"F" Street San Bernardino, CA 92410 909- 381-11 00 Representatives: URS Group, Inc. 10723 Bell Court Rancho Cucamonga, CA 91730 909-980-4000 LSA Associates 20 Executive Park Ste. 200 Irvine, CA 92614-4731 949-553-0666 BACKGROUND: Section 21151.2 of the Public Resources Code requires the governing board of a school district to provide written notice to the Planning Commission with jurisdiction prior to acquiring property for expansion or development of a school. Section 65402 or the Government Code requires the Planning Agency to respond within 40 days to the school district with a report on consistency of the proposed school facility with its General Plan. Failure to respond within 40 days is deemed a finding of consistency. If the Planning Agency finds that the proposed facility is not consistent with the General Plan, the governing body of the school district may overrule the finding and carry out its program. In late June (June 20 and June 24), the San Bernardino City Unified School District (District) submitted requests for findings of consistency with the City General Plan for four proposed elementary school sites: . Monterey II Elementary School, proposed on the north side of Ninth Street, approximately 500 ft. east of Tippecanoe Avenue; . Alessandro II Elementary School, proposed at the southwest comer of Baseline Street and Herrington Avenue; . Burbank II Elementary School, proposed at the southeast comer of Rialto Avenue and Allen Street; . Wilson II Elementary School, bounded by 26th Street on the north, Arrowview Middle School on the south, "F" Street on the east and "G" Street on the west. Staff prepared reports and recommended findings to present to the Planning Commission on July 19, 2005. The staff reports to the Planning Commission (Exhibits 1-4) contain full analyses of applicable General Plan policies and objectives. Three of the school sites are recommended for findings of consistency with the General Plan, as substantiated in the Planning Commission staff reports. Development of Wilson II Elementary School at the site proposed by the District would conflict with General Plan Objectives 1.37 and 1.6, which cite the importance of compatibility Page 3 of 4 with surrounding residential areas, maintaining the character of the community and not adversely impacting the quality of life of City residents. Staff recommends a finding that development of Wilson II Elementary School would not be consistent with the General Plan, based on the following concerns about the proposed site: . The proposal would break up a stable neighborhood with 80% owner occupancy, a model the City is striving to replicate in other areas. . The proposal would require vacation of a segment of 25th Street, making 26th Street the first available east-west street north of Highland Avenue, in a neighborhood where local circulation is already impeded by Arrowview Middle School. . The subject neighborhood is already impacted by traffic related to dropping off and picking up students at Arrowview Middle School. Addition of another school site at the proposed location would worsen these impacts. . The location of Arrowview Middle School on a major thoroughfare (Highland Avenue) increases the potential for outside influences on the middle school students, including exposure to gangs. The Police Department recommends against introducing elementary school students adjacent to this particular middle school (Exhibit 5). As lead agency for school site development under the California Environmental Quality Act (CEQA), the District is responsible for environmental analysis of the proposed actions of site acquisition and development. CEQA requires the lead agency to provide notice and an opportunity to review and comment on the draft analysis to all responsible agencies which will have permitting authority in the future. Responsible agencies typically rely on the CEQA analysis of the lead agency for their permitting actions. The City will have permitting authority for right-of-way improvements and extension and connection to City water and sewer services for all of the proposed school sites in question. Therefore the City is a responsible agency with a substantial interest in the CEQA analysis for the school sites. City staff became aware that the District had circulated Initial Studies and proposed Mitigated Negative Declarations for three of the school sites for which consistency findings had been requested from the City. These CEQA documents were circulated to the State Clearinghouse in Sacramento, but they were not provided to the City, a responsible agency, for review and comment. The City Attorney obtained copies of the documents with a Public Records Act request, just as the formal 30-day comment period was due to expire. In a letter dated July 15,2005 (Exhibit 6), staff requested that the comment period on the subject CEQA documents be extended, and that the District send notices and copies of proposed environmental determinations for all current and future projects to the City for review as a responsible agency. The District responded in a letter dated July 18, 2005 (Exhibit 7) that the CEQA comment period would be extended to August 18,2005. On July 19, 2005, on recommendations from Development Services staff and the City Attorney's office, the Planning Commission tabled all four consistency finding requests with an indefinite continuance, pending further review of the District's development plans and environmental analysis. In order to meet the 40-day timeframe as specified in the Government Code, staff has scheduled the requested findings of General Plan consistency for action by the Mayor and - Page 4 of 4 Common Council. After completing a review of the environmental documents, staff will respond separately to the District within the extended review period agreed to by the District. FINANCIAL IMPACT None. RECOMMENDATION That the Mayor and Common Council make the following findings: · That Monterey II Elementary School is consistent with the General Plan . That Alessandro II Elementary School is consistent with the General Plan · That Burbank II Elementary School is consistent with the General Plan . The subject 