Resolution of the Mayor and Common Council of the City of San Bernardino awarding a Contract to DBX, Inc.
for southwest and southeast corner improvement and traffic signal modifications at Base Line Street and Mt.
Vernon Avenue; traffic signal improvement at Valencia Avenue at 30th Street and Mountain Avenue at
Northpark Boulevard; and traffic signal modifications at University Parkway at the 1-215 Ramps (TC05-06,
TC04-39, SS05-09, TC05-04, TC04-34) per Plan Nos. 11328B, 11436 and 11561 and authorization for the
Director of Finance to amend the FY 05/06 Budget.
Background:
On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital
Improvement Program (CIP), for the Southwest and Southeast Corner Improvement and Traffic Signal
Modifications at Base Line Street and Mt. Vernon Avenue (TC05-04), and Traffic Signal Improvement at
Valencia Avenue at 30th Street (TC04-34), Mountain Avenue at Northpark Boulevard (TC05-06), and Traffic
Signal Modifications at University Parkway at the 1-215 Ramps (TC04-39), per Plan Nos. 11328B, 11436 &
11561.
This project consists ofthe following:
1. Upgrade of curb returns and traffic signal at the southeast and southwest corners of Mt. Vernon A venue
and Base Line Street TC05-04).
2. Upgrade of the existing traffic signal at Valencia Avenue at 30th Street to include new poles, mast arms
and protected left-turn phases for all approaches. Additionally, pedestrian push buttons and ADA
accessible ramps are included in the project (TC04-34).
3. Install a new full-phase traffic signal at the intersection of Mountain Avenue at Northpark Boulevard
(TC05-06).
4. Upgrade striping, signing and the existing traffic signal at the 1-215 ramps on University Parkway
(TC04-39).
The plans and specifications for this project have been completed and bids were received on October 11,2005.
The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction
Bid Board, Construction Data Hot Sheet, Reed Construction Data and Bid America, Construction Bid Source,
the City's web sites, and with the San Bernardino Area Chamber of Commerce.
Bids have been received and are listed below:

Based on review of the sealed competitive bids received, staff has determined that DBX, Inc. of Temecula, the
apparent low bidder, has met the minimum requirements of the specifications and bid guidelines; and, therefore,
recommends that the Mayor and Common Council award the referenced contract to DBX, Inc.

Financial Impact:
The estimated project costs are as follows:

Bid Amount $452,594.00
Contract Management and Inspection (Approx. 13%) $ 59,517.00
Contingencies (Approx. 15%) $ 67,889.00
Estimated Total Proiect Cost $580,000.00
If approved, this project is expected to begin construction in late December of 2005 and be completed by June of
2006.
As indicated in the attached spreadsheet, a shortfall of approximately $181,500 has occurred in the funding for
this proJect. Staff proposes to transfer traffic systems funds from Account No. 250-370-5504-7483 "Highland
Avenue and Central Avenue Traffic Signal (TC04-27)" to cover the shortfall.
Plans for the new traffic signal at Highland Avenue and Central Avenue (TC04-27) are expected to be
completed and ready to bid in approximately two months. The Economic Development Agency has agreed to
fund this signal using Community Development Block Grant (CDBG) funding. This change of funding will free
up the Traffic Systems Fund monies, which were originally allocated to the project, and allow it to be
reallocated to the signals at Valencia Avenue and 30th Street, Mountain Avenue and Northpark Boulevard, and
University Parkway at 1-215. This change offunding will not affect either the scope or completion schedule for
the new signal at Highland Avenue and Central Avenue.
Recommendation:
1. Authorize the Director of Finance to amend the FY 05/06 Budget by transferring $27,500 from Account No.
250-370-5504-7490 "Southwest and Southeast Comer Improvement and Traffic Signal Modifications at
Base Line Street and Mt. Vernon Avenue (TC05-04)" to Account No. 250-370-5504-7493 "Traffic Signal

TC04-39, SS05-09, TC05-04, TC04-34) PER PLAN NOS. 11328B, 11436 AND 11561.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. DBX, Inc., 42066 Avenida Alvarado, #C, Temecula, CA 92590, is the
lowest responsible bidder [or southwest and southeast corner improvement and traffic signal
12 modifications at Base Line Street and Mt. Vernon Avenue; traffic signal improvement at
13 Valencia A venue at 30th Street and Mountain A venue at Northpark Boulevard; and traffic signal

modifications at University Parkway at the 1-215 Ramps (TC05-06, TC04-39, SS05-09, TC05-
04, TC04-34), per Plan Nos. 11328B, 11436 & 11561

A contract is awarded accordingly to said bidder in a total amount of $452,594.00, with
a contingency amount of $67.889.00, but such award shall be effective only upon being fully
19 executed by both pm1ies. All other bids, therefore, are hereby rejected. The Mayor is hereby

authorized and directed to execute said contract on behalf of the City; a copy of the contract is
on file in the office of the City Clerk and incorporated herein by reference as fully as though set
22

forth at length.
SECTION 2. This contract and any amendment or modifications thereto shal1 not take
effect or become operative until fully signed and executed by the parties and no party shal1 be
25
26 obligated hereunder until the time of such full execution. No oral agreements, amendments,
27

modifications or waivers are intended or authorized and shall not be implied from any aet or
course of conduct of any party.

Attached are one (1) certified copy of Resolution No. 2005-367, one (1) original bound contract,
and three (3) duplicate original bound contracts. The contracts have been executed by the
Mayor, City Attorney, and City Clerk. Please obtain signatures where indicated and return one
fully executed original bound contract to the City Clerk's office as soon as possible to my
attention. Please distribute the remaining bound contracts accordingly.
Please be advised that the resolution and contract will be null and void if not executed
