Background: On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital Improvement Program (CIP), for the Construction of ADA Access Ramps and Sidewalk at Various Locations, Phase VII, 2005/06, (SS-B), per Plan No. 11056. This project consists of the following: I. Removal of curb-gutter, sidewalk, asphalt and existing ramps. 2. Construction of curb-gutter, sidewalk, ADA ramps, and asphalt. 3. Replacement of striping, signage and roadway improvements. This project is a continuation of our annual project to eliminate barriers within the public right-of-way throughout the City. The locations to receive improvements were based, in part, on a survey of intersections conducted in May 2000. Criteria for establishing a priority list of location to receive ADA improvements were developed based on the proximity of government building, schools, hospitals, retail, entertainment and recreation sites (city parks etc.). Staff also maintains a list of locations needing improvements identified by the Mayor, City Council, and by the public. Areas of the City to receive improvements are rotated each year so that all parts of the City will eventually receive improvements. The overall goal is to eliminate all barriers throughout the City. The plans and specifications for this project have been completed and bids were received on October I], 2005. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Bid Board, Construction Data Hot Sheet, Reed Construction Data and Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of Commerce. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO KALBAN, INC. FOR CONSTRUCTION OF ADA ACCESS RAMPS AND SIDEWALK AT V ARIOl'S LOCATIONS, PHASE VII, 2005/06, (SS-B), PER PLAN NO. 11056 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Kalban, Inc., 9075 Glenoaks Bou]evard, Sun Valley, CA 9]352, is the lowest responsible bidder for Construction of ADA Access Ramps and Sidewalk at Various Locations, Phase VII, 2005/06, (SS-B), per Plan No. 11056. A contract is awarded accordingly to said bidder in a total amount of $263,330.00, with a contingency amount of $39,500.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3.