17-acre site is located on the north side of 9th Street, approximately 500 ft. east of Tippecanoe Avenue (Attachment B), in the RM, Residential Medium land use district (Attachment C). THe site is proposed for development of Monterey II Elementary School, a 32-classroom facility that would accommodate 900 students (Attachment D). SETTING AND SITE CHARACTERISTICS The site proposed for development of Monterey II Elementary School is vacant land owned by the District. Land uses surrounding the site include: North: Warm Creek Flood Control Channel and commercial uses on other side. South: Residential uses in the unincorporated area on the south side of 9th Street. East: Multi-family residential units and vacant land in the RM land use district. West: Vacant land in the RM land use district. The District may also expand the campus of Curtis Middle school, located on the south side of 9th Street, on property adjacent to the proposed site of Monterey II. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) The determination of consistency with the City General Plan is not a project subject to CEQA. The San Bernardino City Unified School District would be the lead agency for the project of school site development. BACKGROUND Section 21151.2 of the Public Resources Code requires the governing board of a school district to provide written notice to the Planning Commission with jurisdiction prior to acquiring property for expansion or development of a school. Section 65402 of the Government Code requires the Planning Agency to respond within 40 days to the School District with a report on consistency of the proposed school facility with its General Plan. Failure to respond within 40 days is deemed a finding of consistency. If the Planning Agency finds that the proposed facility is not consistent with the General Plan, the governing body of the school district may overrule the finding and carry out its program. Monterey II is one of several sites under consideration by the District for development of new schools to meet the growing demand for classroom space in the City of San Bernardino. Notification to the Planning Commission for a determination of General Plan consistency will be required for each proposed school site. General Plan Consistency Determination Monterey II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 3 The District has informed the City of its facility needs assessment and has met with City representatives to discuss site selection alternatives on various occasions. The selection and planning process for the Monterey II Elementary School has advanced to the final steps required prior to site development. The District owns the proposed site and has commenced environmental review pursuant to CEQA. FINDINGS AND ANALYSIS When the General Plan was adopted in 1989, existing public schools were designated PF, Public Facilities. Potential school sites were not specifically identified, but addressed through the goals, objectives, and policies in the General Plan. General Plan Objective 1.37 states: "It shall be the objective of the City of San Bernardino to provide for the continuation of existing and development of new parks, schools, government administrative, police, fire, social service, and other public facilities and open spaces in proximity to and compatible with residential uses." The site proposed for development of Monterey II Elementary School by the San Bernardino City Unified School District was selected as the best site to serve the needs of elementary school children residing in the immediate vicinity. General Plan Policy 1.37.13 states: "It shall be the policy of the City of San Bernardino to permit the continuation and expansion of existing public facilities (police, fire, social service, cemeteries, governmental administrative, and other) in areas designated as "Public Facilities" and new development in any land use zone." The General Plan encourages development of schools, parks and other public facilities in residential areas, to serve the needs of surrounding residents. The proposed location of Monterey II Elementary School would serve students from surrounding residential neighborhoods, and it would be compatible with other facilities in the area, including Curtis Middle School. General Plan Policy 8.7.1 states: "It shall be the policy of the City of San Bernardino to monitor the residential growth of the City and work with the local school districts to expand facilities and services to meet educational needs." The San Bernardino City Unified School District continually monitors student enrollment and prepares enrollment projections to analyze and plan for facility construction needs. Development of Monterey II Elementary School is proposed to alleviate current General Plan Consistency Determination Monterey II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 4 overcrowding at the existing Monterey Elementary School and will serve student needs, consistent with enrollment projections for the surrounding area. CONCLUSION The goals and policies of the General Plan support development of school facilities, as needed to serve the community. The site proposed by the San Bernardino City Unified School District will serve the student population from surrounding neighborhoods. The site is vacant, so no existing land uses will have to be relocated. Development of a school at the proposed location would serve the needs of the community and be compatible with surrounding land uses. Therefore the proposal is consistent with the General Plan. RECOMMENDA nON Staff recommends that the Planning Commission make a finding that development of Monterey II Elementary School, as proposed, is consistent with the General Plan. The attached figure shows the location of the project site. Pursuant to Government Code Section 65402.a and Public Resources Code Section 21151.2. the District is required to give notice in writing of the proposed school site acquisition to the Planning Department/Commission having jurisdiction over a proposed school site. Accordingly, this letter shall serve as formal notice of the proposed acquisition. as well as a request that the Planning Department and/or Planning