Recommended Motion:
1. Authorize the Director of Finance to amend the FY 2005/06 Budget by transferring $111,600 from Sewer
Line Maintenance Fund balance to Account No. 132-431-5505-7475 "SW-D Sewer Siphon Flushing at
Various Locations" and transferring $23,400 from Unallocated Sewer Line Maintenance Fund balance to
Account No. 132-431-5505-7567 "SW06-03 "South "E" Street Sewer Siphon Cleaning".

Subject:
Resolution awarding a contract to Downstream Services, Inc. for Cleaning Sewer Siphons at Various Locations
in the City of San Bernardino (SW-D 2005/2006), per Project Plan No. I 1340B, and authorization for the
Director of Finance to amend the FY 05/06 Budget.
Background:
On August I, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital
Improvement Program (CIP) for Cleaning Sewer Siphons at Various Locations in the City of San Bernardino
(SW-D), per Project Plan No. 11340B.
The Public Services Department requested that Project No. SW06-03 "South "E" Street Sewer Siphon
Cleaning" be bid with this project as an additive alternate. This siphon has been a maintenance problem for the
cleaning crews.
This project consists of the following:
I. Proper traffic control.
2. Cleaning of sewer siphons per Specifications No. 11340B.
3. Video each siphon for damage and for future maintenance projects.
The plans and specifications for this project have been completed and bids were received on September 13,
2005. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge,
Construction Bid Board, Construction Data Hot Sheet, Reed Construction Data and Bid America, Construction
Bid Source, the City's web sites, and with the San Bernardino Area Chamber of Commerce.
Bids have been received and are listed below:

Based on review of the sealed competitive bids received, staff has determined that Downstream Services, Inc.
of Escondido. the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced contract to
Downstream Services, Inc.

The estimated project costs are as follows:

If approved, this project is expected to begin construction in late October of 2005 and be completed by January
of 2006.
Adequate funding for these projects is available in FY 2005/2006 CIP, subject to adjustment of the various
accounts as indicated in the attached spreadsheet "Sewer Improvement Cost Distribution for Project No.
11340B."
Recommendation:
1. Authorize the Director of Finance to amend the FY 2005/06 Budget by transferring $111,600 from
Unallocated Sewer Line Maintenance Funds to Account No. 132-431-5505-7475 "SW-D Sewer Siphon
Flushing at Various Locations" and transferring $23,400 from Unallocated Sewer Line Maintenance Funds

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO DOWNSTREAM SERVICES, INC.
FOR CLEANING SEWER SIPHONS AT VARIOUS LOCATIONS IN THE CITY OF
SAN BERNARDINO (SW-D 2005/2006), PER PROJECT PLAN NO. 11340B
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Downstream Services, Inc., 2855 Progress Place, Escondido, CA 92029,
is the lowest responsible bidder for Cleaning Sewer Siphons at Various Locations in the City of San
Bernardino (SW-D 2005/2006), per Project Plan No. 11340B
A contract is awarded accordingly to said bidder in a total amount of $184,584.40, with
a contingency amount of $27,727.94, but such award shall be effective only upon being fully
executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
authorized and directed to execute said contract on behalf of the City; a copy of the contract is
on file in the office of the City Clerk and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any pm1y.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
