading
or site development permits.
c) If more than 5,000 cubic yards of earthwork is proposed, a grading bond
will be required and the grading shall be supervised in accordance with
Section 7012(c) of the Uniform Building Code.
d) If more than 1,000 cubic yards of earth is to be hauled on City Streets
then a special hauling permit shall be obtained from the City Engineer.
Additional conditions, such as truck route approval, traffic controls,
bonding, covering of loads, street cleaning, etc. may be required by the
City Engineer.
e) A liquefaction evaluation is required for the site. This evaluation must be
submitted and approved prior to issuance of a grading permit. Any
grading requirements recommended by the approved liquefaction
evaluation shall be incorporated in the grading plan.

f) An on-site Improvement Plan is required for this project. Where feasible.
this plan shall be incorporated with the grading plan and shall conform to
all requirements of Section 15.04-167 of the Municipal Code (See
"Grading Policies and Procedures").
g) One or more refuse enclosures (constructed in accordance with City
Standard Drawing No. 508) or trash compactors will be required. The
Refuse Division shall approve the number, placement, size, and type of
refuse enclosures and/or compactors.
h) Retaining walls, block walls and all on-site fencing shall be designed and
detailed on the On-site Improvement Plan. This work shall be part of the
On-site Improvement permit issued by the City Engineer.
i) The on-site improvement plan shall include details of on-site lighting,
including light location, type of poles and fixtures, foundation design.

Photometry calculations shall be provided which show that the proposed
on-site lighting design will provide 1 foot-candle of illumination uniformly
distributed over the surface of the parking lot during hours of operation
and 0.25 foot-candles security lighting during all other hours.
j) The design of on-site improvements shall also comply with all
requirements of The California Building Code. Title 24, relating to parking
and accessibility. including retrofitting of existing building access points for
accessibility. if applicable.
k) An accessible path of travel as shown on the approved site plan_shall be
provided from the public way to the building entrance. All pathways shall
be concrete paved and shall provide a minimum clear width of 4 feet.
Where parking overhangs the pathway, the minimum paved width shall be
6 feet.

I) Where the accessible path of travel crosses drive aisles, it shall be
delineated by striping or textured/colored concrete pavement.
m) A reciprocal easement shall be recorded prior to grading plan approval if
reciprocal drainage, access, sewer, and/or parking is proposed to cross lot
lines, or a lot merger shall be recorded to remove the interior lot lines.
n) The project Landscape Plan (interior and Harry Sheppard Boulevard)*
shall be reviewed and approved by the City Engineer prior to issuance of
a grading permit. Submit 5 copies to the Engineering Division for
Checking.
* The Tippecanoe Avenue landscaping scheme (in front of the screen
wall) is addressed in Planning condition no. 24, and will be determined by
the applicant, Planning Division, and Parks, Recreation, and Community
Services Department.
0) The public right-of-way, between the property line and top of curb (also
known as "parkway") along Tippecanoe Avenue and Harry Sheppard
Boulevard shall be landscaped by the developer and included in a
landscape maintenance district. However, the applicant/developer is
required to maintain this area. In the event that the landscaping is not
maintained, the City will activate the landscape maintenance district.
The remainder of the landscaping along Tippecanoe Avenue (from the
property line to the screen wall) and Harry Sheppard Boulevard (from the
property line to the parking areas) shall be landscaped by the developer
and included in a Property Owner's Association, as per the IVDA.
However, the applicant/developer is required to maintain this area. In the
event that the landscaping is not maintained, the IVDA will activate the
Property Owner's Association.