Commission investigate the proposed site and within 40 days submit written findings to the District of the results of the investigation as to the conformity of the proposed project with the currently adopted General Plan. The subject 13.8-acre site is located at the southwest comer of Baseline Street and Herrington Avenue (Attachment B) in the RS, Residential Suburban and CG-2, Commercial General land use districts (Attachment C). The site is proposed for development of Alessandro II Elementary School, a 32-classroom facility that would accommodate 900 students (Attachment D). SETTING AND SITE CHARACTERISTICS The site proposed for development of Alessandro II Elementary School is approximately 13.8 acres in area, comprised of the following existing land uses: · 3.66 acres (27%) Vacant Land · 29 Single-Family Residences (62% owner-occupied) · 4 Multi-Family Residential Units · I Commercial Building (market) · 1 Church Residences in the area proposed for acquisition were built at various times, from the late 1930's through the 1960's, with most of the construction occurring in the 1950's. Two houses underwent major rehabilitation or reconstruction in 1992 & 1993. The District is exploring the possibility of building the new school adjacent to or surrounding the existing church building and sharing the parking facilities with that use (Attachment D). Land uses surrounding the site include: North: Residential uses fronting Baseline Street in the CG-2 land use district. South: Residential uses in the RS land use district. East: Commercial uses fronting Mt. Vernon Avenue in the CG-2 land use district. West: Commercial and Residential uses in the CG-2 and RS land use districts. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) The determination of consistency with the City General Plan is not a project subject to CEQA. The San Bernardino City Unified School District would be the lead agency for the project of acquisition and development of a school site. BACKGROUND Section 21151.2 of the Public Resources Code requires the governing board of a school district to provide written notice to the Planning Commission with jurisdiction prior to acquiring property for expansion or development of a school. Section 65402 of the General Plan Consistency Determination Alessandro II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 3 Government Code requires the Planning Agency to respond within 40 days to the School District with a report on consistency of the proposed school facility with its General Plan. Failure to respond within 40 days is deemed a finding of consistency. If the Planning Agency finds that the proposed facility is not consistent with the General Plan, the governing body of the school district may overrule the finding and carry out its program. Alessandro II is one of several sites under consideration by the District for land acquisition and development of new schools to meet the growing demand for classroom space in the City of San Bernardino. Notification to the Planning Commission for a determination of General Plan consistency will be required for each proposed school site. The District has informed the City of its facility needs assessment and has met with City representatives to discuss site selection alternatives on various occasions. The selection and planning process for the Alessandro II facility has advanced to the final steps required prior to site acquisition. The District has commenced environmental review pursuant to CEQA, and is now seeking a determination of General Plan Consistency. FINDINGS AND ANALYSIS When the General Plan was adopted in 1989, existing public schools were designated PF, Public Facilities. Potential school sites were not specifically identified, but addressed through the goals, objectives, and policies in the General Plan. General Plan Objective 1.37 states: "It shall be the objective of the City of San Bernardino to provide for the continuation of existing and development of new parks, schools, government administrative, police, fire, social service, and other public facilities and open spaces in proximity to and compatible with residential uses." The site proposed for acquisition by the San Bernardino City Unified School District was selected as the best site to serve the needs of elementary school children residing in the immediate vicinity. General Plan Policy 1.37.13 states: "It shall be the policy of the City of San Bernardino to permit the continuation and expansion of existing public facilities (police, fire, social service, cemeteries, governmental administrative, and other) in areas designated as "Public Facilities" and new development in any land use zone." The General Plan encourages development of schools, parks and other public facilities in residential areas, to serve the needs of surrounding residents. The proposed location of Alessandro II Elementary School would serve students from surrounding residential neighborhoods, and it would be compatible with other land uses in the area. General Plan Consistency Determination Alessandro II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 4 General Plan Policy 8.7.1 states: "It shal1 be the policy of the City of San Bernardino to monitor the residential growth of the City and work with the local school districts to expand facilities and services to meet educational needs." The San Bernardino City Unified School District continual1y monitors student enrol1ment and prepares enrol1ment projections to analyze and plan for facility construction needs. Site acquisition and development of Alessandro II Elementary School is proposed to al1eviate current overcrowding at the existing Alessandro Elementary School and wil1 serve student needs, consistent with enrollment projections for the surrounding area. CONCLUSION The goals and policies of the General Plan support development of school facilities, as needed to serve the community. The site proposed by the San Bernardino City Unified School District wil1 serve the student population from surrounding neighborhoods, and relocation assistance to be offered by the District wil1 minimize impacts on residents and facilities that would have to relocate as a