Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino awarding a Contract to
Olivas Valdez, Inc., for Street Widening Improvements on Palm Avenue at BNSF Railroad Grade
Crossing North of Cajon Boulevard (SS 04-04), per Plan No. 11354, and authorization for the Director
of Finance to amend the FY 05/06 Budget.
Background:
In early 2002, the City entered into an agreement, No. 53-R946, with BNSF and the State Department
of Transportation (Caltrans) to widen Palm Avenue in the vicinity of the BNFS tracks to compliment
the relocation of the crossing gates and the installation of a third Transcontinental track. The original
agreement called for the project to be completed by December 31, 2003 or funding for the project
would be revoked. The deadline was extended once by Caltrans to December 31, 2004. The deadline
was further extended to December 31, 2005, only due to the City Engineer's commitment to have the
project complete by December 31, 2005. Caltrans recently agreed to the extension, but made it clear
that no further extensions would be granted. The crossing gates have been relocated at a cost of
approximately $317,000. The project must be awarded in order to maintain funding from the State.
On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06
Capital Improvement Program (CIP), for Street Widening Improvements on Palm Avenue at BNSF
Railroad Grade Crossing North of Cajon Boulevard (SS 04-04), per Plan No. 11354.
Prices have increased dramatically, subsequent to the Katrina hurricane. These increases were not
anticipated at the time the original engineer's estimate was calculated.
This project consists of the following:
1. Removal of existing worn asphalt, grading, filling of soil to the level of the new tracts.
2. Construction ofPCC curbs, medians, X-gutters and sidewalks.
3. Striping of the northbound lane to allow 2 lanes of traffic.
4. Replacement of roadway conditions that were disturbed by the project and installation of the
automatic warning arms in the median by BNSF.
The plans and specifications for this project have been completed and bids were received on
September 27, 2005. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, Construction Data Hot Sheet, Reed Construction
Data and Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino
Area Chamber of Commerce.

Based on review of the sealed competitive bids received, staff has determined that Olivas Valdez, Inc.
of Covina, the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced
contract to Olivas Valdez, Inc.
Financial Impact:
The estimated project costs are as follows:

If approved, this project is expected to begin construction in late November of 2005 and be completed
by December of2005.
For FY 2005-06 the following funds were allocated:

A budget amendment for $157,100 is needed to totally fund this project. The funds needed are being
moved from the State Street project because funds are available and are not anticipated to be
completely expended due to environmental studies projected completion date of July 2006. There will
be no impact to the construction phase of the State Street project.
Recommendation:
1. Authorize the Director of Finance to amend the FY 05/06 Budget by transferring $157,100.00 from
Account No. 129-367-5504-7245 "State Street Construction - Phase 1B & 3 (SS04-09)" to Account
No. 129-367-5504-7231, for Street Widening Improvements on Palm Avenue at BNSF Railroad
Grade Crossing north of Cajon Boulevard (S04-04), per Plan No. 11354;
2. Adopt Resolution.

GRADE CROSSING NORTH OF CAJON BOULEVARD (SS 04-04), PER PLAN NO.
11354.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Olivas Valdez, Inc., 846 N. Charter Drive, Covina, CA 91724, is the
lowest responsible bidder for Street WIdening Improvements on Palm Avenue at BNSF Railroad
Grade Crossmg north of Cajon Boulevard (SS 04-04), per Plan No. 11354.
A contract is awarded accordingly to said bidder in a total amount of $248,265.00, with
a contingency amount of $39,200.00, but such award shall be effective only upon being fully
executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
authorized and directed to execute said contract on behalf of the City; a copy of the contract is
on file in the office of the City Clerk and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.

adopted Resolution No. 2005-369 - Resolution awarding a contract to Olivas Valdez, Inc., for
Street Widening Improvements on Palm Avenue at BNSF Railroad Grade Crossing North of
Cajon Boulevard (SS 04-04), per Plan No. 11354, and Authorization for the Director of Finance
to amend the FY 05/06 Budget.
Attached are one (1) certified copy of Resolution No. 2005-369, one (1) original bound contract,
and three (3) duplicate original bound contracts. The contracts have been executed by the
Mayor, City Attorney, and City Clerk. Please obtain signatures where indicated and return one
fully executed original bound contract to the City Clerk's office as soon as possible to my
attention. Please distribute the remaining bound contracts accordingly.
Please be advised that the resolution and contract will be null and void if not executed