p) The landscape maintenance district and Property Owner's Association
shall be formed prior to issuance of grading permit or, the Developer will
provide a Letter of Agreement for Participation in a Landscaping
Maintenance Assessment District.
q) Separate sets of Landscape Plans shall be provided for the Landscape
Maintenance District.
r) An easement and covenant shall be executed on behalf of the City to
allow the City to enter and maintain any required landscaping in case of
owner neglect. The Real Property Section for execution by the property
owner and shall ensure that, if the property owner or subsequent owner(s)
fail to properly maintain the landscaping, the City will be able to file
appropriate liens against the property in order to accomplish the required
landscape maintenance. A document processing fee in the amount of
$200.00 shall be paid to the Real Property Section to cover processing
costs. The property owner, prior to plan approval, shall execute this
easement and covenant unless otherwise allowed by the City Engineer.
3. Utilities
a) All public utilities serving the site must be designed and constructed in
accordance with City Codes and standards, and the requirements of the
serving utility, including gas, electric, telephone, water, sewer and cable
TV (Cable TV is optional for commercial, industrial, or institutional uses).
b) Backflow preventers shall be installed for any building with the finished
floor elevation below the rim elevation of the nearest upstream manhole.
c) The developer is required to install sewer main extensions adequate to
serve the site and project.

d) This project is located in the sewer service area maintained by the City of
San Bernardino and any necessary sewer main extension shall be
designed and constructed in accordance with the City's "Sewer Policy and
Procedures" and City Standard Drawings.
e) Utility services shall be placed underground and easements provided as
required.
f) A street cut permit will be required for utility cuts into existing streets
where the street is not being repaved as part of the required
improvements.
g) All existing overhead utilities adjacent to or traversing the site on either
side of the street shall be undergrounded in accordance with Section
19.20.030 (non-subdivisions) of the City's Development Code.
h) Existing Utilities which interfere with new construction shall be relocated at
the Developer's expense as directed by the City Engineer, except
overhead lines, if required by provisions of the Development Code to be
undergrounded.
i) Sewers within private streets or private parking lots will not be maintained
by the City but shall be designed and constructed to City Standards and
inspected under a City On-Site Construction Permit. A private sewer plan
designed by the developer's engineer and approved by the City Engineer
will be required. This plan can be incorporated in the grading plan, where
practical.
j) Prior to issuance of a Certificate of Occupancy, a parcel map application
must be approved by the Planning Commission, and the parcel map shall
be recorded by the County Recorder.

k) A Street Lighting Maintenance District shall be formed prior to issuance of
a grading permit or the Developer will provide a Letter of Agreement for
participation in a Street Lighting Maintenance Assessment District.
4. Street Improvement and Dedications
a) All public streets within and adjacent to the development shall be
improved to include combination curb and gutter, paving, handicap ramps,
street lights, sidewalks and appurtenances, including, but not limited to
traffic signals, traffic signal modifications, relocation of public or private
facilities which interfere with new construction, striping, shall be
accomplished in accordance with the City of San Bernardino "Street
Improvement Policy" and City "Standard Drawings", unless otherwise
approved by the City Engineer. Street lighting, when required, shall be
designed and constructed in accordance with the City's "Street Lighting
Policies and Procedures". Street lighting shall be shown on street
improvement plans except where otherwise approved by the City
Engineer.
b) For the streets listed below, dedication of adequate street right-of way
(R.W.) to provide the distance from street centerline to property line and
placement of the curb line(C.L.) in relation to the street centerline shall be
as follows:

c) Construct accessible ramps in accordance with City Standard No. 205 at
all curb returns within and adjacent to the project site. The developer may
need to dedicate additional right-of-way at the corners to accommodate
the ramps.
d) Construct driveway approaches in accordance with City Standard No.
204, Type II, including by-pass. Remove existing driveway approaches
that are not part of the approved plan and replace with full height curb &
gutter and sidewalk.
e) All Curb return radii shall be 25 feet minimum.
f) Curb returns at the truck entrance shall be 35 feet unless otherwise
approved by the City Engineer.
g) Construct the median (including landscaping) in Tippecanoe Avenue in
accordance with approved and filed Drawing No. 9053/No. 10525. Median
cuts and/or left turn lanes will be permitted, as shown on the approved
Tippecanoe Avenue median drawing.
h) The main truck egress/ingress area at Harry Sheppard Boulevard and
Tippecanoe Avenue shall be constructed with new concrete pavement, at
the full width of the street, a minimum of 125' in both directions from the
centerline of the access drive, unless the applicant can demonstrate that
the existing pavement is adequate to the sole satisfaction of the City
Engineer.
i) The main truck egress/ingress at Harry Sheppard Boulevard shall be
striped as per Attachment A. This includes three ingress lanes and one
egress lane. Inbound trucks will be limited to the two inside lanes, leaving
the outside ingress lane for access to the San Manuel Indian facilities on
the east.
j) Revise the striping plan for Harry Sheppard Boulevard showing dual
westbound left-turn lanes at Tippecanoe Avenue.