result of the site acquisition. Development of Alessandro II Elementary School would serve the needs of the community and be compatible with surrounding land uses. Therefore the proposal is consistent with the General Plan. RECOMMENDA nON Staff recommends that the Planning Commission make a finding that land acquisition and development of Alessandro II Elementary School, as proposed, is consistent with the General Plan. The Police Department would only recommend approval of a site plan where the school boundaries start west of Herrington Ave. A newly built Walgreens will be located just east of the school at the southwest comer of Baseline and Mt. Vernon, which should have no adverse impact on the school campus. Due to a liquor store and the Elks Lodge located at 11 th and Mt. Vernon, one concern that comes to mind would be illegal drinking, and loitering during the evening hours. Adequate fencing would be necessary to avoid these type of problems occurring on the school grounds during evening hours. The San Bernardino City Unified School District would be the lead agency for the project of acquisition and development of a school site. BACKGROUND Section 21151.2 of the Public Resources Code requires the governing board of a school district to provide written notice to the Planning Commission with jurisdiction prior to acquiring property for expansion or development of a school. Section 65402 of the Government Code requires the Planning Agency to respond within 40 days to the School District with a report on consistency of the proposed school facility with its General Plan. Failure to respond within 40 days is deemed a finding of consistency. If the Planning Agency finds that the proposed facility is not consistent with the General Plan, the governing body of the school district may overrule the finding and carry out its program. General Plan Consistency Determination Burbank II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 3 Burbank II is one of several sites under consideration by the District for land acquisition and development of new schools to meet the growing demand for classroom space in the City of San Bernardino. Notification to the Planning Commission for a determination of General Plan consistency will be required for each proposed school site. The District has informed the City of its facility needs assessment and has met with City representatives to discuss site selection alternatives on various occasions. The selection and planning process for the Burbank II facility has advanced to the final steps required prior to site acquisition. The District has commenced environmental review pursuant to CEQA, and is now seeking a determination of General Plan Consistency. FINDINGS AND ANALYSIS When the General Plan was adopted in 1989, existing public schools were designated PF, Public Facilities. Potential school sites were not specifically identified, but addressed through the goals, objectives, and policies in the General Plan. General Plan Objective 1.37 states: "It shall be the objective of the City of San Bernardino to provide for the continuation of existing and development of new parks, schools, government administrative, police, fire, social service, and other public facilities and open spaces in proximity to and compatible with residential uses." The site proposed for acquisition by the San Bernardino City Unified School District was selected as the best site to serve the needs of elementary school children residing in the immediate vicinity. General Plan Policy 1.37. I3 states: "It shall be the policy of the City of San Bernardino to permit the continuation and expansion of existing public facilities (police, fire, social service, cemeteries, governmental administrative, and other) in areas designated as "Public Facilities" and new development in any land use zone." The General Plan encourages development of schools, parks and other public facilities in residential areas, to serve the needs of surrounding residents. The proposed location of Burbank II Elementary School would serve students from surrounding residential neighborhoods, and it would be compatible with surrounding land uses in the area. General Plan Policy 8.7.1 states: General Plan Consistency Determination Burbank II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 4 "It shall be the policy of the City of San Bernardino to monitor the residential growth of the City and work with the local school districts to expand facilities and services to meet educational needs." The San Bernardino City Unified School District continually monitors student enrollment and prepares enrollment projections to analyze and plan for facility construction needs. Site acquisition and development of Burbank II Elementary School is proposed to alleviate current overcrowding at the existing Burbank Elementary School and will serve student needs, consistent with enrollment projections for the surrounding area. CONCLUSION The goals and policies of the General Plan support development of school facilities, as needed to serve the community. The site proposed by the San Bernardino City Unified School District for development of Burbank II Elementary School will serve the student population from surrounding neighborhoods, and relocation assistance to be offered by the District will minimize impacts on residents and facilities that would have to relocate as a result of the site acquisition. Development of a school at the proposed location would serve the needs of the community and be compatible with surrounding land uses. Therefore the proposal is consistent with the General Plan. RECOMMENDATION Staff recommends that the Planning Commission make a finding that land acquisition and development of Burbank II Elementary School, as proposed, is consistent with the General Plan. The subject 8.5-acre site is located at the southeast comer of 26th Street and "G" Street, adjacent to the northern boundary of Arrowview Middle School (Attachment B) in the RS, Residential Suburban land use district (Attachment C). The site is proposed for development of Wilson II Elementary School, a 32-classroom facility that would accommodate 900 students (Attachment D). SETTING AND SITE CHARACTERISTICS The site proposed for development of Wilson II Elementary School is approximately 8.5 acres in area, located in an existing single-family residential neighborhood. There are 40 single family residences on the proposed site, built primarily in the late 1920's and the 1930's. The properties are well maintained and some of the homes have undergone major improvements recently. 