SUBJECT
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
execution of a third amendment to the Memorandum of Understanding with the County of San
Bernardino Probation Department to administer the grant funded juvenile accountability program
known as Intervention and Management of Probationer Accountability and Compliance of Terms
(IMP ACT).
BACKGROUND
On April 16, 200 I, the City Council ratified Resolution #2001-73 authorizing the execution of a
Memorandum of Understanding (MOU) with the San Bernardino County Probation Department.
The MOU defines the operating agreement between the two organizations as they administer the
IMP ACT grant. This MOU was amended pursuant to Resolution #2002-116, ratified on April
15, 2002.
IMP ACT initially consisted of five two-man teams, each team consisting of one probation officer
and one police officer. One police sergeant and a probation supervisor supervise the unit.
IMP ACT is funded by two grants. The primary grant is a Bureau of Justice Assistance
Innovative Concept grant that is administered by the County Probation Department. This grant
initially paid for four of the IMPACT teams, the probation supervisor, and partial payment of the
police supervisor. IMP ACT received additional funding from the City's Juvenile Accountability
Incentive Block Grant (JAIBG) funds. JAIBG paid for the majority of the personnel cost for the
fifth IMP ACT team. The remaining City personnel costs are funded through asset forfeiture
funds. The JAIBG grant was not renewed for FY 04/05 as the program purpose areas were
changed to where IMP ACT type programs are not funded.
Probation Department's IMPACT grant was renewed for FY 04/05 at the reduced amount of
$247,369. Based on the reduced funding level the Probation Department has proposed to
continue the program with one two-man team, consisting of one probation officer and one police
officer. Probation's funding for FY 05/06 is $394,657, with $116,550 allocated towards the cost
of one (1) police officer.
Probation has requested a third amendment to the IMP ACT MOU to address FY 05/06 grant
funding levels. The proposed change is as follows:
1. Fiscal Procedures: Section A, Program Funds, as amended, currently states, "DOJ
funding awarded to the County of San Bernardino will fully fund one probation
officer and one police officer including salary and benefits for fiscal year
commencing July 1, 2004 and ending September 30, 2005. If additional funding
becomes available, sufficient to fund additional teams of one probation officer and
one police officer, including salary and benefits, additional teams, up to a maximum
of five teams, may be added." The proposed change makes the applicable dates July
1, 2005 and ending September 30, 2006.
FINANCIAL IMPACT
The proposed third amendment to the IMP ACT MOD will have no direct cost to the City. Costs
associated with the continuing the IMP ACT program at a reduced staffing level will be borne by
the Night Light Program (IMP ACT) grant administered by the County of San Bernardino
Probation Department. The City of San Bernardino Police Department as a sub grantee will
receive $116,550 towards the salary and benefits cost of one (1) police officer assigned to the
program. This grant was factored into the FY 05/06 Budget.
RECOMMENDATION

SECTION 1.
The Mayor and Common Council of the City of San Bemardino
authorize the Mayor to execute a third amendment to the agreement between the City of San
Bemardino Police Department and the County of San Bemardino Probation Department to
administer the grant funded juvenile accountability program known as Intervention and
Management of Probationer Accountability and Compliance of Terms (IMPACT).
SECTION 2.
The authorization to execute the above referenced amendment is
rescinded ifnot issued with one hundred twenty (120) days of the passage ofthis resolution.

MEMORANDA OF UNDERSTANDING WITH THE CITY OF SAN BERNARDINO
RECOMMENDATION: Approve Amendment No.2 to Agreement 01-366 between San Bernardino
County and the City of San Bernardino (City) for the Intervention and Management of Probationer
Accountability and Compliance of Terms (IMPACT) program, in the amount of $111,000, for the period July
1, 2004 to June 30, 2005.
BACKGROUND INFORMATION: On April 27, 2004 the Board of Supervisors approved the submission of
a fourth-year IMPACT program plan/application to the Department of Justice (DOJ), in the amount of
$247,369. The program reduces juvenile violence and crime in the City through intervention by probation
officer/police officer teams. The collaborative program was designed to target youthful offenders to reduce
gang involvement, remove firearms, provide intensive supervision of high-risk offenders, and provide
alternatives to delinquent conduct by directing at-risk youth into positive activities.
The Department received electronic notification of the 2004-05 grant award on September 3, 2004, and
staff developed an amended MOU to update the mutual responsibilities between the County and City. On
October 26, 2004 the Board accepted the grant award from the DOJ. The Department indicated at that
time it would return to the Board for approval of the signed MOU upon receipt from the City, which occurred
on November 15, 2004.
The current MOU wiih the City serves as the operating agreement that governs both the collaboration
between agencies and the provision of funding for one team's police officer portion of program services,
with the provision that additional teams may be created if additional funding becomes available. Approval
of this Recommendation would authorize the distribution of grant funds to the City in the amount of
$111,000 for the period July 1,2004 to June 30, 2005.
REVIEW AND APPROVAL BY OTHERS: This item has been reviewed and approved as to legal form by
County Counsel (Dawn Stafford, 387-5471, Deputy County Counsel) on November 22, 2004; and the
County Administrative Office (Laurie Rozko, 387-8997, Administrative Analyst) on November 23,2004.
FINANCIAL IMPACT: There is no local cost impact associated with this item. Staffing costs associated
with this program are fully funded by the grant award. Under the terms of the grant, no matching funds are
requIred. Sufficient appropriations and revenue were included in the Department's FY 2004-05 budget.
