Background: On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital Improvement Program (CIP), for Street Safety Improvements at Various Locations (Annual), 2005/06, (SS-C). The project consists of construction of curb-gutter, sidewalk, catch basin, CMP storm drain, and pavement repair. The purpose of this project is to complete Chestnut Avenue between Washington Street and Irvington Avenue. After completion of the curb, gutter and sidewalk at this location, GFR Homes has agreed to complete the paving on this reach of Chestnut Avenue to provide an enhanced entrance to the area. The plans and specifications for this project have been completed and the project was opened to public bidding on January 10, 2006. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, High Desert Plan Room, Construction Bid Board, Reed Construction Data, Bid America, Construction Bid Source, Bid Ocean and the City's web sites, and with the San Bernardino Area Chamber of Commerce. This project is under design but has been delayed due to processing requirements for federal Highway Bridge Replacement and Rehabilitation (HBRR) funding. Funding for SS04-67 will be restored in the FY 06/07 budget year. Recommendation: I. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. Bonadiman-McCain, Inc., 280 South Lena Road, San Bernardino, CA 92408, is the lowest responsible bidder for Street Improvements per Revision No. One of Drawing NO.1 Ll93 at Chestnut Avenue fi'om Station 14+21.53 to lrvington Avenue (SS-C 05/06), per Plan No. I LllJ3. A contract is awarded accordingly to said bidder in a total amount of $ 59,5 14.00, with a contingency amount of $ 9,558.90, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on Ii Ie in the officc of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, l11odliications or waivers are intended or authonzed and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution. AID.