80% of the homes in this area are owner-occupied, and the only vacant lot in the area is owned by the adjacent homeowner. Land uses surrounding the site include: North: Residential uses in the RS district. South: Arrowview Middle School East: Residential uses in the RS district. Despite serious concerns and opposition expressed by the City, the District's planning process for the Wilson II facility has advanced to the final steps required prior to site acquisition. The District has commenced environmental review pursuant to CEQA, and is now seeking a determination of General Plan Consistency. FINDINGS AND ANALYSIS When the General Plan was adopted in 1989, existing public schools were designated PF, Public Facilities. Potential school sites were not specifically identified, but addressed through the goals, objectives, and policies in the General Plan. General Plan Objective 1.37 states: "It shall be the objective of the City of San Bernardino to provide for the continuation of existing and development of new parks, schools, government administrative, police, fire, social service, and other public facilities and open spaces in proximity to and compatible with residential uses." In accordance with this objective, the San Bernardino City Unified School District proposes to develop a new school site to serve the needs of elementary school children residing in the area currently served by Wilson Elementary School. Unfortunately, the specific site proposed by the District for development of Wilson II is located in a very stable, well-maintained and cohesive neighborhood. Demolition of 40 existing homes and vacation of a segment of 25th Street as proposed would impact the existing neighborhood adversely. This would not be compatible with the surrounding residential area, and therefore would conflict with General Plan Objective 1.37. General Plan Objective 1.6 states: "It shall be the objective of the City of San Bernardino to control the development of land uses which may adversely impact the character of the City and quality of life of its residents." Although it is often necessary to demolish existing structures and displace residents and businesses from existing neighborhoods to provide much-needed public facilities, development of the site proposed for Wilson II Elementary School would be detrimental to the character of the City and the quality of life of its residents. Most of the sites proposed by the District for development of new schools require displacement of General Plan Consistency Determination Wilson II Elementary School Site Planning Commission Hearing Date: 7/19/05 Page 4 residents and other existing facilities. However, these other sites generally exhibit a wide variety of building types and varying levels of property maintenance, interspersed with vacant parcels. The site proposed for development of Wilson II Elementary School is part of a fully developed, stable and cohesive neighborhood, evidenced by the high level of owner occupancy. It is a fine example of a 70-yr. old neighborhood that has stood the test of time and continues to thrive. Intrusion into this neighborhood with the demolition of 40 homes would also eliminate numerous examples of Tudor Revival and California Bungalow architecture that currently enhance the character of the community. General Plan Policy 8.7.1 states: "It shall be the policy of the City of San Bernardino to monitor the residential growth of the City and work with the local school districts to expand facilities and services to meet educational needs." The City has been a willing and active partner in site selection for various school facilities planned by the San Bernardino City Unified School District to meet the educational needs of the residents of San Bernardino. The site selected by the District for development of Wilson II is not consistent with General Plan Objectives 1.37 and 1.6. The City has proposed alternate locations for the District to consider, and the City is willing to continue working with the District to identify an appropriate alternative site, pursuant to Policy 8.7.1. CONCLUSION The goals and policies of the General Plan support development of school facilities, as needed to serve the community. The site proposed by the San Bernardino City Unified School District would serve the student enrollment demand from surrounding neighborhoods. However, it would have unacceptable impacts on the neighborhood selected for acquisition, to the detriment of the surrounding community. Staff is recommending a finding that development of Wilson II Elementary School, as proposed, would not be consistent with the General Plan, based on the following concerns about the particular site under consideration: . The proposal would break up a stable neighborhood with 80% owner occupancy, something the City of San Bernardino is striving to achieve in other areas. The proposal would require vacation of 25th Street, making 26th Street the first available east-west street between "F" and "G" streets north of Highland Avenue. Local circulation is already impeded by Arrowview Middle School. The existing neighborhood is already impacted by traffic related to dropping off and picking up students at Arrowview Middle School. Addition of another school site at the proposed location will increase this traffic. The location of Arrowview Middle school on a major thoroughfare increases the potential for outside influences on the middle school students, including exposure to . . . The Police Department recommends against introducing elementary school students adjacent to this particular middle school. RECOMMENDA nON Staff recommends that the Planning Commission make a finding that acquisition of the site proposed for development of Wilson II Elementary School is not consistent with the City General Plan. I. Alessandro II: The Proposed Alessandro II Elementary School Site is located southwest of the intersection of Baseline Street and Herrington A venue in the County of San Bernardino, California. The proposed project consists of 40 parcels, and comprises approximately 601,128 square feet, or approximately 13.8 acres. The proposed elementary school will total 32 classrooms and would provide education facilities for 900 students in grades K-6. The jurisdiction's General Plan designates the subject site as Residential Suburban District (RS) and Commercial General District (CG-I). 