Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
execution of Amendment No. I to the Agreement for Consultant Services in Collaboration with
District for the CAPS Program between the City and the San Bernardino Unified School District.
Back2:round:
The Children's After-School Program for Success (C.A.P.S.) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The city has been a sub-contractor to the school district in this
program since 1999. The schools provide teachers and aides to teach educational and tutorial
programs. The Parks, Recreation and Community Services Department has been asked to
provide arts and crafts and other recreational activities to the youth.
The CAPS Program was offered at nine elementary schools when first implemented. The
program expanded to 17 schools in 2003 - 04. The agreement in July 2004 provided for three
additional sites for after-school programs and 10 before-school programs; a total of 30 programs
at 20 school sites for a period beginning July 1, 2004 through June 30, 2005.
The original Agreement was for $401,109 and the amendment increases the original Agreement
by an amount not to exceed $42,700 for a new aggregate total of $443,809. The term of the
original Agreement (July I, 2004 through June 30, 2005) will remain the same.
This increase will allow for additional staff at each of the CAPS schools.
Financial Impact:
The original agreement amount was for $401,109 to cover 100 percent of costs for part-time
staff. This amendment will allow the department to provide additional staffing at existing
program sites, Monday - Friday. Supplies and equipment are provided by the district.
There is no financial impact to the City. The program supervision is provided by the existing
staff already covered in the department's general fund budget.
Recommendation:

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council of the City of San Bernardino is hereby
authorized to execute Amendment No. 1 on behalf of said City, an amended agreement for
9
10 additional funding with the San Bernardino City Unified School District to provide contractual
11 services for before & after-school recreation programs at school district sites. A copy of said
12 agreement is hereby attached hereto, marked Exhibit "A", and incorporated herein by reference
13 as fully as though set forth at length.
14 ! SECTION 2. The authorization granted hereunder shall expire and be void and of no

DIVISION OF STUDENT SERVICES - CAPS OFFICE
THIS AMENDMENT is made and entered into this 2nd day of January, 2006, by and
between the SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT, hereinafter
referred to as the "DISTRICT", with its principal place of business at 777 N. "F" Street,
San Bernardino, California 92410, and, CITY OF SAN BERNARDINO, PARKS,
RECREATION AND COMMUNITY SERVICES, hereinafter referred to as the "CITY"
having a principal place of business at 547 N. Sierra Way, San Bernardino, California
92410.
R E C IT A L S:
WHEREAS, the CITY is authorized under the terms and conditions of the original
Agreement entered into on the 18th day of July, 2005, to provide a variety of learning
experiences in the area of art, fitness and sports skills, and values through the
provisions of Recreational Aides at each school participating in the CAPS Program;
and,
WHEREAS, any increase or revision in the Agreement is accomplished by means of an
amendment;
NOW, THEREFORE, the DISTRICT and the CITY mutually agree to amend the existing
Agreement as follows:
1. The amount payable to the CITY as specified in Section IV (Al City's Fee and
Payment Thereof, of the original Agreement shall be increased by an amount
not to exceed Forty-two Thousand Seven Hundred Dollars ($42,700,00) for a
new aggregate total of not-to-exceed Four Hundred Forty Three Thousand Eight
Hundred Nine Dollars ($443,809.00).
2. This Amendment is effective upon execution. In the event of any conflict or
inconsistency between the provisions of this Amendment and the original
Agreement, the provisions of this Amendment shall control. All other terms and
conditions of the original Agreement shall remain the same.
IN WITNESS WHEREOF, the parties have executed this Amendment in duplicate as set forth
below.

At the Mayor and Common Council meeting of February 6, 2006, the City of San Bernardino
adopted Resolution No. 2006-34 - Resolution authorizing the execution of Amendment No. 1 to
the agreement for consultant services in collaboration with district for the CAPS Program
between the City and the San Bernardino Unified School District.
Attached are one (1) original agreement and two (2) duplicate original agreements. - Please
obtain signatures in the appropriate locations and return the ORIGINAL contract to the City
Clerk's Office as soon as possible, to my attention. Please keep the remaining two (2) fully
executed copies for your records and for the other party.
Please be advised that the resolution and contract will be null and void if not executed
within sixty (120) days from the date of adoption, or returned to our office by Thursday,