shall deposit 25% of the estimated fees2 to be used against time and
material charges for the services provided by the City.

d) This project is greater than 5 acres and the drainage fee is estimated to
be $102.583.68. This estimate is_based on a charge of $0.455 per square
foot for the first 3,000 square feet of impervious lot area (estimated as
85% of the net lot area), $0.156 per square foot for each square foot over
3,000 square feet but less than 5 acres, and $0.049 per square foot for
each square foot of impervious area over 5 acres. This fee may be
reduced in accordance with City of San Bernardino Reso. No. 1999-335
for existing buildings and impervious areas. It is the applicant's
responsibility to provide supporting documentation for a reduction in these
fees. The City Engineer shall determine the exact amount, and the
applicant shall pay the fee, prior to issuance of a Building Permit.
e) Traffic system fee in the estimated amount of $149,194.700, based on
8,221 trips per day at 18.148 per new trip generated by the project. This
fee may be reduced in accordance with City of San Bernardino Reso. No.
1999-335 for existing buildings. It is the applicant's responsibility to
provide supporting documentation for a reduction in these fees. The City
Engineer shall determine the exact amount, and the applicant shall pay
the fee, prior to issuance of a Building Permit.
The City will conduct trip counts at the existing facility in Chino and/or at
this facility, within one and a half years after issuance of the Certificate of
Occupancy. At that time, the City will re-evaluate the traffic data, and
adjust the fees accordingly.
f) This project is subject to an additional historical traffic unit fee as identified
in City of San Bernardino Resolution No. 2003-72.
g) A portion of the Traffic Systems Fee paid for this commercial/industrial
project can be credited to the initial developer (entity paying the fees)
based on the actual cost of installation of the new traffic signal or upgrade
of existing traffic signals for the mitigation of traffic related conditions
identified in the project review process and required as part of the
approved development. See Resolution No. 88-140.

h) Sewer Connection Fee in the approximate amount as follows based on
$257.70 per 3,000 square feet or fraction thereof: $103,595.40 This fee
may be reduced in accordance with City of San Bernardino Reso. No.
1999-335 for existing buildings. It is the applicant's responsibility to
provide supporting documentation for a reduction in these fees. The City
Engineer shall determine the exact amount, and the applicant shall pay
the fee, prior to issuance of a Building Permit.
i) Sewer Inspection Fees in the estimated amount of $21.72 per connection.
j) Street or easement dedication processing fees in the amount of $ 200.00
per document.
k) Revise striping plan for Harry Sheppard Boulevard showing dual
westbound left-turn lanes at Tippecanoe Avenue.
I) Revise Table "0" in the Mattei Distribution Facility Traffic Assessment
prepared by LSA Associates, dated May 21, 2003, for contribution to
reflect the original "ITE" trip generation to be use to determine Mattei's
contribution for the SBITC Specific Plan traffic-related improvements.
m) The applicant shall rehabilitate or repave Tippecanoe Avenue from Mill
Street to Central Avenue/Palm Meadows Drive, prior to issuance of a
Certificate of Occupancy. This improvement shall be in accordance with
the direction of the City Engineer.
In lieu of completing this requirement, the applicant may deposit $80,000
with the City of San Bernardino Public Services Department. This funding
shall be used by the City to make repairs to Tippecanoe Avenue from Mill
Street to Central Avenue/Palm Meadows Drive. The funding shall be
received prior to issuance of a Certificate of Occupancy.