2. Burbank II: The Proposed Burbank II Elementary School Site is located between West Rialto Avenue, South Allen Street, Valley Street, and Waterman Avenue in the County of San Bernardino, California. The proposed project consists of 43 parcels and comprises approximately 435,600 square feet, or approximately 10.0 acres. The proposed elementary school will total 20 classrooms and would provide education facilities for 600 students in grades K-6. During a previous meeting between City staff and San Bernardino City School District (SBCSD) staff, it was disclosed that the SBCSD was planning on constructing Wilson II Elementary School north of the existing Arrowview Middle School, south of 26th Street, east of G Street and west of F Street. The Police Department has concerns with the construction of a new elementary school in that area for the following reasons: . This will build a school next to the middle school, which is located on a main street (Highland). That school, due to I) its fronting Highland and 2) the age of the attendees, will attract gang members and other suspects who like to hang around schools. Needless to say, that issue could have an impact on the students attending the elementary school as well as additional public safety problems for the Police Department. . This is predominately a residential area. Thus, the traffic patterns created in the neighborhoods by parents who pick up and drop of kids will significantly impact the neighborhood. That issue has become a major problem for neighborhoods throughout Southern California as it really impacts people who live in the surrounding community. . Finally, it will close the east/west streets north of the existing Arrowview Middle School- thereby causing residents and drivers to go several blocks before they can access some of the surrounding neighborhoods or streets. This letter indicated that I believed that the City is a responsible agency under CEQA and as a responsible agency has both the right and the duty under CEQA to review and comment on the environmental documents for these proposed school sites. To date, I have not received a response to my inquiry or the environmental documents. I recently became aware from the CEQAnet database through the Governor's Office- of Plal1l}ing and Research that the public review and comment period ends on July 14, 2005 for the above two schools. I further noticed that the review period for the proposed Wilson II elementary school is from June 21, 2005 through July 20,2005. However, the City has not received a Notice of Intent for any of these schools. Without the opportunity to review the environmental documents and comment on potential environmental impacts and recommend mitigation measures, if any, the City as a responsible agency, cannot represent that we can provide services necessary to these sites. In addition to the above, proce'eding with the environmental determination for Wilson II is especially problematic. The City has repeatedly told the District that it has concerns with the , ,r SBCUSD Proposed School Sites July 15.2005 Page 2 proposed location of this school. Presumably, the environmental document addresses the vacation of2S1h Street and Berkeley Avenue to accommodate the schoo\. The City has repeatedly told the District that the City cannot support, and strongly opposes these street . vacations for numerous reasons, including but not limited to the unmitigable impact on traffic on surrounding streets as a result of these street closures. As it appears that the District failed to follow proper procedures under CEQA by sending any environmental documents to the City who is a responsible agency under CEQA, the City hereby reserves the right to raise any issues which it could have raised during the comment period in any future litigation that may be filed on behalfofCity and/or City Municipal Water Department. Furthermore, as a responsible agency, the City is again requesting that the City be sent all notices of intent or notices of preparation of an EIR as well as any other environmental documents for any future sch'ool sites located in the City of San Bernardino. In closing, the City and City Municipal Water Department are formally opposed to the adoption of Negative Declarations for Burbank II, Alessandro II, and Wilson II elementary schools and are requesting that the District extend the review period for at least an additional thirty (30) days to allow the City and Water District to properly respond to these environmental documents. In your letter, you refer to an earlier letter from you to me, dated June 21,2005. I and my staff were not aware of this letter. We have conducted a search of our files; cannot find your letter or a record of receiving this letter; and have not had the opportunity to address any request you made in this letter. In response to your current letter, we want you to know that the District desires the City's engagement in such important matters as the current one. We are pleased to extend the review and comment period for the City for thirty days from the date of your letter through Monday, August 15,2005. We will assume that this extension is acceptable to the City of San Bernardino unless we hear otherwise from you by the close of business on July 21 st. ~'- Copies of the mitigated negative declaration reports for the Alessandro II, Burbank II and Wilson II school sites are attached for your review and comment. We would like to suggest a meeting within two weeks to address any preliminary issues or concerns that the City might have iden~ified regarding these reports. One objective of that meeting would be to attempt to resolve most or all of the City's issues, if any, prior to the end of the review period. A second objective would be to establish any necessary follow-up meetings within the review period. Please be assured that the School District has always tried to kee~ the City involved in new school location and construction matters. In fact, as recently as June 161 , the City Attorney's office made various requests including a written request for the status on CEQA for two of the three identified new school sites that you referred to in your letter: Wilson II and Alessandro II (copy attached). As part of our response to that request, the District made available exclusively to the City originals of the entire negative mitigation reports, receipt of which was acknowledged in writing by the City staff. As far as we know, these originals are still in possession of the City. As described in the July 15,2005, Staff Report, the proposed site is located in the RS (Residential Suburban) land use district, and is not within any overlay district. Furthermore, the proposed location is to the immediate north of Arrowview Middle School. The General Plan recognizes the importance of providing adequate educational facilities for the City's growing population, and encourages the construction of new schools: Goal1A of the General Plan states: It shall be the goal of the City of San Bernardino to: Provide for the continuation and development of sufficient land uses to serve the housing, commercial, educational. cultural, recreational, and social needs of existing residents C and population growth. Obiective 1.1 states: It shall be the objective of the City of San Bernardino to: Provide lands for the housing and commercial and public services for the City's existing population and growth of 70,300 persons. This proposed location would accomplish Goal 1 Gj: Goal1Gi: It shall be the goal of the City of San Bernardino to: Locate commercial and human services, recreation, andjobs in proximity to residents. Obiective 1.37 states: It shall be the objective of the City of San Bernardino to: Provide for the continuation of existing and development of new parks, schools, government administrative, police fire, social service, and other public facilities and open spaces in proximity to and compatible with residential uses. Associated Policy 1.37.11 states: It shall be the policy of the City of San Bernardino to: Permit the continuation of existing and expansion of existing schools in areas designated as Public Facilities (PF) and new develoDment in anv residential zone (in accordance with Public Service Policies 8.7.1 through 8.7.3) (JJ.1 and 11.18) Policy 1.37.30 calls for the City to: Coordinate with public agencies to ensure that public buildings are designed to be compatible in scale, mass, character, and architecture with the adiacent buildinf!s in o which they are located and in accordance with the standards for design and development stipulated for the location or zone in this Plan (11.18) Policy 1.37.31 calls for the City to: Require that public sites be designed to incorporate landscape setbacks, walls, and other appropriate elements to buffer their use, as required from adjacent uses (traffic, noise, etc. (Il.18). Discussion: Objective 1.37 was cited in the Staff Report as a basis for a finding of non- consistency. However, the Objective clearly expresses a preference for locating schools in close proximity to residential uses. The proposed location meets this Objective, and is permitted in this zone. The school is proposed to be designed in keeping with the character of the neighborhood, and will incorporate appropriate buffers, as required. According to the General Plan, the neighborhood to the immediate north was identified with at least ten "deteriorated" properties. Although, the dwellings to be demolished include structures constructed prior to 1955, the neighborhood is not recognized as a historic district, and is not subject to an historic overlay. Prior to the demolition of any pre-1955 building, further research and recordation will be completed as mitigation. o Obiective 1.6: It shall be the objective of the City of San Bernardino to: Control the development of land uses. which may adversely impact the character of the City and quality of life of its residents. Discussion: This Objective was cited in the Staff Report as reason for staff recommendation for denial of the District request. We believe that this Objective was not intended to be applied to the location selection of new educational facilities. Rather, the associated Policies clearly direct the Objective's application to industrial facilities with identified toxic pollutants, alcohol sales, and adult businesses, as well as those associated with high levels of noise, nighttime patronage and high crime. The associated policies furthermore, direct the location of such uses away from schools. These policies follow. o Associated Policies: It shall be the policy of the City of San Bernardino to: 1.6.1 Control the development of industrial and other uses which use, store, produce or transport toxics, air emissions, and other pollutants; requiring adequate mitigation measures confirmed by environmental review (Il.1, Il.6, Il.7). 1.6.2 Control the location and number of alcohol sales, adult bookstores and businesses, flame arcades and other communitv-sensitive uses, based on vroximitv to residences, schools, religious facilities. and parks, in accordance with legislative and legal requirements (11.1. 11.6, and 11. 7). 1.6.3 Require Police Department review of uses which may be characterized historically by hiflh levels of noise, niflhttime vatronafle, and/or rates of crime; providing for the conditioning or control of use to vrevent adverse imvacts on () o o ad;acent residences, schools. religious facilities, and similar "sensitive" uses (Il.1, Il.6, n.7, and 1.8). Displacement Concerns referenced by Terri Rahal and Valerie Ross in the July 19, 2005 Staff Report to the Planning Commission. The District offers the following response: Of the 40 housing units, none are vacant; 28 are owner-occupied; and, 12 are rented to tenants. Traffic Concerns referenced by Terri Rahal and Valerie Ross in the July 19, 2005 Staff Report to the Planning Commission The Traffic Analysis undertaken pursuant to the Initial Study concluded that there would be no significant effect associated with the vacationing of 25th Street. Specifically, the District provides the following responses: Commellt: The proposal would require vacatioll of a segmellt of 25111 Street, makillg 26111 Street the first available east-west street Ilorth of Higltlalld Avellue, ill a Ileighborhood where local circulatioll is already impeded by Arrowview Middle School. Response: This intersection is located at the northwest comer of the proposed site. This is a "T" intersection with 26th Street terminating into G Street. 26th Street is a local neighborhood collector approximately 25ft wide. It is assumed that volumes on 26th Street and at this intersection are almost zero and used only for local access for the few residents located on 26th Street. It is anticipated that the addition of the school and 174 AM peak period trips to the area will not adversely affect movements at this intersection. The few residents that use this street will still be able to make right or left turns onto G St with minimal delays. It is anticipated that minimal trips generated by the school will use 26th Street for access to the site. School buses will use 26th Street to access the bus pick-up/drop-off area on the north side of the propose property. Institute of Transportation Engineers (ITE) publication Trip Generation 6'11 Edition states that on average 60% of elementary school students are bussed to their schools. It is estimated that approximately 360 students will be bussed to and fro.m the school site (600 X .60). Conventional Blue Bird school buses hold between 48 and 78 children depending on size. Using 50 as an average we can estimate that seven to nine buses would be required to transport the students of Wilson Elementary depending on the density of students per bus. Approximately seven to nine buses will use 26th Street to access the school during the AM peak period. This will not adversely affect the LOS of the intersection or roadway. This topic is revisited in the section on Site Access. o As part of the proposed project, the north-south neighborhood collector, N. Berkeley Avenue, would be abandoned. The roadway serves very few residents and provides no substantial benefit to access, circulation, or emergency services beyond that provided to the few existing dwellings. Access to W. 26th Street on the north, where N. Berkeley Avenue terminates, is provided to the west by North G. Street and to the east by North F. Street, both of which have more right-of-way. Likewise, W. 25th Street is provided access via the same streets. With the development of the school any future demand for this north-south roadway will be eliminated as the residences adjacent to N. Berkeley Avenue will be purchased and demolished negating the need of this roadway. Abandonment of this roadway will not cause an increase in traffic on adjacent roadways or degrade circulation in the area. Furthermore, access for emergency services vehicles will not be hampered or restricted in any way by eliminating N. Berkeley Avenue. Consequently, the abandonment of N. Berkeley Avenue will have no significant impact on access, circulation, or emergency services. Comment: The subject neighborhood is already impacted by traffic related to dropping off and picking up students at Arrowview Middle School. Addition of another school site at the proposed location would worsen these impacts. o Response: Site access is limited to G Street that can be reached from the south via Highland Avenue and from adjacent neighborhoods. Local arterials provide adequate capacity for users of the school. There are no grade, curve, or sight-distance issues associated with this property. Site plans include two driveways on G Street and bus facilities on 26th Street. The driveways located on G Street provide parking and pick- up/drop-off facilities while the driveways on 26th Street provide bussing facilities. This design allows for concurrent pick-up and/or drop-off of students by both bus and private vehicle with negligible friction while providing an adequate flow of vehicles through the site with minimal delays. Approximately seven to nine buses will use 26th Street to access the school during the AM peak period. It is anticipated that school bus operations will not adversely affect the LOS of the intersection or roadway. Current on-street parking fronting the school on 26th Street will need to be evaluated and potentially restricted to allow adequate turn radius for the buses entering and exiting the bus pick-up/drop-off area. o o o o Children's Exposure to Gangs Concerns referenced by Terri Rahal and Valerie Ross in the July 19, 2005 Staff Report to the Planning Commission: Comment: The location of Arrowview Middle School on a major thoroughfare (Hig/zland A venue) increases the potential for outside influences on the middle school students, including exposures to gangs. The Police Department recommends against introducing elementary school students adjacent to this particular middle school (Exhibit 5). "Exhibit 5" to the July 27, 2005, Request for Council Action provided to you by Staff, was not provided to the District until July 29, 2005. The District has not had a opportunity to prepare a response. Notification Chronology The Mitigated Negative Declaration (MND) was provided to the City on July 18, 2005, in response to the July 15, 2005, letter from Valerie Ross, requesting an extension of 30- days for City review, which was granted by the SBCUSD. Ms. Terry Rahal was provided a request for a Consistency Determination on June 9, 2005, with electronic follow-up on July 5, 2005. Furthermore, the State Clearinghouse was provided 12-copies of the MND on June 14, 2005. The City Attorney's office was provided a copy of the Draft MND on June 16,2005, and public review copies were made available by the District at both the Board of Education Building (777 "F" Street) and the City (Feldheym) Library (555 W. 5th Street).
